Foreclosure Firm Ben-Ezra & Katz Is Latest Addition to Attorney General's Investigation

The state foreclosure fraud investigation expands.
Fort Lauderdale law firm Ben-Ezra & Katz is the most recent subject of the state attorney general's mortgage fraud investigation. The firm "appears to be fabricating and/or presenting false and misleading documents in foreclosure cases," according to the allegation listed by the office of Florida's attorney general, Pam Bondi.

Ben-Ezra & Katz is the first firm to be added in 2011 to the five total law firms under investigation. As of February 10, Fannie Mae terminated its business with the firm, as it did last year with the law offices of David J. Stern, also under state investigation. Two weeks ago, only days after Fannie Mae cut ties with Ben-Ezra, the firm laid off 182 employees and its affiliated title company laid off 36, resulting in 218 total layoffs.

Before the layoffs, the law firm and title company had 536 employees, meaning the recent cuts translate to a 40 percent reduction in staff. No further layoffs are planned at this time, according to a company media representative.

Following the 2010 layoffs at David J. Stern's law firm and processing company, DJSP, former employees filed a lawsuit alleging that the company did not comply with the Worker Adjustment and Retraining Notification (WARN) Act, which conditionally requires 60 days' notice of mass layoffs. WARN records for Ben-Ezra & Katz are backdated, with a notice date of February 21, 2011, and a layoff date of February 14, 2011, one week prior.

I have been dealing with PNC bank trying to save a friends home from foreclosure... I was researching Ben-Ezra & Katz and to my surprise they are being investigated... It seems the two are working together because PNC is giving my friend the run around and stating they have not received some of the required information... Which is not true, how do you receive some and not the bank statements... Trying to find an honest foreclosure attorney is like trying to find a needle in a hay stack...

I also have been dealing with PNC bank trying to save my home from foreclosure for 1 1/2 yrs. they turn me down and then ask me to reapply for a home loan mortgage program. I am now so much behind now they want to take my home. Any suggestions?

Copy everything you send, send via fax with confirmation, then certified delivery with return receipt. Make sure all correspondence (that is important) from the bank is received in writing. A lot of the foreclosure foreclosure firms in Florida are under investigation right now - back procedures for quick profit.

Also, seeing that you are just someone who Matt has helped, please consider yourself lucky that he did not scam you too. I do not understand why you badger when you were helped. Please allow us that have been scammed voice our concern about Matt Misczak and we will let you bask in your glory that you were personally helped by Matt Misczak. Now, even with his “own home” has been deeded to his wife, and she has just filed bankruptcy as well. Matt Misczak is a Con Man! Please do your research before giving ANY money to a man like him! He put almost 100 homes in Land Trusts in the DFW area and MANY of those were foreclosed on. He collected rents from tenants and pocketed the money. He is trouble and has been since the days of Superior Real Estate Solutions, Texas Lease Houses, Valcom, etc. Search the Tarrant Appraisal District under previous owners. Also search the Bankruptcy Court records in Dallas around 2006, and also the Texas Real Estate Commission as he has outstanding suits against him for deceptive practices.Good Luck all…just do your homework! It is very easy to find a lot of information on this Con Man!

What's interesting to me is that the companies (Freddie, Fannie & the banks) had to know that the volume of foreclosures being processed by these firms on a weekly or monthly basis was enormous. They paid lows fees, which results in... a mill! Both parties are to blame. Great for foreclosure defense attorneys and homeowners who have been dealing with all the "errors"
