Florida Abortion-Ban Bill: "Personal Liberty Is Not a License to Kill"

Once again, the "Florida for Life Act" has been submitted in the Florida Legislature. The bill would ban abortions not related to medical emergencies and would make it a first-degree felony to perform or assist in the performance of an abortion.

Rep. Charles Van Zant has filed the bill on the House side, and Sen. Stephen Wise -- the "Christmas Break" guy -- has filed it in the Senate, which would make abortions legal only if it's an emergency and the woman's life is at risk.

Not surprisingly, the bill uses some Bible-speak to justify the ban.

The bill states that "all human life comes from the Creator" and defines life as beginning at conception.

Further, it states that "personal liberty is not a license to kill" and that the United States Constitution makes no limitation to states making laws "which regard human life as the most fundamental gift from God."

The bill also comes with a stipulation that they beg the Supreme Court to overturn the Roe v. Wade decision and provides a maximum sentence of life in prison for doctors who perform abortions -- or anyone who assists in providing an abortion. Or anyone who runs a place where abortions take place.

It calls for any "induced" abortion to be a first-degree felony for doctors, and performing a legal abortion comes with some hoops doctors have to jump through.

Two doctors have to certify in writing that the woman would die if an abortion were not performed, or one doctor would have to certify in writing that the abortion was a medical emergency.

I submit that, if you haven't read every word of Justice Blackmun's superb majority opinion in Roe v. Wade, then you shouldn't be writing in comments on stories such as this one. Blackmun addresses almost every issue I see in these comments and sets them aside as irrelevant or totally out of bounds. 

Conservatives seem to believe that Blackmun and the Roe majority were a cabal of uneleted, unjudicious tyrants legislating from the bench. WRONG! Based upon the principles issued in Griswold v. Connecticut, a case about birth control information and family planning, the Roe majority actually were strict constructionists, merely following the established law of privacy -- which is the path the women who filed Roe chose to litigate, and won on. If you overturn Roe, you have to overturn Griswold, which would lead to outlawing birth control, which would take us back to the 19th Century and pre-Margaret Sanger.

The world doesn't need a vastly larger population, especially when so many unwanted children end up as murderers, sexual predators and career criminals. The anti-abortion crowd are a disgrace to Western civilization.

This gets me so f***kin pissed off. First of all, why can't people leave religion out of politics?! I fail to comprehend this fact. My question to all these Bible humping, praise the Lord a**hole extremists is that if this bill goes through, and abortions are illegal unless of a medical emergency etc. and a child is born, what if that child grows up to be gay? All this fighting to protect the rights of this future child and if it's gay, then f*ck that, the child has no more rights in your view. The child is cursed by the devil and must be brought towards the light! If the fetus you save grows up to be gay, transgendered will you still be there protecting its rights?

It's not murder, it's justifiable homicide. If I tried to crawl up in a person and feed of them for 10 months, drugging them with hormones while I did it. The person would have every right to kill me in self-defense. An unborn person has no more right to do that than I do. They're not even a U.S. citizen.

I love how these extremists will do anything to stop an abortion but they would do everything they can to prevent funding to help families (THE SAME FAMILIES RESPONSIBLE TO RAISE THE BABY) get back on their feet or make an economy that is fair and equal where billionaires get tax breaks that people who earn less than $100,000 do not.

So basically they are terrified at the idea of an infant being terminated in the womb but wouldnt bat an eye at a baby that looked like a starving african child.  Whoops! Maybe that went too far.  Maybe they'll care but take it to the other extreme....Republicans would probably sue the woman for being irresponsible and put her into jail or fine her so she can have even less money! Haha  I'm laughing not because its funny but because its so believable that something this stupid is happening.

The proponants of this bill need to come up with a better tag line to avoid obvious hypocracy. Personal liberty is a license to kill - according to the Castle Doctrine. Cook up "reasonable fear" and you can execute anyone near your property, armed or unarmed.

This bill, if enacted, will be DOA at the first federal court it is taken to by Planned Parenthood. We have the rule of law in this country, and that law comes from the Supreme Court, which disposed of almost all these issues in 1973. These clowns who pander to the ignorant do not belong in government. 50 million Americans without health insurance, and this is all they can do. Millions of Floridians in need of affordable windstorm insurance, and these morons want to imprison doctors. No wonder Europeans think we are a bunch of shrieking savages running around in loincloths.

It's really easy to spot idiots in these comments. According to some, if I masturbate in a napkin I technically would be destroying the "potential" of life.  Scary, scary stuff. I love the "I'm a liberal but all abortion is murder and God will punish you" types.  The only thing that bothers me more than "pro-life" folk are those that hang onto the absurd concept of deities. The silly part of these arguments is that abortion either is, or isn't murder. People love to tailor their argument according to what they are personally comfortable with, which is why a universal standard is so impossible. It's murder unless it threatens the mothers life... horse crap. God doesn't want us to kill babies - horse crap. In the crusades God wanted us to kill everyone that didn't believe in God... that was perfectly O.K.  During the inquisition it was OK to torture people that didn't believe in God and then when they claimed to believe, kill them anyway.  All this nasty stuff is OK, but terminating a fetus is a no no? This planet is famous for killing its own in the name of one or more Gods, but now in the last few decades we have seen the light and abortion is an abomination?? Oh the sillyness.... Perhaps the flat earth society should pipe in here for comedic purposes or the pastafarians. (I love the notion that God is actually a plate of spaghetti and meatballs).  Maybe abortions of children that will become Muslims or atheists is OK? (It would fall under the Crusades argument.)

I would say that argument may hold water for most proponents of abortion. If we're going to say a child isn't really a child until x stage of gestation, fine (well, not fine actually in my opinion, but that's not pertinent to this). However, the federal unborn victims of violence completely contradicts this, as many people noted when it was signed into law.  It does not make sense to define a fetus as a person for the purposes of criminal prosecution, and as a "collection of cells" when the mother does not want it. It's one of the biggest contradictions of law I know of, which makes sense seeing as how polarizing this particular issue is in general.

@Frisbee006Acutally that is a logical fallacy. A cancerous tumor is different genetically than the carrier, but I'm sure you don't have any problems ridding the patient of that. Simply because something is genetically different, this doesn't indicate life. The fetus is unable to survive without its host making it a parasite. In fact many classes on developmental biology use this exact analogy.If you are against abortions, don't have them. It's really that simple.

 I am a liberal at the core, socialist during my most heated moments, and a proud agnostic. But terminating a pregnancy, no matter what stage, is the same as terminating the potential that the collection of cells has. That to me is murder and nothing less. I support anti abortion bills because I know too many people who aborted only because reckless sex, and learned little from the experience.
