Florida Senate Bill Wants to Ban Bongs and Glass Pieces

Better be careful with those glass pieces, because if one state rep has his way, you won't be able to pick up a replacement anywhere in Florida. A new bill floating through the Legislature seeks to ban pipes and bongs from retail outlets.

The legislation was filed last December. Right now, it's floating through various subcommittees. But this isn't the first time the state has cracked down on smoking devices that may -- possibly, if someone really wants, in an autonomous personal action completely outside the manufacturer's intentions and legal culpabilities -- be used to smoke illegal drugs. In 2010, the state passed a bill that limited paraphernalia sales to stores that made 75 percent of their income from tobacco sales.

"The new bill builds on the old bill," says Darryl Rouson, the St. Petersburg representative sponsoring the House bill. "Rather than just regulating them, let's just ban them. If we can make people drive to Georgia and Alabama and South Carolina to get fireworks, they can drive to get these utensils of death."
 
If that phrasing didn't clue you in, Rouson is no friend of the paraphernalia trade. Admittedly, he's got a different perspective than most: Rouson was a crack addict before sobering up 15 years ago and today sees bongs and pipes not as good-time party favors but as implements of addiction. His campaign is all about ending the head-shop hypocrisy, as stores can sell the products with wink-wink, nudge-nudge approval as long as you just "use it for tobacco."

"When was the last time you pulled up to a red light and someone was smoking a wad of tobacco out of a colored glass one-shooter?" he asks New Times. "When was the last time you walked into someone's house and on the table was a water pipe they were smoking tobacco out of?"

(Answer: not yesterday.)

Rouson spearheaded the 2010 campaign. After that legislation was passed, a group of head-shop owners got together a legal challenge, hoping to sink the law by questioning its  constitutionality.

After a two-year back-and-forth, a judge in Tallahassee recently ruled on the state's behalf. Rouson took that as a green light to go forward with a proposed all-out ban. Incidentally, Rouson isn't an outsider in the Legislature -- in February, he was elected leader of the House Democrats.

"I believe there is support for it," Rouson says.

I sure don't need to be protected from myself by a crackhead. How did someone this ignorant get elected in the first place? Who ran against him? A serial killer? (Actually, I would vote for Dexter before this clown.) 


Spend your time (and our tax money) on fixing real problems and quit locking up people for trying to medicate with a natural substance you fool.

Florida's policy regarding marijuana is already decades in the past and if lawmakers have their way they will take Florida back to the stone age.  There is a reason why educated young professionals are flocking to states like Washington and Colorado, and why the same demographic is NOT moving to Florida.  Why would the Creative Class move to a state where you can be charged with a felony for having (just 20 grams of pot) the same amount of cannabis that would be legal in other states.  Stop the brain drain, turn Florida's marijuana policy around.  This is just embarrassing.

This is just wrong. I have personally seen Cathy Jordan use a bong and pipes as well. What about the patients who use these devices to deliver their medical cannabis?

Glass is one of the biggest collectibles in the world. Just in case you guys missed Degenerate Arts on Netflix. Obviously you don't care about all the local people that make so much money from glass or all the world wide collectors. Most of the nice glass is never used for anything but to collect. It is never smoked out of period. Just another step towards communism and fueled by news propaganda. While other states are taking totally different approaches Florida wants to hurt their own economy even more.

Former crackhead Representative Darryl Rouson should be aware that you do not use bong pipes to smoke crack, they are for leafy organic substances like medicinal marijuana. While protecting people from themselves might seem laudable, it infringes on personal liberty and is counter-intuitive to the Constitution. No wonder Florida Democrats embrace Rouson. The medical properties of marijuana are unique and irrefutable. Where is Roger Stone when we need him? actually some people smoke tobacco out of water pipes because it is cleaner, drugs are not the problem, it's people with no coping skills, no safety net, no clue how to live their lives that turn to drugs as a answer.

@icculus17 Exactly. The water in a water pipe filters out the tar and carcinogens. However the biggest thing is that most glass is never even smoked from. It is highly collectible and sells sometimes for tens of thousands of dollars for one piece. Obviously Florida makes enough money with the prison system they don't care about supporting or helping local artists.
