This Tax Day Brings Bad Tidings for "So Ethical" Richard Rubin

Back in 2005, I questioned Richard Rubin, husband of criminally charged former Broward County Commissioner Diana Wasserman-Rubin, about his relationship with the shadowy politically connected real estate broker Ira Cor.

​Rubin worked as a sales associate in Cor's real estate firm. One problem with this arrangement was that Cor did behind-the-scenes business with several local governments and Rubin's wife often voted on Cor's deals. Another was the fact that Rubin was working for a felon -- Cor had been convicted of insurance fraud and grand theft in 1983 at age 37. 

Both men were also deeply involved in dubious land deals orchestrated by the Town of Southwest Ranches that netted each about a million dollars in commissions.

Rubin told me in 2005 that he simply used his employment with Cor as a "legal resting place" and that when he conducted a real estate transaction, Cor reimbursed him "100 percent." 

"Because I'm so ethical, I thought there wouldn't be a problem," said Rubin at the time. 

As for Cor's criminal past, Rubin told me the felony conviction "probably made [Cor] even more 
ethical." 

What Rubin failed to tell me was that he'd already orchestrated a $108,297 evasion of federal taxes -- using Cor's business as his cover. Rubin was charged yesterday by the U.S. Attorney's Office with tax evasion for failing to report two real estate commissions. One involved a $102,000 fee for brokering a land deal for the Town of Davie in 2004, the other a $6,297 fee coming from the sale of a condo in Hollywood. 

Both fees were paid to Cor -- a prolific contributor to political campaigns -- who then passed the money on to Rubin. The problem is that Rubin never reported the income to the government, according to court documents.

The $108,297 was paid to Rubin in January 2005. That year, he and his wife, Wasserman-Rubin, filed a tax return indicating only $121,826 in joint taxable income. With his wife's $90,000 County Commission salary at the time, it looks like Rubin took a steep dive in business that year. The $106,297 commissions he failed to report constituted almost half the couple's income that year -- and his failure to report it saved the couple about $25,000 in taxes. 

Rubin made his first appearance in court yesterday with attorney David Bogenschutz, and a plea deal appears already to be in the works. U.S. District Court Judge William Zloch will sentence Rubin -- and determine whether he does prison time. Rubin's wife faces trial on seven state counts of unlawful compensation related to her vote on grants her husband wrote -- and profited greatly from -- for the Town of Southwest Ranches.

A few lessons from this case: 

1. Political connections, especially of the marital variety, can lead to huge windfalls of cash in this corrupt county, including Davie. 

2. Never trust a politico who ties their ship to a felon (I'm looking at you, Ann Murray). Oh, and a felony fraud conviction rarely if ever makes anyone "even more ethical." 

3. Pay all your taxes today. 

-- This is simply incredible: The Palm Beach Post reports that Florida Gov. Rick Scott's general counsel has admitted to misleading the Florida Supreme Court during his argument to kill the high-speed rail project last month. 

It amounts to a $79 million lie that the newspaper reports may have "cinched" the governor's victory in killing $2.4 billion in funding that would have launched Florida as the bullet train epicenter of America. 

Scott's taxpayer-financed general counsel, Charles Trippe, admitted in a letter to Chief Justice Charles Canady that he misled the court when he claimed that $110 million of the $130 million in state-allotted funds for the project had already been expended. In reality, only $31 million had been spent. 

Trippe argued that because there was only "de minimus" money left in the appropriation, the killing of the project wouldn't violate the legislative action to spend the money. The court apparently agreed. 

State Sen. Thad Altman was one of two senators who sued Scott alleging he had exceeded his constitutional authority in killing the project. "We knew [Trippe[ was wrong when he said it in court but we couldn't stop him from saying it," Altman told the Post

There's another lesson here: Never trust Rick Scott or his lawyers, even when they're standing before the Supreme Court.

Scott, assistant legal counsel for Miami-Dade's Office of Inspector General, was selected unanimously Saturday by the committee formed to fill the new post.

The newly created inspector general job will be among the most powerful in Broward's public realm, with subpoena and investigative powers over all the county commissioners, every city official in Broward, and all the government employees, and all the vendors who do business with Broward's city and county governments.

The job pays $165,000, which is more than the Broward state attorney makes, and the office budget is yet to be determined by the Broward County Commission.

The creation of this job and the office and staff that will come with it were prompted by a historic season of public corruption arrests across Broward, with one after another elected official facing corruption charges and public humiliation.

Scott spent two decades at the U.S. Justice Department, he says in his letter. Read it and his resume here.

Mr Pulp Somehow you forgot to include that Mr Trippe claimed he was given the wrong info from the Ministry of Transportation as he stated and as we all know lawyers never lie .I am also surprised no investigator or journalist verified that statement with the Ministry of Transportation to see who tripped up Mr Trippe or the MOT employee ???And kudos for the Governor for saving us from a major (high speed) trainwreck .......Go Heat !!!

Anonomyte posted the web site address for a Sun-Sentinel article. I read that Sun Sentinel article, titled “Former Tamarac employee admits he took cash from developers.” In that article, ASA Tim Donnelly, one of the boys with strict allegiance to Michael Satz, was trotted out. It seems that the State Attorney must not have felt that the investigation into the Tamarac public corruption was sufficient (even though the Chaits were singing like the stool-pigeons they were). So, another batch of immunity had to be awarded over 6-months ago. This time, the immunity was awarded to Tamarac’s former director of community development, Chris King, who admitted taking 2-envelopes full of cash from Shawn Chait, that he says was not more than $1,000 - $2,000 TOTAL. (At the time, KING WAS AN 11-YEAR EMPLOYEE OF TAMARAC, RECEIVING A YEARLY COMPENSATION OF OVER ONE HUNDRED THOUSAND DOLLARS, $101,130, plus full pension contributions, medical, & other benefits.) The (under-the table, unreported) cash-payments, contained in the envelopes, in 2006, had purchased an expedited process that would be no more than 30-days for the Prestige Homes project, and the money helped to goad King, to approve the project and attend various meetings & functions to recommend it to the commission, several city boards, and at community presentations. Remember that it has been reported that the Chaits (needed to meet a State deadline and) had pushed for an expedited time frame (which hastiness in action is the ACTUAL & ONLY REASON that most of the Tamarac players were caught).

In explaining the decision to act to give King immunity, Tim Donnelly, the prosecutor in charge of the State’s corruption investigations, said that “it’s sometimes necessary to subpoena potential witnesses and give them immunity.” Now, the ASA would have us believe that there is nothing that the State Attorney can do about the crimes committed by King (that King admitted, while testifying & changing his story, as new information was brought-in), since King had been guaranteed immunity, even though an acknowledgement has been made, by the ASA, that the immunity is void if King perjured himself. Well, why doesn’t the ASA look into that? King says that the payments were of a mere thousand dollars or less each time. That is debatable. King lied on his IRS forms, and he lied (through an intentional act of omission, or nonfeasance) on State forms, about the amount that had been gifted to him. So, why should King be believed to be telling the truth about such a negligible amount, that he says was offered & agreeably received (NOT requested NOR negotiated?), to risk his job & pension, and to work really hard to push the project forward?

Additionally, there seems to be something amiss in King’s explanation of leaving Tamarac shortly thereafter for a job in Virginia & subsequent placement as the administrator at the Indian Trail Development in Palm Beach County. Is there more to the story than the minimal amount of cash offered and accepted to push this one project in South Florida? In my opinion, that amount does not fly -- and the jaunt to Virginia (with a following job opportunity, in Palm Beach, of which more qualifications for that particular job could have been needed by the applicant,) does not jibe. After Tim Donnelly so readily accepted King’s testimony in that one sworn deposition (that completely contradicted King’s one-and-only statement), the ASA should have tried to verify King’s sworn declarations. ASA Donnelly could have asked the Chaits how much money was passed to King, when & where, and for what purpose. ASA Donnelly could have asked the Chaits if there was anything else promised. ASA Donnelly could have asked a really meaningful question, and queried the Chaits as to who the real power (and face) is behind the company (throwing a lot of money around to anyone that showed an interest or wanted in on the scheme). The inordinate amounts of money & goods (which have been downplayed), shared by so many, makes you wonder if the money did not come from a questionable source. Nonetheless, even if a laundering process were to have been involved, that still would not excuse any person, if presenting perjured testimony or submitting false written declarations. If it is discovered that King has lied, the State Attorney (or an ASA with authority) should immediately file a felony information, work to convict him, and strip him of his pension -- so that he can NOT get any other public job & the people of Florida don’t have to pay him (or any of these thieving b*st*rds) after his criminal activity worked to destroy a community in Tamarac, helped to drain money from State coffers, assisted in making the economy tank, and has forced the taxpayers to cough up more money to keep this ship afloat.

A couple of years ago, ASA Tim Donnelly was involved in another matter, but his tune was quite different then. (In other words, instead of getting overly involved in order to exonerate as many lawbreakers as he could, he laid back to exonerate as many lawbreakers as he could.) That other matter involved a rather messy scandal at BSO, in regards to felony violations of the law, fraud & perjury, the abuse of steroids, & the forging of prescriptions to get those muscle-pumping drugs (that would later be abused). BSO Sergeant Lisa McElhaney, an expert prescription drug investigator, finalized her investigation, on January 9th, 2009, of the activity, that involved more than a dozen Broward Sheriff’s Deputies, who had obtained steroids, growth hormones and other drugs through fraudulent prescriptions, between 2005 and 2008. The Sergeant wrote in her report, that “there is evidence to support numerous violations” of Florida Law, regarding obtaining a controlled substance by fraud. Video surveillance had been conducted and credit card payments, bank statements, and pharmacy invoices were effectively linked to the 15 BSO Deputies named in her official report. And, there was a lot of lying about the matter, by those Deputies that had been caught. Section 943.13(4), F.S., would not have permitted any person to remain a Deputy if convicted of perjury or uttering a false statement. So, why was nothing done with these BSO Deputies -- and, what ever happened to all of those reports that were required (by law) to be sent to the FDLE?

Since the probe was conducted by the Drug Diversion Unit of BSO’s Strategic Investigations Division, the Broward State Attorney’s Office did not bother to open a file over the matter, even though the case had been presented to the State Attorney’s Office. Assistant State Attorney Tim Donnelly, the director of the State Attorney’s Office Special Investigations Division, excused the inaction in telling a story about Ken Jenne’s (the former sheriff’s) decision to handle the matter administratively, after the Broward State Attorney’s Office had been asked “for some guidance” about POWERMEDICA, the Deerfield Beach pharmaceutical company that had been the basis for opening up the investigation, in 2005 -- that brought about that joint BSO/FDA raid, that lead to the drug operations being transferred and then shut down.

No thanks to Michael Satz (THE PERSON WHO IS SUPPOSED TO ACT AS THE STATE ATTORNEY BECAUSE HE IS THE STATE ATTORNEY), there was a FEDERAL conviction in the POWERMEDICA scandal (although no case was made against a BSO Deputy). In 2010, a key player, 50-year old Daniel L. Daily (the founder of the enterprising drug operation, enjoyed by many BSO Deputies), pled guilty, to conspiring to distribute human growth hormones and steroids. Like Scott Rothstein, although he has a federal inmate number (91427-004), he also has remained in an undisclosed location. Like Scott Rothstein’s law partners and other Florida bar attorneys (at the downtown Fort Lauderdale Rothstein enterprise) involved in those fraudulent reimbursements of campaign donations & a few other campaign-finance schemes & criminal activity (who did not have to face the music), the drug-addled, steroid abusing, dirty BSO Deputies continued on in their employment as Deputies (under Rothstein friend & associates Ken Jenne and Al Lamberti), acting in ignorance of their crimes and of Florida Law. The reward for BSO Sergeant Lisa McElhaney, the person who fulfilled her duty with integrity & honor, was the removal from her position in the Strategic Investigations Division and a reassignment by Al Lamberti. So don’t let Lamberti fool you when he says that there is nothing he can do about reassigning those like Dave Benjamin or Tom Wheeler. Al Lamberti seems to have no problem in removing those who do their jobs, while allowing the incompetents & corrupted (politically-connected or of a familial relationship) to remain. It seems that Al Lamberti and Michael Satz have a lot in common. And, they keep their special boys around, too. Just like Benjamin & Wheeler fill a role for the Sheriff, Tim Donnelly definitely has a role to play for the State Attorney.

Broward County seems not just to have a State Attorney and Sheriff that surround themselves with such incompetents and persons with a problematic character (that favor criminals, like dishonest office-holders, Scott Rothstein & his ilk), but seems to be corrupt in just about every area you can imagine. Just take a peek at the county commission, the several city commissions in this county, the school board, the hospital districts, the downtown development authorities, the community redevelopment areas, and the water management districts. And, don’t forget about the deceitful & manipulative court system, the crooked judiciary, and shady lawyers granted an allowance to lie (depending on bought-and-paid-for relationships, influence-peddlers, favoritism, nepotism, and other concerns). With even law enforcement in Broward County being ineffectual, it is the feds that have to come calling against those that should have been arrested, informed, or indicted. As in the article above (on this tax-day) about the husband of a Broward County Commissioner (arrested and awaiting trial) and the felon that assisted (without mentioning the participation of fellow lobbyist Bernie Friedman, county commissioner/lobbyist Lieberman/Michelson & hubby’s also pal), the feds have brought in the IRS (which I believe is only the beginning). Can you imagine -- not only are the hapless, cash-strapped taxpayers forced to pay for services rife with so much corruption, but we, the taxpayers, must find out that the public officials and those related to the public officials, not only get to exploit us & take us for our tax dollars, but, don’t even pay in their fair share of tax dollars.

It’s a shame that the Statewide Grand Jury mainly focused on the school board, and had such incompetent direction that no indictments could be brought against the charlatans of the board, doing nothing more than getting away with raiding the banks that hold the future benefits of the children of our community. You would think that the exposure of so much criminality would have brought down many in the various continuing enterprises that have been bringing down this State. What a waste of taxpayer money, which was spent on this investigative all-powerful body that merely issued a final report, that basically told us what we already knew -- that the school board was corrupt and no one was going to do anything about it. The way that public corruption cases have been mishandled, Tallahassee should have been alerted. Although nothing was really done in the past, except for show (like the dog-and-pony Grand Jury alerts that lasted one whole year), Charlie Crist (who may not have minded that type of a show, along with his alliance) is out of office, and Florida has a new Governor. Does Broward County stand a chance with this Governor? If so, when will the Governor put in writing the misconduct that is occurring here, reassign Michael Satz, under sec. 27.14(a), F.S., (or, at the very least, act under sec. 27.15, F.S., to bring in a State Attorney, learned in the law, with an understanding of the Florida RICO Act and public corruption, to ably assist) and give a directive to FDLE, under sec. 943.03(2), F.S.? It can’t come soon enough. Until then, feds keep on keepin’ on.

Recently, I had a conversation about local corruption asking when will the FEDS & the FL State Attorney get to Davie. The response was Davie has a very long history of backroom dealing and corruption including "old monied interests". Don't think for a minute they aren't watching Davie... and all the cast of characters of "The Davie Show".

Early on, it was obvious Rubin was "brought in" much to the residents' surprise and consternation. He "suddenly" showed up on the scene well after the issue of the "Fill Permit" to fill the borrow pit was filed by the property owner's representative, Bill Laystrom.

I've been around "the ranch" a few times and have known this time would come. I knew early on the Sunny Lake deal was problematic on many levels including the State Grant Funds, County Grant Funds and the Town Open Space Bond Funds expended for this "folly". This "borrow pit" is not a "bird sanctuary", it is a place where birds "roost" at night. Nothing more. In two evaluations done by an environmental biologist there is NO evidence of a rookery, which is a bird nesting area. There is no habitat for roosting there, period.

Most telling is the fact the Town is now trying to avoid removing the rest of the invasives at the behest of the same residents who refused to listen to the grant requirements. Subsequently, paid $750,000. for .7 (that's less than 1 acre) of land from the Town's Open Space Bond money out of District 1 which was pushed and orchestrated by 1 property owner, Pam Pelkey Rose at Open Space Committee meetings and Parks & Rec meetings. What's worse, is the District 1 Council member, Caletka, supported investing another $800,000. to renovate an old house on the property. In the" current market" a new building could be built for under $300,000. Not one person in town hall has discussed re-assessing this "boondoggle".

So, you have Town of Davie accepting grant funds and not adhering to the state and county requirements. In addition to squandering Open Space Bond money on purchases pushed and orchestrated by special interests without any public input or participation. And, this is just for starters.

It was suggested to me to continue doing what I have been doing. Keep watching, keep good records and keep putting the information out there in the public forum. Eventually, the "birds will come home to roost". They have arrived.

Kudos to Crook Scott? He made us the laughing stock of the nation by turning down the allotment for building the high speed railroad. Do you realize how many other states wanted that? Kudos for knowingly allowing a lie to the Courts? In my opinion you speak without any accurate information and you are also just a puppet. If I were you and not a citizen of this country(No voting rights) and had no say in how our country or county is run, I woud not be sprouting right or wrong decisions!

Hey, knucklehead, this is the United States, not Canada. Florida doesn't have a "Ministry of Transportation". It's known as the DOT -- Department of Transportation. And the officials in that department who "miscommunicated" with Trippe were members of Rick Scott's administration. Get it? Rick Scott's people lied to the attorney.

Agreed. And this guy Cor's 30 years ago convictions are for non-violent offenses. And, he is not a public figure. Scarlet letter days are over.

However, if , for example a person had been convicted or received a deferred disposition on violent charges--such as violating a protective order with oh, say 46 or 47 maybe even 48 harassing emails, or tossing containers of his or her own urine around at people's residence, or repeatedly vandalizing someones car - in the more recent past--say within seven years or so -- then labeling a person like that as a criminal would be completely appropriate - doubly appropriate if say, there were additional, more recent victims. A person like that would deserve to be labeled a criminal.

This is a new thing for Tim Donnelly (trying to get to the top) it seemed that an earlier situation reported heavily upon by Wanda DeMarzo and to a leeser degree by Paula McMahon, the powertack scandal at BSO.

Donnelly and his office went after line staff and left the supervisors and commanders alone. There is sworn testimony that the fix was in with the SAO and that Jenne orchestrated the SAO investigation (remember it was the feds who got Jenne).

Thanks again, jad. Your parsing of the once-over-lightly SS article highlights implausibilities in King's story that should be obvious to the most credulous reader and then goes on to provide enlightening details, overlooked by the local paper, about King's career path in public service.

Another very useful part of the post is the back story on Donnelly, all of which was news to me. On principle, I'd been skeptical of his claim that handing out all those immunities will assist in bringing down Lieberman. From the record, however, it appears that the allusion to Lady Macbeth was simply a sop to all us high school graduates out there, to give the impression that a serious effort to dethrone her was being made. Would it help encourage the feds to stay on the case if we all put on our tree suits and marched on Dunsinane?

Clarification-Fill Permit "Application" filed by property owner's legal representative, Bill Laystrom. Meetings were held with the residents (only 7 homes on this borrow pit) where it was suggested the community look for the funds - $3.5 million - via grants.

In total, this "boondoggle" has cost taxpayers at least $5 million for 7 residents, which is located at the Griffin Rd. Tpke entrance. One of Davie's follies.

Others are the Van Kirk Parcel. And,of course, one of the best ones..."Forman's Palma Nova Cancer Asbestos Pit" of 125 acres, which the Town bought 25 acres for $12.5 million. The former Town Administrator's job was threatened, if he didn't push this contaminated pit sale through. Forman closed this place because he know his Ferncrest Contaminated Water Utility was a "class action lawsuit" looking for a place to happen.The record speaks for itself on Ferncrest. It's now conveniently called "Tindall Hammock".

Oh boy Glitz now I am goin to sound like Timmy but truth betold I have done more real serious corruption fighting than any American on this Blog.. 4 HPD officers in prison(and there should have been many more)because of an FBI sting which I believe was aimed at Mr Jeff Marano and crew whom I believe was tipped off...Clue: as I mentioned each of the five times I went to the Feds ,Jeff rode by on his HPD motorcycle on each occasion to intimidate me...Because of this sting a New Chief Mr Wagner was smart enough to "retire" Mr Marano and fire the Disney Cops to show the citizens of Hollywood what a REAL cheif should do (not a puppet for PBA) PS More to come eh!!!

When Dierdre Funcheon did my story on Tom Sikes the NTs lawyers were paranoid because they had a ten million dollar suit against them for trying to put Bay Guardian out of business by predatory pricing and secret deals to some advertisers.So my story was not printed among other reasons (HPD would not name Neal Chambers as a suspect despite as Df3 said a ton of circumstantial evidence)... So what good the Pulp and Pulpsters do somehow make up for what shady business NTs has done in the past much like our new Governor might be doing himself....And like I said before I am here to fight corruption even after I send Neal Chambers and Sharon Sikes (among others) to prison for the murder of Tom Sikes.....Sorry my fellow Pulpsters but its a slow rainy day!!!
