Teacher Slaps 9-Year-Old; Police Won't Take Report

Two weeks ago, Quiana Nixon's 9-year-old was strangely silent upon his return home from Chester A. Moore Elementary School in St. Lucie County. She asked him what was wrong.

"My teacher slapped me," he said.

Quiana didn't believe him, but then he showed her what appeared to be a handprint on his face -- visible in faint purple even hours after the alleged assault. According to the child and another of his schoolmates, the fourth-grade teacher slapped the child because he was laughing.
The handprint is hard to make out in the pic to the left. (The exigencies of New Times' blog software make it difficult to post the picture at high resolution.) In the high-res copy emailed to me, there is a large, faint purple welt on the left side of the boy's face, beginning just near the hairline and extending almost all the way to the jaw.

I heard about Quiana Nixon from Melissa Barton -- the mother, students' rights advocate, and activist she-tiger who helped midwife the new Floridian law eradicating teacher tenure. This incident illustrates one of the reasons Barton was motivated to do so.

When Nixon confronted her school's administration, she claims she was told that the teacher had already owned up to her actions and apologized. "They said, 'Yeah, we know,'" Nixon says. "She came and told them herself, saying, 'I just did something way out of character.'"

Even so, when Nixon attempted to file a police report, she says she was rebuffed. According to Nixon, an officer with the St. Lucie Police Department informed her that it's legal for a teacher to slap her pupils.

Nixon says she spoke with a School Board official, whom Nixon queried about obtaining counseling for her son. The School Board official told Nixon that she would have to pay out of pocket.

Since the incident, Nixon's son has reportedly developed a fear of school and has been having nightmares about school, one of which caused him to wet the bed for the first time in years.

The School Board hasn't yet responded to my email seeking comment; neither has the St. Lucie PD. I'll update if they say anything interesting. No matter what they say, it'll be hard to parse -- this slap-happy elementary teacher almost certainly has tenure, and it'll be almost impossible to tell if the School Board's attempts to defend her are motivated by a respect for her abilities or out of a fear of wasted money. With tenure in place, even fired teachers are paid a salary in perpetuity; it'd be irresponsible to let one go over a little violence.

Nightmares? Bed wetting? Give me a break. Was the teacher out of line? Certainly. Are teachers human, yes they are. Should she be reprimanded? You betcha. But if momma had slapped the precious little darling for acting out, well I bet she'd be real upset if someone tried to file charges on her. Am I defending the teacher? No. The fact she admitted she had done something she considers out of character tells me she took responsibility for her actions. If mom thinks he needs counseling, she should pay for it. Most likely if he's this freaked out over the incident it's based upon some sort of hidden trauma being brought to the surface.

I doubt the teacher would have slapped a girl pupil like that, and I doubt the police would have declined to act if it was a girl slapped

What a shock, no one answered your queries. Could it be that your journalistic writing leaves a lot to be desired? Just look at your post to the first comment. I actually feel dumber after reading this P.O.S. article. I do not care how things were when you were in school, but teachers are not allowed to administer any type of corporal punishment. Most of the quotes from the mother show you didn't even bother folllowing them up with anyone besides the Board. Every school offers counseling for free, a simple search reveals this. Please return to writing for your city paper that no one reads and leaves on their driveway.

Puuuuuullllleeeeeeaaaasssssseeeeeee, you want me to believe that if the incident happened and this "she-tiger" accepted the answers given and that is it? Bull friggin shit! This ain't her first time at the rodeo and no, FSS does not allow teachers to "slap a child" in fact it is child abuse, as the teacher is the temporary care giver to the child. The mother can file charges with the police and in lieu of them accepting a report go the the sheriff's office and/or the state attorney's office, believe me, running to the media is an option but way down on my list, I like to stand on my own and get things done....and oh yea, the kid most likely needed a swift kick in the ass, but I am sure then "she-tiger" ain't go no idea who the baby-daddy is, I am sure she will need to go on Maury to figure that one out...what is that about reaping what you sow????

As ironic as the story link you posted is; and remarkable similar as it is, they are two different cases. Both show that bigotry and inequity are very much alive in our classrooms as much as we would like to think not.

Why on earth do we allow such cowards as yourself online? Someday, there will be laws in place to ensure you can not hide behind your MyCompClub computer and people (using the term lightly) like yourself will be the cause for it all.

Although as the author pointed out, your literacy level is likely far below that required to comprehend what I just said.
