Kaitlyn Hunt, Florida Teen, Arrested and Expelled From School For Gay Relationship UPDATED

UPDATE: The Indian River County Sheriff's Office is holding a press conference today at 1:30 p.m. at 4055 41st Avenue in Vero Beach. Those who are supporting Kaitlyn are being encouraged to attend and be a part of a peaceful rally by wearing t-shirts, and carrying signs.

A star student at Sebastian River High School was expelled from school and arrested on "lewd and lascivious battery of a child 12 to 16 years old" charges because of her same-sex relationship with a fellow student.

Kaitlyn Hunt, 18, a cheerleader and basketball player at the school, had been dating her 15-year-old girlfriend, a teammate on the basketball team. But when the relationship became public, everything began to unravel for Kaitlyn.

She was kicked off the team because the coach allegedly feared having a gay couple on the team would bring unwanted "drama." And, once her girlfriend's parents found out about the relationship, they called police, who showed up to the Hunt's home to arrest Kaitlyn, which led to her expulsion from Sebastian River High.

Her parents are fighting the charges as nothing more than simple bigotry.

Kaitlyn's mother, Kelley Hunt Smith, started a "Free Kate" Facebook page, which has swelled to over 14,000 members. The family has also started an online "Stop The Hate" petition, which so far has over 40,000 signatures.

The family says Kaitlyn's girlfriend's parents are pressing charges because they simply can't handle their daughter being in a same-sex relationship.

"They are out to destroy my daughter, because they feel like she 'made' their daughter gay," Hunt explains in a Facebook letter. "They see being gay as wrong and they blame my daughter. Of course, I see it 100% differently. I don't see or label these girls as gay. They are teenagers in high school experimenting with their sexuality - with mutual consent. And even if their daughter is gay, who cares? She is still their daughter."

The letter goes on to describe the frightening moments when police showed up to the family's door to arrest their young daughter:

imagine if it was a normal 18 year old guy in a relationship with 15 year old girl in his school

So then I guess laws do not apply to lesbians. is that what this articles is insinuating? If I were a 18-year-old and I had sex with a 15-year-old I would be treated the same way.

Really - it seems like the issue here is that the teammate's parents didn't know how to handle the situation and involved the police instead of at LEAST trying to have a conversation with Kaitlyn's parents.  Granted, 15 and 18 is a little murky.  She's technically an adult but she like JUST became an adult, when not long before they were both considered on the same level.  Which, again, granted, as a child you cannot legally consent, but aside from your brain gradually developing, nothing magical happens to suddenly "make you an adult" when you turn 18.  While I'm on the fence about the age part, I still feel like the potential punishment and being labeled as a "sex offender" would be extreme.

Kaitlyn's mom just doesn't get it.  A child cannot legally give consent to have sex in Florida (and in a lot of other places.)  Her argument just doesn't hold water.

My wife and I live in Florida with our 2 daughters 14 and 10.  I don't want ANY adult trying to have sex with my daughters.  As a parent, that's my call.  If I hear that's happened, someone is going to prison.  Florida law is on my side.

I don't see why the fact she's female should allow her special treatment. If she was male she would have been arrested. And if they started seeing each other when Kaitlyn was 17 then the other girl was only 14 at the time. In PA. the parents of the older person can also be charged if they allowed them to be together in their home. So it isn't because she's female that she got arrested....but they will use the same sex issue to make it seem that she's being treated unfairly. If you ask the 15 year old's parents, would they have had an 18 year old male arrested they would tell you yes.

WHAT?! i had a girlfriend IN THE FOURTH GRADE and im currently 26. are you kidding me right now?! LOL my high school even had a GAY GROUP COUNSELLING class every other week. the orientation of a student should NOT take away their right to get a FREE EDUCATION like the rest of the nation. i hope this girl SUES the school system and the arresting police department for ALL they have!

This tragic story is not about discrimination against gays, but our growing obsession with Predator Panic. Across the USA, children as young as age 9 found themselves listed on public sex offender registries. Behavior that may have been seen as nuisance behavior is now criminalized by an ever-growing industry whose sole mission is to place as many people on a public registry as possible. The sex offender registry was originally intended to be a private list for law-enforcement, with only those proven to be a high risk of re-offense listed in the event of a rare stranger abduction. Today, the registry has over 700,000 names, including thousands of kids under the age of 18 who have engaged in consensual relations with each other or sexting. 


We have proven that having a publicly accessible registry does nothing beneficial to society. This girl is charged with “sexual battery” for an obvious mutual sexual relationship. To use that term implies sexual violence. The registry does not differentiate between a case like this and somebody who has committed a real sexual offense. Florida is one of the worst states for the treatment of those on the registry, putting signs in yards, forcing registrants to live under bridges, and allowing a number of violent vigilante groups to exist.


The commonsense solution would be to abolish the public registry and return it to its original intent, as a tool for law-enforcement agents than those who work primarily with children. Oncefallendotcom for sex offender facts and solutions.

it's like when i was in high school and had to break up with my 16 year old girlfriend once i hit 18. we were together for 2 years but her father was looking for any reason to break us up. and would have had me charged with anything he could have since i was nolonger a minor and she was under 18. there is no difference here. The girl should have known better and knew the law goes for same sex couples as well

Let's be real. Sex is sex and an 18 year old, by law, should not be dating/having sexual relations with a 15 year old. I probably wouldn't go as far as the younger girl's parents did - but I would have to do something.

Actually it is a felony for a person over 18 to be having sex with a person under 16.  It's called statutory rape. But the problem is to prove they were actually having sex.

There are a good number of communities where residents can "take into consideration the circumstance" when deciding what laws they will or will not obey.

These communities are called prisons, and they take in new residents all the time.

No one can interpret the law?  Judges interpret the law all the time.  That's what they're paid to do. 

Additionally, some laws are so clear and unequivocable, not much interpretation is needed.  Here's one:  Thou shalt not kill.  (I realize that's Mosaic law.)   how much interpretation would you need for that one, judas?

@biggadon2000 Read the officer's arrest report (it's searchable online).  I've read it. kaitlyn and the child both have admitted that Kaitlyn put her finger into this child's coochee.  Kaitlyn was 18 at the time and the child was 14.  In Florida that's a felony.  This is a shut and closed case.

Kaitlyn admitted to the officer that she put her finger in this 14 year old girl's coochee.

Kaitlyn  is looking at a minimum of 3 years prison if convicted after a jury trial.

The Florida legislature has amended statutory rape law.  Consent and ignorance of the victim's age are not allowable defenses.

Kaitlyn rejected the prosecutor's offer.  She's going down.

Many years ago i knew a boy who had his virginity relieved form him by a nice 15 yr old girl with much more real world experience than that boy had even dreamed of.... I hate to imagine what the present would be like if he'd been held up to today's standards....
