Charged With Growing Pot, Man Claims Medicinal Marijuana Defense -- and Wins

Prosecutors dropped criminal charges today against a Palm Beach County man who had claimed a medicinal marijuana defense in a case that could have sent him to prison for five years for growing pot plants.

Jeffrey Kennedy, a 53-year-old Boynton Beach resident, had turned down a plea deal in the case in the hopes that his medicinal marijuana defense could set a legal precedent in Florida, where such cases are rare.

"For 18 months, I have been so worried about losing my home, my wife, my life,"
Kennedy said today after a court hearing in which prosecutors announced they would drop the charges. "We can get back to normal, if I can find what normal is again."

Problems began for Kennedy in 1999, when he tripped over a wire left in his yard by a cable guy. He fell and broke two disks in his back, requiring surgery that failed to fix his chronic pain. Doctors prescribed pain pills that gave him severe mood swings and failed to fix the pain he felt in his back, legs, and feet.

Kennedy hadn't considered pot until about six years ago, when a stranger in a doctor's office waiting room asked: "Ever try dope?"

"I told the guy, 'Yeah, but I gave that up years ago. Does it work?' He gave me a joint, and I went home that day and smoked half of it." For the first time since the accident, the pain was gone. "I thought, 'Wow, this is the most amazing thing.'"

Kennedy began buying pot from dealers. But hoping to cut down on the costs of his newfound medicine, Kennedy said he decided about five years ago to start growing it. He ordered a book from Amazon.com on how to grow medical marijuana and set up a small farm out by his pool.

But on August 29, 2009, Kennedy came home in the afternoon to find his front door open. Fearing a burglar, he called the cops. While searching the home, they found his plants and arrested him on charges of trafficking and of cultivating 26 marijuana plants.

Prosecutors later dropped the trafficking charges and offered Kennedy a deal: plead guilty and he'd walk away with just three years' probation, which would require him to take monthly drug tests. If he smoked dope during that time, he'd likely go to prison.

Kennedy's daughter urged him to take the deal, fearing her father could end up in prison. But by then, Kennedy had begun an internet and email campaign, rallying pro-pot forces to his cause. "I wrote my daughter a letter explaining why I couldn't take the deal," Kennedy says, breaking down in tears. "I told her that I'd be letting everyone down, and I just couldn't let anyone else go through what happened to me."

Kennedy says prosecutors called his attorney, Michael Minardi, again yesterday asking if Kennedy would take the deal. By then, Minardi had lined up a series of nationwide experts -- brain surgeons, medicinal marijuana users, and others -- who were ready to testify. Palm Beach County Circuit Court Judge Karen Miller had yet to rule on whether jurors could hear the medicinal marijuana defense when the case went to trial, which was scheduled for May 2.

So prosecutors relented and agreed to drop the charges before a 10:30 hearing this morning on Minardi's motion to dismiss.

"I broke down; I cried for probably 30 minutes," Kennedy says of when he heard. "The stress was just gone, just gone. It felt so good. This fight I have been fighting for 18 months paid off. I didn't fold, I didn't flinch, I didn't take their deal."

Karen Goldstein, president of NORML of South Florida, hopes the case will encourage others to use a medicinal marijuana defense to fight criminal pot charges. "We hoped if this case had gone further that it would set a legal precedent in Florida," Goldstein said. "But either way, we are so happy for Jeff."

Minardi says this isn't the first time a medicinal marijuana case has won in Florida. Two cases out of the First District Court of Appeal from 1991 and 1998 established that defendants could argue a medicinal marijuana defense. But no cases have gone before the Florida Supreme Court, which would establish for good the defense statewide. "Hopefully," Minardi said, "other people, if they have legitimate medical reasons, will be able to use this defense."

Asked if he's going to continue smoking weed, Kennedy replied: "I plead the Rick Scott. Rick Scott took the fifth 72 times in a court case. So I take the Rick Scott."

I was in county for 8 months, one court appointed lawyer died of cancer, and the other would not do anything because I wanted to go to trial. I am a disabled Vet who has a rare spinal chord disease and 3 protruding discs, from my service to the country. None of the 4 District Judges would hear my case, and I was not allowed to even bring any legal papers or evidence to court while incarcerated and Pro Se. I ended up taking time served State Jail and 2 years prison for Failure to appear in court. First arrest. 32 years old. Comal County Tx.

I wish my son would have taken that route. He is in remission from Cancer however JudgeCollier in Pensacola Fla. would not allow his cancer to be brought up in his trial. He too was growing for his own personal use but received 10 years in federal prison. Good Luck to you and I am glad some people are starting to understand how pot helps people.

 I think that the legalization of medical marijuana in Florida would drastically reduce the usage (legal and illegal usage of pain meds that run so rampant down here in South Florida such as Oxy and Roxycodone...and it's not addictive...Right now the people who should be on trial are the pharmaceutical companies for making slaves out of the users of their "drugs"....Is there really any question as to what needs to happen here????   companies for making slaves out of the users of their "drugs"....Is there really any question as to what needs to happen here????

I'd like to think that the ogvt in this case saw the horizon and it loked to them like a dangerous precednet to their way of life and doing business. The incarceration of otherwise law abiding citizens whose only crime is to smoke or injest cannabis is a business. The DEA the law enforcement agencies all stand to lose a good share of their budgets if cannaibis is deciriminalized or one can only hope legalized.Follow the money trail. Rick Scott's plan for privatization of prison hinges greatly on the number of prisoners to be stored. Legalizing cannabis would greatly reduce those numbers.It's not about you and me. It isn't about public safety or health.It's about money.

This is GREAT! as an advocate for Medical Cannabis in NC, i am so thoroughly excited for you as well as the rest of FL. I hope that more and more people have the strength to stand up for the reality of Cannabis and of The state of medicine as it is practiced. Now... if you could get your lawyer to send the contact info of your experts to the advocacy groups around the nation, the pieces to this whole thing could all begin to be assemble in the light of day. Congratulations on your victory, I wish I was brave enough to have done the same. I to had been abused by the Florida legal system for the same thing, regretfully I took the plea and subsequent probation. Which I served out with out incident, and shortly after receiving my walking papers my partner and I bolted put of Florida to Colorado.

So, bully job for holding your ground. May this be a turning point for Floridas draconian drug policies.

Hi i'm looking at the same charges third dgree felione and 2years probation i had both my feet amputaited i have a lot of cronic pain i also can't take pain medication and my lifes also been turned upside down. Hi Im Rachel my dad posted something on hear a while ago. his names Charles or chuck for short. But when i was about 2, 3 my dad was in a four wheeling acident an had both his feet cut off i remeber going to the hopital to see him. Im 13 now. My dad was in so much pain, he couldn't walk, half of his feet where takin off he would just lie in bed in pain. He missed everyone of my cheerleading games for two years an he missed my younger sister's gymnastic torniments. Sorry if my spellings not too good. My dad couldn't take pain meds, because he would go crazy if he did, no lie. He tired it an it didn't help so about two years ago he decided to grow pot. I didn't like it, i new it was aginst the law i tried telling my dad to stop but he wouldn't hear me out. he said it helped. Then this year the cops came to my school, sat me down an said that "there where problems at home and that i smelled like pot." I paniced and told them. My dad never forgave me, i missed the bus one day, because i was scared to go back to school, i was there when the cops came i locked myself in my room an cried, i didn't wanna hear them yell at my dad. Because i new it was my fault, because i was the one who said something. I still blame myself an i hate to see my dad in pain, and i want him to stop. my dad can't work, an my mom just got laied off. so things aren't great. When i see my dad i know he doesn't forgive me. Im hoping that you will give him you're lawers name an number an please try an help him. I may be young but when i saw your story on the news i new that you may be able to help my daddy. I love my daddy, i know you have a daughter an how would u like it if ur daughter blamed herself for what happend for u. ): Please try an help my dad it would mean the WORLD to me. Talk to your dad he is probably scared and angry but i bet he's not really angry at you.Being a mother myself i can only say there is NOTHING in this world that could make me stop loving my kids!My husband smoked pot and it caused alot of conflict with the whole family but it was bacause of the cost(which we couldn't afford)if the goverment would see that some people really do need it for legitimate reasons maybe we could put the drug dealers out of business!
