Beth Talabisco Gets Tough Judge in Imperato

Now-former Tamarac Mayor Beth Talabisco had more bad news when she learned who would be presiding over her case: Circuit Judge Cynthia Imperato, who has a reputation as one of the toughest judges on criminal defendants in Broward County.

​Imperato is former police officer and prosecutor who has kept that mentality in the courtroom. She's not a fan of motions to suppress evidence and other defense-oriented techniques -- and when it comes to sentencing those who are found guilty, she usually drops the hammer.

A judge informed me yesterday that Imperato has been assigned the Talabisco case.

"[Judge Imperato] is very flexible when it comes to pleas, but God help you if you go to trial because you better win," said defense attorney Bill Gelin, who runs JAABlog. "There's always a chance she'll max you out." 

Hey, how do we get Imperato on all these corruption cases? 

-- I told you I was going to get into the role of political operative Beverly Stracher today, so let's just ring off some of her connections.

Bribe-giving developer Bruce Chait told prosecutors he gave Stracher $100,000 cash for her help in

securing him the votes of politicians like Talabisco. At the same time she was running Talabisco's mayoral campaign, making money on both ends.

There's plenty more. Chait said he hired Stracher at the behest of Broward County Commissioner Ilene Lieberman, whom he said pressured him to put her on his payroll. Lieberman is of course now a key witness in the criminal case against Talabisco.

​In addition to working as a campaign consultant for Lieberman, Stracher was a paid consultant on the 2006 commission campaign of Stacy Ritter, who also voted for the Chaits' project and accepted a golf cart as a gift from him.

As an aside Stracher was also the campaign manager for huckster and accused crook Shak Dhanji, who was charged with receiving illegal campaign contributions and falsifying records after his run for sheriff.

[As another aside Stracher also managed the campaign for John Sommerer, the former Coral Springs mayor, when he lost to Scott Brook in 2006. In 2008, Sommerer was charged with child molestation and was sentenced to 4 1/2 years in prison after striking a plea deal. The judge on the case: Cynthia Imperato, who with her not so harsh sentence in that case indicated her flexibleness with plea bargains).]

On top of it all, she was married to former Scott Rothstein attorney Les Stracher -- who at times used the power of the fraudulent law firm to intimidate the cabal's political enemies, including activist and Tamarac commission candidate Patti Lynn.  Les Stracher filed for divorce against Beverly last August.

It's connections like these that to speculation that Stracher was the bag lady for the Chaits, the conduit for his lucre.

I have been told by sources that she has denied receiving that amount of cash -- but I wonder how deeply the State Attorney's Office has delved into the banking accounts of their cooperating witness, who from all signs doesn't seem to be paying off very well.

At the same time, in a move that shows just how arrogant and corrupt these people are, Lieberman hired Stracher as her aide at the county last year, after the onset of the investigation, raising the specter that she may be paying off a potential witness with taxpayers' money.

This is only speculation -- but you sense that some secrets will remain buried in this investigation.

-- Florida Republicans, riding high on the batshit Tea Party, are taking off the veil, folks. They've always had designs on robbing the public blind, but now they've come up with a plan to build golf courses -- along with hotels and restaurants -- on our public parks.

The horrendous idea was apparently birthed by Jack Nicklaus himself -- and it would be Nicklaus who would profit from the destruction of our parks.

​While the bill would open the door for numerous parks to be turned into golf-oriented tourist traps, the only one slated for the firing line in the bill is Jonathan Dickinson State Park in Martin County, a camping treasure for us South Florida folks.

Sponsoring the legislation is Republican Sen. John Thrasher and West Palm's own Rep. Dan Rooney. The two men should be publicly flogged.

The terrifying part is that with Scott and the Republican Legislature this thing could actually go through. From the Palm Beach Post:

The bills are even more alarming than early reports suggested. For starters, the legislation would allow hotels in the parks and beer and liquor sales at golf facilities. The golf courses would not have to follow any city or county government regulations.

The legislation is an incredible sweetheart deal for Mr. Nicklaus, who met with Gov. Scott early on to suggest the plan for a "Jack Nicklaus Golf Trail" of courses in Florida's public parks. Nicklaus' lobbyist Jim Smith, former attorney general and secretary of state, told the St. Petersburg Times the governor endorses the idea.

Nicklaus Design has exclusive rights to design all the courses, though the firm agrees to lower its usual rate of $2.5 million per course to $625,000 each. In a down economy, not a bad deal.

The governor, indidentally, was in town today talking to the Florida Venture Capital Conference (when it comes to Scott's public appearance, it's either elite business groups or the Tea Party). And billionaire Wayne Huizenga loves him.

"I think the governor is doing a fabulous job," he told reporters today after Scott spoke at   ... He's going to do what he says he's going to do."

State to Broward Schools: Plan to restore trust isn't good enough

By Cara Fitzpatrick March 11, 2011 11:48 AMEducation Commissioner Eric Smith told the Broward County School District that its plan to "restore the public's trust" after a recent grand jury report ISN"T GOOD ENOUGH.In a letter sent to the district Thursday, Smith said he plans to send the state Department of Education's Inspector General to the district to review records, interview staff, and help him decide whether to launch a full-fledged investigation.

The Department of Education has never investigated a school district before, a department spokeswoman said. But, she emphasized that the Inspector General's purpose on the impending visit is to "evaluate and review."

Smith also told the district to provide its detailed report by March 31, sooner than the maximum 45-day deadline Superintendent Jim Notter had promised it by. He cited the "critical nature" of the grand jury's findings.

The grand jury found such "malfeasance, misfeasance and nonfeasance" that it could only be explained by "corruption of our officials." It said the board has demonstrated an appalling lack of both leadership and awareness, and it bashed Notter for letting board members meddle in the operation of the district.

In its 20-page summary response to Smith, the district proposed to increase training, create an ethics policy for board members, improve record-keeping, and discuss all construction and facilities items in public.

Well, Hutchinson and many others kept their heads low for the parade today. I saw Seiler working the staging area in an official-looking sash, but he didn't march or ride in an open vehicle. Unsurprisingly, the governor didn't show his face.

Representing the school board were Maureen Dinnen and Jennifer Gottlieb. I was with people who'd lived in New Orleans, where parade-going is a spectator sport, so they were happy to join me in shouting "Resign! Resign!" until the offenders' vehicle had passed.

Adderley was near the front, marching between two other cops in shirt sleeves. Much later in the parade there was a closed car with "Sheriff" on the hood, but being on the driver's side of the street, I can't confirm that Lamberti was the passenger.

As parades go, it wasn't up to last year's, and my friends the Mardi Gras veterans were critical of the locals' presentation: raggedy lines, banners held so carelessly they couldn't be read; people talking on their cells as they marched or rode on floats. Not many smiling faces, either.

There were horses, though, to give me something to smile about. A wagon advertising Bergeron was pulled by two big drafties. Several of the FLPD horses were there (the others might have been working at the Andrews Ave. end). & there were two men in LE uniforms I couldn't identify on very nice paints, riding side by side, One was doing dressage, surely a first on Las Olas.

About the only other thing that caught my eye was the small group with the sign saying that St. Patrick was a human trafficking victim. Someone else had a sign with a green map of the state and the information that Florida is 3rd (or maybe 5th) in the country on human trafficking.

Well, what about the disparity in facilities, equipment, and amenities between the minority area schools and the schools where our elected officials send their children. If you doubt what I'm mentioning, grab some friends and ask for a guided tour. You don't even have to look for the computers, electronic teaching aids, and modern desks...go look into the rest rooms. Compare Dillard, South Broward, or MacArthur with ANY school in Parkland, Weston, or Coral Springs. There's a reason that the new "Beachside Montessori School" in Hollywood has an enrollment that is not reflective of the neighborhood. Some politically powerful people have assured that THEIR children...and others who can afford an expensive pre-k program...will have the best facility, the best teachers, and the best accessories that prestige can buy. Stick them with a fork!!! THEY'RE DONE, dammit. They have cost the families with NO voice to suffer a second class education...and that costs ALL of us.

The Board's 20 page reply is all well and good for the future. I feel the School Board and Notter have to be accountable for the corruption and misuse of the Board's budget that put it in a deficit of MILLIONS of dollars, depriving all the county schools of much needed supplies and resources. They have to pay for that.

ATG...for probably the first time, I disagree with you. These "rollovers" serve as an example to all of the indicted, those thinking about doing something to get indicted, and the associates of those who are thinking about doing something that might get them indicted: There is NO honor among thieves. If you're doing something wrong, your partner in crime will sell your butt down the road to save his/her own. It may have taken Mike Satz a long time to start moving, however, the man is moving now. If those "rollovers" choose to stay in the area after the hearings and trials, pay attention to whom they are hanging with. Possibly the next crop of indictees. Pulpsters....don't let the momentum stop. Bob has given us the ammunition to get rid of these corrupt people. It's up to us to keep the pressure on them. That's wonderful news. The entire board especially Gottlieb and Notter have to be held accountable for the wasteful misuse and loss of the School Boards money. They commited criminal acts. They literally stole the quality of education out of the County to benefit their own selfish personal needs. They are crooks equal to those that take a gun and rob a bank. They should be put removed fron their positions on the board, brought up on criminal charges and do prison tie. This is too serious to be ignored.

Thank you so much. That was a nice description on the day's events. I see you know your horses. Perhaps the Mayor realized it wasn't the best for his and the city's image to be photographed with accused corrupt former officials as if they were still in good standing. Maybe he was informed of that and today was different. It's strange that practically everyone of the officials that marched in the parade has had some sort of back story. Oh well at least they were wearing green, when many think they should be wearing orange.

I can appreciate what you're saying and I agree. Perhaps "rolling over" on their cohorts in crime is atleast their redeeming factor for immunity. But after that, I feel they're still criminals, They were awarded freedom from prosecution from their crimes and then they should leave the State or at least Broward County.

I am working on the final chapter of Solving 9/11, which focuses on the destruction of the crucial steel evidence from the World Trade Center. In the interest of accuracy and completeness this effort requires contacting the key players in the administration of President George W. Bush. Yesterday, I called and wrote to John Ashcroft and Michael Chertoff, respectively the U.S. Attorney General and Assistant Attorney General during the Bush administration. Ashcroft has not yet responded; Chertoff has.

Michael Chertoff, who headed the Criminal Division of the U.S. Department of Justice at the time, responded to my email question. Chertoff said that he does not know who authorized the destruction of the crucial evidence from the World Trade Center. The Federal Bureau of Investigation, it should be noted, an agency of the Criminal Division of the Dept. of Justice under Michael Chertoff, led the 9/11 investigation.

This is to say that Chertoff, the official who had the highest managerial responsibility for the FBI investigation, says he does not know who authorized the destruction of the evidence from the crime scene his agency controlled. How believable is that?

The FBI, which controlled the criminal investigation, had ultimate authority over the evidence from the World Trade Center.

The FBI website says this about its 9/11 investigation:

Our ensuing investigation of the attacks of 9/11—code-named “PENTTBOM”—was our largest investigation ever. At the peak of the case, more than half our agents worked to identify the hijackers and their sponsors and, with other agencies, to head off any possible future attacks. We followed more than half-a-million investigative leads, including several hundred thousand tips from the public. The attack and crash sites also represented the largest crime scenes in FBI history.

Mayor Rudolph W. Giuliani and Defense Secretary Donald H. Rumsfeld at ground zero three days after the World Trade Center collapsed. A New York Times article entitled "Ground Zero Illness Clouding Giuliani's Legacy" reported that Giuliani “seized control” of the World Trade Center site. Why did the U.S. government allow him to destroy the evidence?

Here is the email exchange between me and Michael Chertoff:

Mr. Chertoff,

I am a journalist working on an article about the destruction of the steel from the World Trade Center. The questions that I am posing herewith are for the purpose of this article.

When Kenneth Holden of the Department of Design and Construction of New York City gave his statement to the 9/11 Commission on April 1, 2003, he said that he had received "verbal permission" to send the steel to scrap yards in New Jersey, but failed to name the person who had authorized the move.

Did you give the permission to send the steel from the World Trade Center to the scrap yard? If you did not authorize the destruction of the steel, who did?

Chertoff responded the same day:

When Commissioner Holden was reappointed head of New York City’s Department of Design and Construction in January 2002, Mayor Bloomberg praised him saying:

New Yorkers are fortunate to have Commissioner Holden agree to remain as Commissioner of DDC. Over the last four months he has done a terrific job managing the clean up of the World Trade Center and so that the reconstruction process for Lower Manhattan can begin. By coordinating the movement of millions of tons of steel and rubble, excavating one of the most dangerous work sites in the world all seemingly ahead of schedule, under budget and without a fatality, Kenneth Holden has been the unsung hero of this enormous task.

Can you tell me why U.S. Attorney General John Ashcroft and the Criminal Division of the Department of Justice, which you headed, allowed Mayor Giuliani to “seize control” of the crime scene and make decisions that resulted in the hasty destruction of crucial evidence before it could be properly examined?

The New York City Department of Design and Construction reportedly oversaw the recovery efforts. A New York Times article entitled "Ground Zero Illness Clouding Giuliani's Legacy" of 14 May 2007 reported that Mayor Rudolph W. Giuliani “seized control” of the World Trade Center site:

An examination of Mr. Giuliani’s handling of the extraordinary recovery operation during his last months in office shows that he seized control and largely limited the influence of experienced federal agencies…

A Mayor in Control - From the beginning, there was no doubt that Mr. Giuliani and his team ruled the hellish disaster site. Officials from the Federal Emergency Management Agency, the Army Corps of Engineers and the Occupational Safety and Health Administration, all with extensive disaster response experience, arrived almost immediately, only to be placed on the sideline. One Army Corps official said Mr. Giuliani acted like a “benevolent dictator.”

Despite the presence of those federal experts, Mr. Giuliani assigned the ground zero cleanup to a largely unknown city agency, the Department of Design and Construction. Kenneth Holden, the department’s commissioner until January 2004, said in a deposition in the federal lawsuit against the city that he initially expected FEMA or the Army Corps to try to take over the cleanup operation. Mr. Giuliani never let them.

Why did President Bush and Attorney General Ashcroft allow Mayor Giuliani to “take over the cleanup operation”?

In the person of Congressman Peter King (R-New York), the incoming chairman of the House Homeland Security Committee, the abstraction called "hypocrisy" has acquired tangible human form. After spending decades canvassing his fellow Irish-American Catholics to raise money for terrorists in Northern Ireland, King has promised to conduct a wide-ranging investigation of American Muslim congregations and cultural organizations in search of people providing "material support" for Islamic terrorism.

"We have to break through this politically correct nonsense which keeps us from debating and discussing what I think is one of the most vitally important issues in this country," King insists. "We are under siege by Muslim terrorists and yet there are Muslim leaders in this country who do not cooperate with law enforcement."King has also demanded that the WikiLeaks whistleblower organization be designated a terrorist organization. He insists that the group provided "material support" to terrorism by publishing hundreds of thousands of pages' worth of previously classified documents, many of them describing criminal acts and institutionalized corruption on the part of policy-makers in the U.S. government. It's reasonable to suspect that King's antipathy toward WikiLeaks is inspired, at least in part, by personal concerns. Among the documents made public by WikiLeaks is one that could be of particular interest to King -- a February 2010 CIA "Red Cell Special Memorandum" -- an "out-of-the-box" analysis examining "what it would mean for the US to be seen ... as an incubator and `exporter of terrorism.'" For example: "Some Irish-Americans have long provided financial aid and material support for violent efforts to compel the United Kingdom to relinquish control of Northern Ireland.... The US-based Irish Northern Aid Committee (NORAID), founded in the late 1960s, provided the Provisional Irish Republican Army (PIRA) with money that was frequently used for arms purchases." NORAID was designated by the Justice Department as an arm of the IRA more than thirty years ago. King, whose Long Island district has a large and well-organized Irish-American constituency, was one of the group's most effective fundraisers and one of the IRA's staunchest supporters.

King served as chairman of the House Homeland Security Committee from 2005 until the Republicans lost their majority in the 2006 mid-term election. During his last stint in that post, King used his influence to intervene on behalf of Malachy McAllister.

In 1981, McAllister served as an armed lookout during an ambush of a policeman outside a pub in Northern Ireland. The victim, it must be said, was a member of the Royal Ulster Constabulary, a paramilitary force that became notorious for beating and otherwise mistreating innocent people. McAllister served three years in a British prison for his role in the ambush.

In 1988, after McAllister was released from prison, he narrowly escaped being killed by a Loyalist paramilitary gang that opened fire on his family's home in Belfast. The McAllisters fled to Canada, and in 1996 and settled in Wallington, New York. Seven years later the McAllisters' home came under armed siege once again -- this time by agents of the Department of Homeland Security, who carried out a 5 a.m. raid to enforce a deportation order. The family was to be expelled on account of what the agency called McAllister's "terrorist activities" a quarter-century ago.A stay was issued while the deportation order was examined in the courts. King used the interval to lobby Homeland Security Commissar Michael Chertoff. In a letter to Chertoff, King insisted that McAllister's family would likely be murdered if they were sent back to Northern Ireland. McAllister, like many Catholics in Ulster, endured inexcusable treatment at the hands of British occupation forces and Loyalist thugs. He admits to committing the acts for which he was incarcerated, but describes himself as a combatant in a civil war, rather than a terrorist. That distinction is difficult to defend in light of the fact that McAllister was a member of the Irish National Republican Army (INLA) -- the military wing of the Irish Republican Socialist Party (IRSP).

And these actions affect every one of us.
