Grand Jury Slams Jennifer Gottlieb's "Beachside Boondoggle"

The Sun-Sentinel obtained some comments from school boarder defending themselves from the findings of the statewide grand jury.  

Said Broward Schools Supt. Jim Notter: "I've built a 37-year career by being passionate about digging through the data, emphasizing accountability and getting things done right."

Sure. Except when he was willfully violating state law to allow the lobbyist and contractors to take over the school district and waste hundreds of millions in taxpayers' money.

There was former school board member and all-around political hack Marty Rubinstein, who said the report smacked of a "political vendetta."

Oh now it makes sense. The members of the statewide grand jury were political plants installed by the board members' political opponents. That's about as reasonable as the idea that the State Attorney's public corruption unit went Stacy Ritter to further the political career of Ari Porth, right?

Funny, the school board members and other corrupt politicians in this town used to claim its critics were rife with conspiracy theories -- now it's the other way around.

Incredibly, the Sentinel also quoted the criminally charged former board member Stephanie Kraft. She complained that the grand jury included Bob Parks' penchant for naming buildings after himself. "Maybe politically that wasn't smart, but why was that even in a grand jury report?" she asked. "Is that corruption? If it is, indict him."

How bizarre is this county when criminally charged and ethically bankrupt school board members like Kraft are attacking statewide grand juries in the daily newspaper for reporting on school board corruption?

These people are never going to get it. The only people who made any sense in the article were new board member Patti Good and board activist Mary Fertig, who praised the report but questioned the recommendation to have an elected superintendent.

Good, in fact, was the only board member to respond to the Sentinel's request for comment, which is pretty outrageous. One who apparently stayed sheltered from the storm was Jennifer Gottlieb.

No wonder -- she was slammed hard in the report, specifically for her pet project, the unnecessary $25 million Beachside Village Montessori school in Hollywood. 

No fewer than five pages of the 51-page report were devoted to what the grand jury called the "Beachside Boondoggle." This was another taxpayers' waste that I wrote about in 2009. Here's how the grand jury led off its slam of school:

The building of what is now known as Beachside Montessori ... is a microcosm of everything that is wrong with the Board and District: interference by the Board in the building of projects, favoritism in the selecting' or keeping of contractors, rushing projects to contract without complete plans, cost overruns, wasting tax dollars on unnecessary and unjustified projects, unilateral decision making by individual Board members, strong arming local neighborhoods, failure to have any meaningful oversight or discussion as a Board regarding the need for the school, complete lack of accountability, and failure to adhere to Board policy. ... The process was not open and transparent and the Board engaged in underhanded tactics to build this and other schools at a time when it knew the District had an excess of capacity.

And you ain't seen nothing yet. Inside read what they said about Gottlieb's role in the process.

Here it is. The "particular Board member," is, of course Gottlieb.

The reality of what happened, as told to us by a myriad of witnesses, is that after 2006 Beachside became a particular Board member's "baby". According to witnesses it is well known to virtually all District employees that most, if not all, Board members have pet projects that it's best not to interfere with, no matter how wasteful or unjustifiable the project may appear to be.

This particular Board member argued the case for Beachside against the number crunchers in the Boundaries department When former Deputy Superintendent Michael Garretson tried to cancel the project in June of 2008, it was this same Board member who, in the presence of Mr. Garretson and the PM, stated emphatically that the school would be built and it would be built with that contractor.

It was the same Board member who decreed that the school would be changed to a K-8, necessitating delays, design changes, and driving up the costs. It was this Board member who decided unilaterally that it would be a Montessori school. As the process neared completion, it was this same Board member who attended a meeting of parents interested in sending their children to Beachside, a meeting held not at a school building or other public building, but rather at a private residence, a meeting she attended in her official capacity even though it was not publicized and attendance was by invitation only.

Beachside was slated to be built partly on a City of Hollywood park, an extremely controversial decision amongst some Hollywood residents. The city contributed the land based on Board plans for an elementary school. The change to a K-8 caught both the city and residents off guard. This change required the City to ratify changes to the existing contract between the City and Board. When opposition to the change arose in Hollywood, due to the impact on park operating hours, it was this Board member who attended the city commission meeting and made a thinly veiled threat to have the park closed even longer if the city did not agree to the changes.

According to the witnesses and documents provided to us, as early as 2006 virtually everyone
in Facilities up to and including the Deputy Superintendent recognized that it was a waste of money to pay for a new school building in that area. We question where the senior leadership ofthe district was during this process. Why was there no effort by the District to seize back control ofthe construction program, or to at least insist that the decision be made by the Board as a whole? Had there been a full public debate perhaps all ofthe issues could have been addressed. One thing that might have been done was to explore the option of changing the boundaries. Another might be emptying out one of the existing schools and renovating it to accommodate the Montessori concept. That would have avoided destroying a local park, displacing residents, saved millions in land acquisition and millions more in
construction. Perhaps the school could have been located in an area of overcrowding out west.

Apparently the people behind Beachside weren't interested in other ideas or public debate.
In our view the inaction of both the Board and the District leadership allowing an individual
Board member to unilaterally shove through a "pet project" was a gross dereliction of duty on their parts. This "process" doesn't sit well with us and we doubt it will sit well with the taxpayers who in the end had to pay over $25 million for an unnecessary school building.

it's always INTERESTing to go back and see, with the reality of the ways things turned out, how the players originally took a stand to defend what they knew was wrong, back then - all for money

It seems that Mr.Norman and many haters on this blog have a deep hatred for Mrs Gottliebor envy maybe.... for the measly pay and low rewards that the job has given her she should tell you all to go to hell...but she is too much of a lady to do that.The fact that the montessori school was already approved and construction contracts were given before she was elected to the board does not seem to come up on this dialogue.the school has a 2000 children waiting list,if anything we should expand it....By the way Mrs Gottlieb boys children attended the Montessori school in Ft Lauderdalelong before the Hollywood one was built or she was a board member,their transfer to Hollywood was in accordance with the rules......Peace!

Notter should go he is evidently worried about something other than student achievement or he would have put this money into the schools. Students do not have books and the computers are junk. Well, that evidently does not matter in this (leader's ???) eyes. He has proven that he can't do the job. His salary alone could fix many things. Again we are worried about teacher's salaries. Mrs. Gotlieb had a school built for her children with taxpayer dollars. Why didn't she just pay to send her kids to private school? Its because she feels entitled to have us the taxpayers pay for her kids education. We are the same people that vote her in to office. This shows the gross mismanagement of the school board. Like many others, I'm wondering why, if the Grand Jury is hurling accusations of wrongdoing around so often in its report, it didn't hand up a single indictment? Can anyone explain it? Perhaps I can . . .

Florida’s rules relating to grand jury activities declare it improper for a grand jury “to make a presentment using words of censure or reprobation so that a public official or any other person is impugned or embarrassed, unless [the grand jury] return an [indictment.]"”

Specifically, Florida Statute Section 905.28 says that “A report or presentment of the grand jury relating to an individual which is not accompanied by a true bill or indictment . . . shall not be made public or be published until the individual concerned has been furnished a copy thereof and given 15 days to file with the circuit court a motion to repress or expunge the report or that portion which is improper and unlawful.

So, it seems that if this grand jury had named people, each of them would have had the right to contest the report’s findings as to them.

As for the absence of indictments, proof beyond and to the exclusion of a reasonable doubt must have been lacking. Maybe we need someone to investigate the manner in which evidence was presented to the grand jury.

He stated at a recent City Commissioners meeting that giving scholarships would also be a mistake because those getting the scholarships would be more likely to take their kids out of the program after the scholarship runs out. Of course, he has no facts to back that up. Ken Gottlieb (Jennifer’s husband and state representative) was outside a recent City of Hollywood commission meeting shaking hands with parents from Beachside who had come to a City Commission meeting to protest the City from taking any further action on getting rid of the $135/wk, $4800/year tuition for the preK3 and preK4 programs. In response to Ray's statement regarding the hiring of an individual to run the business part of the District and another to run the school operations, this was tried during Dr. Till's regime. I do not remember the individual's name but he had previously worked for FP&L. He lasted less than a year before he was fired. This was never tried again.

As to Countryman; in my trial, Dr. Till stated he and Countryman met every week to discuss the complaints from the witnesses regarding management issues. After interviewing with Countryman on many occasions, it became obvious that he was not familiar with construction procedures, terminology or how construction projects were run. He even asked if I knew of any "expert" witness he could call. I suggested a professor from one of the colleges with the oldest construction school but he never bothered. The only thing he was intereseted in was if any of us had seen an exchange of money between contractors and District personnel during our everyday workday. He did not understand fraud through change orders, types of construction contracts misinterpreted to the advantage of the contractor, change orders charged to inspectors, etc. After a period of time, I and others like me refused to see Countryman after it became obvious, he was just going through the motions and nothing was going to happen. The State Attorney that followed him was too busy going after Ken Jenny to be bothered with the School Board problems. You can draw your own conclusions from what I have said.

There are two very complex and current cover ups occurring at this very moment. The timing of the release of the report could cause the perps to regroup on the fly. Either way, we'll find out soon enough and I'll keep you posted. Hint: FTE and FEMA. In each case the issues lead directly back to actions or inactions of the superintendent. Conveniently these issues have been captured on video and will surely make more sense after the chips fall where they may.

Why hasn't that much been brought up now of how Notter got the job? Wasn't the Superduper Supposed to have a PHD? Wasn't there a rule about the interim not serving as the permanent Super?

Do they have a reason they didn't do the October Report or whatever it is called that looks at possible enrollment compared to school seat availability?

This is what happens to little people when they become the big frog in the little pond. It goes to their head and other places.

We need two superintendents. One with an academic background, one with a business background. They would be co-equal and report to the board if there were any disagreements, but each would be held responsible for his/her area of expertize. They would be paid less also than the current one.

How do you take a person who has never been in a business background and put her/him in charge of a billion dollar industry and then expect it to work.

When a system is so broken as this one, SBBC, you don't add more band aids, you start all over and replace the current key members with new people. You also create a SBBC code of conduct that is approved by a vote of the people of Broward.

We have had the weasels and foxes guarding the school house so long, we no longer know what responsible leadership is.

Yesterday, I sent an e-mail to all of the legislators who represent Broward County. I received a reply from Ellyn Bogdanoff today saying she had not read the report but that she would get back to me after she read it. Need more of you to contact more of your legislators - lets see if the squeakiest wheel gets the oil.

Broward Teachers' Union call for Notter's resignation. Here's a link. Anybody know what the plan is? Are they going to organize and take turns with the three minute for each speaker? The board really hates when that happens. Well if the BTU goes to the board meeting, just remember to exercise all of the characteristics of Respect, Integrity, etc...Wouldn't want anyone to be removed by SIU for saying unflattering things or whatever happens...

One of the biggest mistakes we accepted was allowing Broward to be ONE school district.Broward is the 6th largest school district in the nation. We need to micro-manage the district.

Perhaps the taxpayers would have a better handle on the school district if we divided the 250,000 children up into separate school districts . North, South, East, West school districts.

Lets not forget the main cheerleader for the school and whos kids also attend, Hollywood mayor Pete Bober. Guess he figured since mayor Mara got buried powerlines for her beachplace diggs he at least deserved a school! The only surprise is that they didn't name the place after themselves.

There's a school board meeting on Tuesday at 10 a.m. at the Kathleen Wright building near the courthouse (600 SE 3rd Ave.), and ethics is on the agenda. This doesn't give much time to mobilize and prepare, but from my limited experience, I think it's true that in order to be allowed to sign up to speak, your topic has to be related to a posted agenda item. There seem to be more meetings not open to the public than open, and the next open meeting doesn't have ethics on the agenda.

Let's also remember that those who send their children to the PAID Pre-K at the Beach Boondoggle school are entitled to enroll in the Montessori school ahead of neighborhood children. Most of the kids in the neighborhood are financially disadvantaged, so they go to the FREE Pre-K. Another slap in the face to the locals.

Somehow, several of you have missed the real point here. Unless the legislators enact laws that have real teeth instead of slaps on the wrist, the School Board will continue to tell you they are going to respond to the recommendations and either lie they have corrected the issues or just totally ignore it. And then the Board just continues business as usually. Even the Grand Jury report issued in December 2010, the Grand Jury Foreman stated, no one can be punished for these acts unless laws are put in place to have prison sentences or large enough fines to stop these actions. The political machine in Broward keeps electing these individuals and out number the voters who vote at the polls. Unless there is a grass root movement to elect true public servants, nothing will be done. You can go to the Board meetings and demonstrate as you suggest, it might change what happens, but will your movement be there at every meeting to continue the scrutiny? Most of the deceptive behavior is behind closed doors and phone calls. The School Board owns a public television station; so why is their meeting recorded for delayed broadcast. One of those broadcasts is at 2 am in the morning. I am certain all hardworking parents are up at that time? BTU was aware of all of the problems with mold and mildew from 2001 when TSP joined their union, but did BTU take any action to stand behind the inspectors who were trying to insure corrective procedures were being followed to correct. Poor construction has been a problem since 1985 but when did BTU make it an issue, in the last 2 years. The whole administrative system needs to be replaced and start over.

I gave a list of Broward County legislators on my previous comment on the previous article. You can find them on Google, At least make the effort to write and complain. Do both, go to the School Board meetings and write your legislator. I did both and I spoke up.

As to Notter's always doing the right thing. I can recall him telling me he would decide how a code violation would be interpreted; because he was the principal and I was the teacher. He had to be reminded he had no construction experience and also did not have a state license authorizing him to do so. At that time he didn't know what plans and specs were. Since he was Associate Superintendent of the Vocational Schools, please tell me how instructors in those schools make over $100,000 a year and the money generated in those schools are not shared with the rest of the District?

She is telling parents and Hollywood city commissioners that the entire school is in jeopardy, the Montessori programs will be severely damaged if the pre-K tuition is removed. Mayor Bober even takes it further. He stated at a recent City Commissioners meeting that giving scholarships would also be a mistake because those getting the scholarships would be more likely to take their kids out of the program after the scholarship runs out. Of course, he has no facts to back that up. Ken Gottlieb (Jennifer’s husband and state representative) was outside a recent City of Hollywood commission meeting shaking hands with parents from Beachside who had come to a City Commission meeting to protest the City from taking any further action on getting rid of the $135/wk, $4800/year tuition for the preK3 and preK4 programs. The newest figures out show Beachside Montessori is 78% white, non-Hispanic.

You are right, Ray. The Interim Super was not supposed to be eligible to become the permanent Superintendent. How do you suppose they worded the general advertisement for the Superintendent job ? "Must be a team player. Must keep mouth shut while enabling theft of millions of dollars by nine corrupt politicians. Must be able to hide behind Marko. And be willing to cover JenJen's adventures." What decent person is going to send their resume in based on an ad like that ?? And who from outside the team could they have trusted to meet those job requirements?

Good luck getting anything from this band of thieves. I, and several former co-workers, requested the documents associated with our layoffs and the District refused to give it to us or our attorneys. They responded by sending all of us copies of our layoff letters, knowing darn well we wanted the justifications of why we were laid off instead of less senior co-workers, and who it was that recommended our layoffs. Guess what? They took two months to respond and still did not give us what our lawyers requested. We each paid about $50 for a dozen pieces of paper. The District charged me 1-1/2 hours to locate and copy 11 sheets of paper.

Before any of you jump on me for having a lawyer, I was forced to pool my money with several other "victims" of the HR cuts to hire an attorney only AFTER months of trying unsuccessfully to get the information on my own.

The district maps are to the right. Contacting staff (Sandy, Dee) you can easily get a list of all members (current electeds) and contact info, Leg Del meeting dates (as this would be a good venue to stand up and speak - meaning staging a reading of the report - too).

I am in as a participant as well, though I thorough agree with what Fly said. [It was for this very reason that the redrawing of the district boundaries had to go through referendum again. When challenged in the courts, the laws on the books could not support the "wrong" nature of how district lines had been drawn previously.]

However, I just wonder if there are any existing laws under which these thieves could be charged. What I mean, since there is nothing that specifically deals with this kind of situation in a manner that would send these folks to jail doing real time for felony criminal acts ... can't existing laws be loosely interpreted to apply to these folks? If someone stole a loaf of bread from a store to feed a family and was caught, s/he would probably get more tough jail time than these bozos. Isn't thievery .. . thievery? Anyone with in depth knowledge of the law able to weigh in on this topic?
