Fort Lauderdale Man, 79, Shoots 12-Year-Old Kid Who Kept Knocking on His Door, Cops Say

Fort Lauderdale police say a 79-year-old man shot a 12-year-old kid in the abdomen last night because the kid and his buddies were harassing the man all day.

James McIvery told the cops that a few youngsters had knocked on his door at an apartment in the 700 block of NW 12th Terrace multiple times and that he told the kids to leave him alone.

Police say at one point, McIvery came out of his apartment with a small revolver and fired two shots at the ground -- one of which struck the 12-year-old kid.

McIvery told detectives he fired the gun off to scare the kids and didn't intend to actually shoot any of them.

The kid was taken to Broward General Medical Center for emergency surgery, and police say he is now in stable condition.

McIvery was arrested by Fort Lauderdale cops without incident.

McIvery has been charged with aggravated battery with a firearm and is being held at the Broward County jail on $10,000 bond.

The cops ask that anyone with information about the shooting call Det. Wood at 954-828-5344.

I can understand this guy  being mad  he told the kids to STOP! POLICE did nothing. Too bad he had to use a gun. Glad to kid was not killed. I hope the parents of these kids will take better care of what their kids are doing.

I wish I had $10,000 I would bail him out. Stupid kids need to have better parents and a nice size belt can fix a lot.

Good for this fella. Obnoxious kids need to be dealt with severely.  Their parents don't care about them, so why should anyone else have to deal with their bullshit? These kids won't be playing that stupid, fucking game anymore.

This is really a shame if the guy was only firing at the ground to scare away boys that were harassing him.

What's the big deal?  The kid tasted lead and lived to tell about it ("yeah, when I was 12 I got shot by an old man"): the old man sent a message, spent a few nights undisturbed, and received 3-squares a day for a short time; and the story generates a few dollars for websites and news outlets. 

Sounds like win-win-win.

Why the hell didn't he call the f%^ing police.  Screw him.  12 years old.  I don't know the whole story but question why shooting an annoying kid is ok.  "ringing the doorbell?" come on.  think maybe they were TRYING to get a rise out of him?  Again, call the police.  Fucking cowboys.

This should have been your kid. for real shot a kid  for knocking on a door. WHAT THE HELL. I did it when i was a kid. No one shot us. We just got our ass whiped. I no this kid. TJ. Unless mentally defective, a 12 yr old kidlet knows right from wrong. Hopefully the kid will behave in a more civil manner and live a long productive life. The community should thank this man for teaching the young miscreant a lesson.

From all accounts these kids have been not all harassing this almost 80 year old man but tormenting him now from what I hear quite awhile. Lucky he had a bad aim. Kids ,people be nice to the elderly, plain and simple or in this case they will shoot you.

Actually Patti, the self defense law in Florida has gotten stronger since that Boca case (2003).  Florida's self defense law was expanded in 2005, signed into law by Jeb Bush, no duty to retreat, can meet force with force, prosecutors must assume would be victims feared for their life, castle doctrine expanded to car and no duty to retreat even outside one's home.

Well, let's see what happens in this case.  Remember the Boca (white) guy who intentionally shot at a boy who had been ringing his doorbell?  He killed the child, who was shot in the back, and was found not guilty, based on the "fear for one's life" law, which allows deadly force if you are in fear for your life.  Le's see if the same rules apply here.

I do not agree with the "fear for one's life" statute, as it is too broad and has allowed drug dealers to kill others based on the fear factor.  I'd like to see our legislature hold the public to the same standards as police officers: Use only the amount of force necessary.  If staying in one's house is enough to avoid one's like being in danger, then one should stay in the house.  Allowing someone to come out and MURDER someone is ridiculous.

Then again, that's no more ridiculous than the stupid legislature passing a law FORBIDDING any town, municipality, or other entity from enacting stronger gun laws than the State of Florida.   The state's laws are almost non-existent...they're so lax.  What happened to "Home Rule" that they're so hot on when it's the Feds dictating to them????

I don't think your facts are correct. I recall reading that he was seeking an early release from probation which would not be the case if he was acquitted. He didn't go to jail, but didn't getoff scot-free either, as you suggest
