Kaitlyn Hunt's Charges Will Not Be Dropped, Florida State Attorney Says

Florida state attorney Bruce Colton says the charges against Kaitlyn Hunt, the Sebastian River High School student who was arrested on charges of "lewd and lascivious battery of a child 12 to 16 years old" because of her same-sex relationship with a fellow student, will not be dropped.

Kaitlyn's family had started a petition,written to Colton, and Assistant State Attorney, Brian Workman, explaining Kaitlyn's story, and pleading for understanding and for them to have the charges dismissed. The petition explains that the two girls began dating when Kaitlyn was 17, and that the other girl's parents are blaming their daughter's homosexuality on Kaitlyn. The petition received 56,500 signatures.

Colton explained that the public petition will not sway prosecutors from dismissing the charges.

"The idea is to protect people in that vulnerable group from people who are older, 18 and above," he said. "The statute specifically says that consent is not a defense."

"There's a big maturity difference between them," Colton added. "You're talking the difference between a senior in high school and a freshman in high school. That's what the law is designed to protect."

"If this was an 18-year-old male and that was a 14-year-old girl," Indian River County Sheriff Deryl Loar said, "it would have been prosecuted the same way."

If convicted, Kaitlyn's second-degree felony charges are punishable by up to 15 years, and she might need to register as a sex offender.

While the state is not dropping the charges, Colton says they've offered a plea agreement of two years house arrest and one year probation. Kaitlyn's family's lawyers have until Friday to decide to take the deal.

Kaitlyn has received an overwhelming amount of support online, particularly from those who believe this is a gay rights issue. There are those who oppose her, and use the staunch Florida law as a reasoning to push their bigotry.

The family says Kaitlyn's girlfriend's parents are pressing charges because they simply can't handle their daughter being in a same-sex relationship.

"They are out to destroy my daughter, because they feel like she 'made' their daughter gay," Hunt explains in a Facebook letter. "They see being gay as wrong and they blame my daughter. Of course, I see it 100% differently. I don't see or label these girls as gay. They are teenagers in high school experimenting with their sexuality - with mutual consent. And even if their daughter is gay, who cares? She is still their daughter."

Indian River county detectives reportedly conducted a recorded phone call between the two high school students to develop grounds for an arrest. In the call, Kaitlyn told the girl she loved her.

Sexualy Misconduct...ok..but that's all it should be.  TAke a poll at any high school and see how many 14 or 15 year olds are having sex with older guys.   The schools would empty out fast..This is all serious, I agree, but the parents are being vindictive and very non Christian.   Tell them to pray about it...

They wiretapped the damn phone? Who is this vindictive DA anyway. This is like using an elephant gun to hunt a rabbit. It is so over the top it is unbelievable. And now saying "I love you" is a felony in Florida. This is more like entrapment than any kind of justice. Who is this caveman?

This is the same State that was going to allow a white man to stalk and unarmed black teenager then gun him down in cold blood, after making racist statements, before public pressure caused them to have second thoughts. It is time to turn up the public pressure once again so justice can be served. Florida seems to have a big problem getting things right the first time.

who among us would like to have been CONVICTed of an indiscretion in OUR teens ?

who really thinks these two KIDs have the maturity and knowledge to properly deal with their emotions and raging hormones as other than immature and inexperienced KIDs that they are ?

in UTAH for example, they both would be considered as potential wives to an older man, possibly a very older man, possibly a man with multiple other wives, and how is that acceptable ?

whatever happens here it will not be easy due to the minor being required to be protected by law as it SHOULD work AND that eventually that minor will be old enough to make an adult decision which may indeed show, if they do ultimatley become a couple, that any strict and harsh punishment of the senior now to be premature and excessive

so far what better defense can ms hunt have than these pictures of a glowing smiling pretty young girls' face

Yes, as a matter of fact this IS a gay rights issue. When you seek equality, that means equality in all things, including punishment for criminal activity. An 18 year old boy having sex with a 14 year old girl would be prosecuted if the parents involved law enforcement. (And read the arrest documents, the girl was actually 13 when this all started.) This is no different. Sadly, fighting for preferential treatment in cases like this only sets the gay rights movement back.

This girl should do time. She corrupted and damaged the younger girl's life. I have been through a very similar situation, except the older girl was not 18. The younger girl, take away from the influence of the "lesbian" is now happily strait with a nice boyfriend. A 15 year old is far too young to be deciding if they are gay or not. And don't give me the "born gay" crap, because identical twin studies prove that wrong.

I just wonder if anyone has asked the 14 year old girl her opinion? I know she is still a teenage girl but she obviously wanted to be with this girl too. I understand that if this was a case with boy-girl relationship no one would even be reading this story, but the fact is that Florida laws are backwards. No, I don't agree with any 18 year old being with any 14 year old. Both girls were in a relationship before Kaitlyn was 18, why did the parents wait for her to turn 18 to stop the relationship. This sounds like a hate crime also

The education system lumps 4 classes with age difference into "high school", yet somehow they ( SAO) have decided that an 18 year old student is too old to socialize with other high school mates. Brilliant.

A 14 year old CHILD cannot possibly be emotionally able to understand being in love or understand the relationship that she is in. If an 18 year old boy was with a 14 year old girl I would have the same problem. That is why these laws and statutory rape were put on the books. I cannot believe this girls parents are standing behind her and not advising her to drop the relationship. Why risk having to register as a sex offender for the rest of your life? To get your face on the news? To get your name on-line with change.org?!? Quit exploiting your daughter and do the right thing!! By their own admission they don't even believe that she is gay, they think that she is "experimenting" so this is not true love (by their own admission) protect your daughter!! That is your job, just as it is the right and job of the parents of the minor child to press criminal charges against the ADULT that is having sexual relations with their CHILD!!

This is a miscarriage of "justice".  If she was a boy, nothing would have been done.  But because she is a girl, and they BOTH are still girls, they will ruin her for life with this prosecution.

I think this is selective prosecution at its worst, and a clear example of bigotry.  There is no question that there would not be such a high profile arrest and prosecution had this been a case of heterosexual lovers.  The comparison of course wouldn't be one of an older teen boy, younger teen girl, but the opposite, an older high school girl, younger high school boy.  I wonder how many times that combination has received this kind of vindictive approach by the state and the police.  It seems to me they are trying to teach lesbians (and gays) "a lesson." I certainly hope the overwhelming national and international condemnation of what is being done to Kaitlyn pressures the state into dropping the charges. Her expulsion and government-encouraged harassment by bigots is already damage enough for what I hope will be a very large lawsuit.  Mentioning Salem or the Scopes monkey trial by comparison is hardly hyperbole, considering how far the rest of the country has come.  If I weren't so outraged I'd be laughing at how backwards and absurd it is for the government to be wasting tax money on this kind of witch hunt.  It's time to stop the hate, it really is.

I think it has less to do w/ gender than it does w/ the ages. Give it a rest. If it was a 18 guy w/ a 14 y/o girl, I doubt you'd be calling for his release.

@aclcuhh Unfortunately, no. Guess what? Since she is considered a minor, her thoughts and opinions must not matter. And since she is allowed no voice of her own, she get to be treated like her parents property, while they dictate what they want her POV to be to the public.

@KennyPowersII In Florida the age of consent is 18. That means charges could be brought against two seniors having a consensual relationship if one is 18 and the other one has not yet turned 18. The Florida law is abstinence only in reality. Just how backwater is that. And with the law being broken tens of thousands of times a day how do they cherry pick the one case a year they prosecute. Think about it.

@jgolden1971 Your nuts.  First off, an 18 year old is not considered an "adult".  And what would you prefer?  To completely segregate the age groups?  It is impractical to say the least.  Its time to admit that your just upset that two girls hooked up.

Remember, the child's parents filed charges.  police have to arrest, but its up to SAO to prosecute.   we will see how the trial goes.. most likely.

@parentrap This is exactly correct. Those parents let a sick teenager, filled with confusion about what is right and wrong, loose on society. They needed to educate the girls on what is right and wrong, as the public school system can no longer provide that information.

@parentrap Quite possibly this is the worst comment I have ever read.  They are both in high school and are not even close to a pedophile.  When I was a freshman of 14, years ago, my first girlfriend was 18.  If by your standards was accurate, then she would also be thrown in jail.

Enough, our kids are being pushed into the "sexual" world of grownups and the consequences are terrible.  How young is too young?  There are many reasons why adults should not have those kinds of relationships with minors regardless of age.  So it is OK if a 17 y/o is with a 13, how about 16 and 12, how about 15 and 11 or 14 and 10.  These are all kids, agreed but I find something really disturbing in the defense of kids introducing other kids into the sex world at such young ages.  Am I antiquated? perhaps but these relationships are starting at very dusturbing ages 6, 7 and being of sexual nature.  It is time someone said enough!
