Florida Judge Punches Public Defender in His Chambers (Video)

"You want to fuck with me?" the voice was heard saying, as the sound of scuffling and crashing debris echoed throughout the courtroom from behind the closed door. "Do you?!" the voice repeated as more slams could be heard.

"All right!" the other voice screamed out.

The judge, who apparently had just finished beating up a public defender in his chambers, walked back out to his courtroom to applause from those listening in disbelief.

Judge John Murphy, a Brevard County judge who once applied to be a Florida Supreme justice, apparently had had enough lip from public defender Andrew Weinstock during a hearing on Monday.

The two seemed to have tension as Murphy was pushing Weinstock to get his client to waive his right to a speedy trial.

In the video, Weinstock delivers some dismissive answers when Murphy asks him about what he wants to do.

With that, Murphy seems to lose his patience, saying, "You know, if I had a rock, I would throw it at you right now. Stop pissing me off. Just sit down."

"You know I'm the public defender," Weinstock replies. "I have a right to be here, and I have a right to stand and represent my client."

That's when Murphy had apparently had had enough of Weinstock's disrespect.

"If you want to fight, let's go out back and I'll just beat your ass," he tells Weinstock.

Inexplicably, Weinstock then follows Murphy back into the judge's chambers, where it doesn't take long for the fisticuffs to start flying.

The video's audio, found by WFTV, captured the violent sounds of a scuffle and things crashing as Murphy yells at Weinstock.

It took two deputies to separate the men.

Murphy then walked back into the courtroom and sat back at his bench.

"I will catch my breath eventually," he then said. "Man, I'm an old man."

WFTV reports that Weinstock thought the two men were going to talk out their differences. But, the report says, as soon as he was out of the courtroom, Murphy grabbed him by the collar and proceeded to beat him up.

WFTV also reports that Weinstock was left with a bruise on his head following the altercation.

So far, no charges have been filed, but the incident is being reported to the Florida Bar.

Disgraceful!  A judge attempts to coerce a PD into waiving his client's Constitutional right, and when the PD won't give in, the judge resorts to assault & battery on camera?!?!  While court is in session?!?!  Why the hell didn't the deputies arrest this criminal?  Why is this cruel joke of a judge, and poor excuse for a public servant, still allowed to serve on the bench?  Please, please, please Mr. Weinstock, lodge a criminal complaint against this violent, tyrannical egomaniac!  A judge who brazenly commits violent crimes on camera in his own courtroom, shouldn't be allowed to pass judgement on others for one second!


Code of Judicial Conduct, Cannon 3B(4):  "A judge shall be patient, dignified, and courteous to litigants, jurors, witnesses, lawyers, and others with whom the judge deals in an official capacity . . ."


784.011  Assault:

(1)  An "assault" is an intentional, unlawful threat by word or act to do violence to the person of another, coupled with an apparent ability to do so, and doing some act which creates a well-founded fear in such other person that such violence is imminent.

(2)  Whoever commits an assault shall be guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083


784.03  Battery; felony battery:

(1)(a)  The offense of battery occurs when a person:  1.  Actually and intentionally touches or strikes another person against the will of the other; or 2.  Intentionally causes bodily harm to another person.

Judge John C Murphy is a public figure and, as such, he does not have a right to privacy for anything, including his public records.
He lives at 3152 Bellwood Circle in Rockledge, Florida 32955-5111.
According to the County Tax office, the residence is listed in his wife's name.
I would publish his personal phone numbers, but he has recently had three of them disconnected.

Well.... that was a lot to take in! If that had been you or me as the judge they(the judicial system) would have arrested me on the spot because the assault was obviously witness by the 2 deputies that broke the assault. I admire the PD for sticking up for his client despite the VERBAL ABUSE he received and if the guy(judge) had invited me to fight it out I would have put in the second punch and then there wouldn't not have been a judge to go back to the courtroom as he would be on his way to the hospital via EMS for treatment. However, Mr. Weinstock showed he had more control of his emotions and temper than our fine upstanding ELECTED judge.


Folks remember Judge Murphy when he runs next election, do you really want him hearing your case and passing judgment??????

The judge tried to get the public defender to waive his client's rights, and when he refused to acquiesce the judge threatened him (assault) in open court and physically struck him (in the back hallway that leads from the chambers to the court)? And it's all on tape?! If this judge is cleared of wrongdoing we'll know how much justice exists in Floriduh - as if we needed a reminder after Casey Anthony, George Zimmerman, Marissa Alexander, Jameis Winston and/or Rachel Hoffman.

Wow! That is one shitty judge! Good on the PD for standing up for his client in the face of a demand from the judge that his client waives his rights. Absolutely out of line for that judge.

@Nomore Asserting a client's right to a constitutionally protected speedy trial is not being "mouthy." It's called "being a fucking attorney." Just because you don't personally like the fact that the constitution covers everyone, and not just you and your buddies, doesnt make this "judge's" actions appropriate.  You sound childish and asinine by suggesting this

one "judge" is being removed for selling her clients out as an attorney before being a judge
