Where's the Leadership, Sheriff?

The photo above is one that the Broward Democratic Party didn't want you to see.

Or at least the part of it showing lobbyist Judy Stern with a sign denouncing offshore drilling. The photo was taken at the "Hands Across the Sands" protest last June. The Democratic Party's website, bluebroward.org, covered the rally and included the photo, but Stern was cropped out of it. Only the man at her right, who happens to be Ken Evans, an area leader for the Broward Democratic Executive Committee, was shown. 

Someone sent me the unedited photo just yesterday. There's good reason for the Democrats to erase Stern from the photo. She's one of those sneaky lobbyists, after all, who are best hidden behind the curtain. But it's not only the fact that she's a lobbyist but what she has lobbied for. Stern represented the infamous Calypso natural gas pipeline project that enraged beach residents in Fort Lauderdale. That plan called for the construction of undersea terminals off the coast and pipelines that would pump highly flammable natural gas to shore under the ocean floor. 

It was so unpopular that former Gov. Charlie Crist killed the Calypso project himself in 2009 to a literal standing ovation from residents. 

A year later, Stern had suddenly become a 
great environmentalist. Of course, her daughter, Barbra, was making a run for the state Legislature as well, so a quick rah-rah at the party's protest certainly wouldn't hurt that either.

Evans, as an aside, was one of the rabblerousers who heckled Allen West at his town hall meeting at Cavalry Chapel on Tuesday. On that topic, I'll say this: I really don't like the fact that the Dems are sinking to the level of the Tea Party, but if anyone deserves to be shouted off the stage, it's Allen West. 

-- So let's get this story about the judge right. 

Broward Circuit Judge Ilona Holmes is enjoying Easter dinner at her sister's house in Deerfield Beach. Apparently there is a burglar on the loose in the area. BSO deputies mistakenly surround Holmes' sister's house, believing the burglar is inside. 

The judge is packing heat. She pulls out her gun. The deputies announce who they are. Holmes announces who she is. The deputies are unimpressed and order the family out of the home at gunpoint. From Elgin Jones' story

The family told deputies they are the homeowners and that the officers were at the wrong house.

Still, the deputies continued to order the family outside with their hands up. After they came out of the house, the deputies ordered them to lie on the ground but they did not comply.

Holmes continued identifying herself as a judge. She told the deputies she was coming out and would place her weapon on the ground. As she came out through a side door, deputies began yelling, "Put the gun down!" After she placed her gun on the grass, they yelled, "Get away from the gun" and "Get on the ground."

Holmes again identified herself as a judge and explained that she has a bad back and therefore unable to lie on the ground.

At that point, the family was being held at gunpoint with their hands in the air. The Scarletts' 16-year-old daughter Kiana was escorted outside at gunpoint. 

One of the deputies recognized Holmes and told her she could put her hands down.

A neighbor said she too told deputies they were at the wrong address but they continued to search the house.

"I told one of them they had the wrong house and he went to tell the rest of them," said Diandra Evans, a neighbor who witnessed the incident. "They owe them an apology because they made a mistake."

Because Holmes is black, this story has resounding racial overtones. Jones also reports that Holmes called Sheriff Al Lamberti after the incident but he hasn't returned the call. 

My take on this is that if BSO had apologized to Holmes and her family for getting it wrong, then none of this would even be coming up at this time. They would have squashed it. 

Instead, BSO has apparently dug in its heels, compounding its mistake. 

The apparent lack of an apology or any accountability by Lamberti or his agency for rousting the peaceful family at Easter only bolsters those who would claim, right or wrong, that this was the work of an unprofessional, arrogant, and possibly racist team of deputies. 

Where's the leadership, sheriff?

Bob why don't you take some responsibility for your incorrect reporting. The deputies, sergeant and command staff apologized but the judge and family did not want to hear it. You weren't there, we were. The deputies went to the wrong address because of the neighbor. The judge knew the deputies were outside and still brought a gun outside. Get your story right.

First thing this monring, Lamberti called a meeting of all Internal Affairs detectives and their supervisors, his top brass, his lawyers and a PIO. The topic was how the steroid report got out to reporter Elgin Jones. Lamberti and company are really bent over how their mass cover up has been exposed (again) and were giving the inquisition to the troops to find out who leaked this information. He asked the lawyers about taking legal action and the PIOs were told that Jones gets NOTHING from BSO ever even if it is public information. This is gospel and SOOOO typical of Lamberti and his mob. They think they can control the employees, media, public opinion, the courts and the legal process by fear and conspiracy. They never seem to understand that they cannot find a phantom spy to single out and blame - it is not one person - it is everybody, everywhere in the agency who is revealing the corruption and felling really good about it for the first time in years. To the reading public: Lamberfti and mob are the most corrupt and inept group to ever hold public office in a law enforcement agency. They make the mafia look like a bunch of overgrown kids playing pranks.

Apparently we had another “Take Your Kid to Work Day.” Maybe the Sheriff’s son got a new lesson about law enforcement as his father dealt with some recent issues. Young Nick already learned how to get major freebies like attending the Super Bowl while his father and staff orchestrated a criminal scam and cover up with all other local and federal agencies. He learned first hand how to proudly wear false credentials and surely was coached on what to say and not to say to his school chums when they ask about all the publicity. That was a great lesson for the up and coming teen LEO. Today, he may have picked up some pointers on how to avoid any responsibility to respond to questionable situations such as occurred to a Circuit Court judge at the hands of some error prone deputies. And the other day Nick learned that it is apparently OK for an off-duty SW Ranches sergeant to give special attention to a VIP football player wounded in a domestic violence felony stabbing. Maybe the supervisor In question gets a few favors in return so Nick learns about how “one hand washes the other.” And a most important part of his education concerns the steroids mess. His daddy surely explained how you must always take care of your friends even when they commit felonies and the proof is there to read. I can hear Nick telling his mother, “Don’t worry Mom - Dad made sure that cousin Jim Gibson won’t get charged with anything. And he said that part of being a sheriff is to always destroy anybody who is doing honest work by exposing crimes and corruption. Boy are they suckers. That woman detective is toast now! Bob oh Bob....I agree with much that you write and I think you know I just love to poke no-good-niks in da eye, but Bob, Pulpster....you are soooooooooo wrong on dis one.First and foremost, Al needs to get smacked for some stupid shit he's done but dis ain't on of them. Deputies, working in a predominantly African-American section of town, get a dispatched call of a burglary in progress. Now, I know thay should just think, ahhhh, it is probably a mistake so let's not respond, but alas, they respond anyway. Now, the address does not exist, but instead of thinking, ahhhhhh, it must be a mistake, let's go home.....they think, better check it out anyway, you know, maybe the caller had the wrong address, Hey, ya know what, even my Garmin GPS makes a mistake!!!! So they go to the home they believe it is to check it out, they call for the folk inside to come out, everything reasonable up until now???? Another neighbor tells a deputy, they have a wrong house, he goes to alert the other, still fine with me...."THE JUDGE" comes out with a handgun and tells the responding deputies, " She Is Judge Holmes", now, Pulp, who da fuck cares? I mean, who da fuck is dis broad???????? I mean, she speaks of herself in the third person anyway, I mean she should go but just her first name, " Ilona" you know, like 'Cher" or Liza, witha Z" I mean come da fuck on, how many judges in dis county??? and she expects everyone to know her? And even if they did, what she is right? I mean if and when she gets stopped for a traffic violation, you just know the first words out of her mug is, I'm Judge Holmes, like that means she's a good driver???? I mean I met a guy, said his name was Jesus!!! I said good, now go mow my fuckin lawn.Now, you never told the rest of the story, when they deputies went back to speak with her, she tell's them she can't speak as she is " soaking her feet?!" Bob, the Broward Sheriff's department put local radio personality Nicole Sandler in solitary confinement and sprayed her with mace in the County jail yesterday after she was arrested as she exited the Allen West town hall and was then held for seventeen hours for a $25 bail. Furthermore, that town hall was held at the Calvary Church, which I'm not so sure is even in West's congressional district- and it's common knowledge that West has not even lived in the district he represents. Al Lamberti needs to be replaced, and certainly West's time will come to pass.

Is there any evidence that what you say is true? If she were sprayed, there would be a use of force form completed. What did she do to warrant the chemical agent/segregation? The jail is full of cameras. Here actions would have been recorded. So let's hope she is telling the truth about what happened in the jail.

I watched the video of her being escorted by the Sergeant. He did nothing improper during the video. She was the one running her mouth.

It is this type of radical fringe behavior (from both sides) that is wrong with politics today.

What I said was regarding what I saw in the video which was after she was arrested. The video was taken after she was arrested. I have no evidence to base the propriety of the arrest accept her behavior post arrest. Her post arrest behavior tends to sway me into believing she committed the offense of disorderly conduct.

Whoever commits such acts as are of a nature to corrupt the public morals, or outrage the sense of public decency, or affect the peace and quiet of persons who may witness them, or engages in brawling or fighting, or engages in such conduct as to constitute a breach of the peace or disorderly conduct, shall be guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.

So if her behavior affected the peace and quiet of others or if she engaged in such conduct that constituted a breach of the peace or disorderly conduct, She committed a crime. You can do those with just words.

That said using the vernacular "running her mouth" can be crime depending upon how long and what was said. For instance disruptive speech can be a crime, calling a judge a corrupt jew can get you locked up, phoning in a false bomb threat can get you locked up, etc so in the realm of running one's mouth.... yes it can be a crime.

This was a political "stunt" that backfired on her.

My deputies were in a black area. It was near MLK blvd. Crime is all over the place on MLK. there is a lot of crime in black hoods. They do crack and have hoes there. Everyone knows it. It was Easter so they were probably drinkin. Someone told us there was a burglar in the area. We figgered they all know each other anyways so we went in. Its' BSO policy to have your guns drawn went you enter a black house with the drinkin and crack and whatever other crime them black people are committing on MLK Blvd. Besides how we to know that a successful judge would be slummin in black town anyways. WTF. Them black people can get crazy you know.

She expects people who are public servants to do their jobs correctly. BSO came to the wrong house responding to a call of suspicious activity. This is NOT the last we'll be hearing about BSO on this one.

Ok LL- I gave you the benefit of the doubt last time. Now you are just being dense. I guess you think its cool to call judges corrupt and dirty jews. You obviously have no idea what you read in the transcripts. The judge was just following the law; i.e. the Plaintiffs failed to give the defendant proper notice of a wage garnishment, so the judge dissolved the garnishment. Simple. In fact, the Plaintiff's counsel admitted during the proceedings that the Plaintiffs failed to give proper notice, as required by Florida law.

I'm sorry but I don't believe calling the police racists is necessary. They had the wrong house. Considering the kind of criminals the cops come up against each and every day I don't blame them for not "believing" the person or persons telling them they had the wrong house. When the one deputy recognized the Judge the situation changed. This racists card is uncalled for and I feel totally unacceptable from the Judge and from the Pulp.

PULP,Elgin Jones released the report of all of the BSO deps involved in the 'roid case... It is very interesting reading. If you sub Oxy's for 'Roids a lot of cops would have been arrested.

What you don't know there has been racial tension between BSO and the "community" in Deerfield for a long time. The crescendo was when BSO unleashed K9's on a wild group at Mango Fest about 10 years ago. BSO's Lt Col Danny Wright came out and said that wouldn't happen in Weston. 100% true.

It is less about racism and more about placism though. Black football players have been treated very well in Weston and SW Ranches and other upper middle/wealthy neighborhoods. This call was in a "black" neighborhood and a very real seige mentality exists.

What planet do we live on where the Sheriff won't return a call from a Circuit Court Judge?

I call balls and strikes when it comes to Lamberti and his failing to call back Judge Holmes is a strike against him. He is coming very close to striking out. Think about it all he had to do was take her call and say I'm looking into it. I'll let you know what comes of it.

And to the guys thet were there, might I suggest the next time you're at 201 SE 6 St... Go by her chambers or court room and apologize. Its the right thing to do.

This is such bullshit. Judge Holmes should have shot the burglar, lured him into returning fire, injured him and retained her ability to give him life on a 10/20/life felony. Was she wearing her blue or black robe that day? I'm no huge fan of not apologizing, but is BSO simply supposed to take a gun weilding person's word that she's a judge? They had a duty to disarm her. Lucky a cop recognized her or things would have gotten really ugly... Anyone that has been before Judge Holmes knows she doesn't take instruction from anybody and she can more than hold her own, on and off the bench. Anyone know what she was packing?

You ain't been around the blog long, if you don't know about my sarcasm. Had many cases before this judge in my time and she is a mixed bag. Blue robe, good plea - black robe, look OUT! I don't expect you to get the jokes within the jokes...

Either way, its all in fun. Just to be clear (no sarcasm). BSO should apologize for getting the wrong house. BSO was right to disarm her, despite the error. BSO is lucky they didn't make Holmes hit the pavement, as it would have brought this to another level.

Now pass me the rolling pin - I have some play dough biscuits to make...

This is a bad case... The problem was not in the way they handled the call (although a marauding band of post menapausal female home invaders seems rare even here in broweird). As soon as one of the guys recognized Judge Holmes, (who is a great judge) they changed their tune.

The problem was nobody dusted them off, shook their hand, ate a little crow and apologized. BSO has always had a bunker mentality. Think back at every misstep at BSO throughout the years. BSO has always been unapologetic, think Timothy Brown, Townsend, Lee, the crash in Sunrise, even deaths and injuries of its own in Fatta and Hernandez. The only mea culpa in recent years has been the Oakland Park Crash.

This is just more of the same.

Question to DF.If the BSO did not see the burglar go into the house nor were they chasing a fleeing felon what right did they have to enter the house without a search warrant? I think that is the real issue. What was the exigent circumstance? The fact that one of the occupants of an innocent house was armed is irrelevent.Also why did they have their guns drawn.

The BSO is the most arrogant sons of bitches of any department in lawenforcement.

I have some of the same questions... you can Monday Morning Quarterback their tactics up to learning that the house is occupied by the home owners and a judge. Once they figure out they have the wrong house... YOU APOLOGIZE!!!! Show some contrition explain what happened and what went wrong. Every cop on the planet has made mistakes. Hey Norm, what if bso shows up and someone is in the house, but holds one person behind at gun point and tells the rest that if they tell bso that someone is inside, that he'll shoot the hostage. Its police protocol to handle this situation the way that they did, period. And I thought you liked calling out elected officials who got "special" treatment? Wrong, wrong, wrong! Inexperience deputies rushed when there was absolutely no reason to rush. They had the house surrounded. They had tag numbers from the cars out front. They had eye witnesses that were trying to tell them something. Never in my decades of police work did I ever hear of an older gentleman calmly washing dishes in the kitchen sink of a house that was being burglarized by him and his family! For God's sake-where does BSO find these these guys? There was absolutely NO reason to push this thing to full resolution immediately. By waiting and keeping it controlled, which the report indicates it was, valid new information could have been clarified. Instead, these morons proceeded to rush in and rush to judgement. The report indicates that a sergeant arrived. If the sgt. had been on the scene before they made a mess of it, perhaps this would have gone better. And if Lamberti and his staff would just once take responsibility and acknowledge these things! Just once!!!

I hadn't caught that when reading the post. The Broward Democratic Party does have it's own website, that was only very recently constructed. BlueBroward.org is an independent effort created by David Carr and has no affiliation whatsoever with any Party operations.
