Will Lamberti have to raise his right hand in Rothstein court?
Busy news night. Another Broward jail worker, this one a nurse named Carline Jean, was arrested yesterday on charges of introducing contraband to an inmate, including giving the inmate a cell phone and (this goes without saying at this point) sending nude pictures of herself to the prisoner.

What's in the water at the Broward County Jail? 

Jean, 34, is sitting in the jail where she cared for patients on $75,000 bond. She's the fourth jail employee -- the other three were deputies -- charged with giving contraband to prisoners and the third who apparently engaged in some form of sexual interplay with inmates.

My sources are telling me there are more arrests to come.

In the meantime, a kindly reader sent me the motion filed by former RRA partner Russ Adler's legal team to depose Sheriff Al Lamberti in his bankruptcy trial. The Scott Rothstein bankruptcy trustee is demanding $1.2 million in clawbacks from Adler for alleged overcompensation and unpaid loans from Rothstein during his Ponzi scheme. From the motion:  

Sheriff Lamberti is not just a public official; he is the chief law enforcement officer for Broward County. His primary purpose and responsibility is to detect and investigate criminal activity in Broward County. It is abundantly clear from the attached newspaper articles that neither he nor other high ranking members of the Sheriff's Office (Wheeler and Benjamin) ever suspected that Rothstein was engaged in criminal activity, despite his admitted "friendship" with Rothstein and the fact that Messrs. Wheeler and Benjamin were even closer with Rothstein, and never suspected him either. This is why the testimony of Sheriff Lamberti is so critically important to the Adlers' defense to the case at Bar.

Questions Adler wants to ask Lamberti in court (from federal court documents):

a. Please provide your name and professional address for the record.

b. Isn't it true that you knew Scott Rothstein for many years?

c. Isn't it true you consider yourself a friend of Scott Rothstein?

d. Isn't it true Scott Rothstein was a member of the Broward Sheriff Advisory Counsel?

e. Isn't it true that membership on the Advisory Counsel is by invitation only?

f. Isn't it true that all members of the Advisory Council must go through a background check before a potential member is approved to join the Council?

g. Isn't it true that during your campaign to become Sheriff, Scott Rothstein was
instrumental in arranging a fundraiser for your campaign at Ross Peiko's house?

h. Isn't it true that Mr. Rothstein, both through personal friends of his and lawyers employed by RRA, contributed to your campaign?

i. How much did Mr. Rothstein raise for your election campaign?

j. Isn't it true that you have been to Mr. Rothstein's house on Las Olas Isles?

k. Isn't it true you have been to Mr. Rothstein's house in Harbor Beach?

l. Isn't it true that you were aware of Mr. Rothstein's expensive lifestyle, which includes various homes, jewelry and traveling on private jets?

m. Isn't it true that you were a guest of Mr. Rothstein in the skybox at Dolphin Stadium on more than one occasion?

n. How many times did you attend Dolphin games as a guest of Mr. Rothstein?

o. Isn't it true that you sent a letter to Scott Rothstein congratulating him for the award received from the Anti-defamation League in 2008?

p. Isn't it true that your letter to Mr. Rothstein thanked him for his friendship during
the year prior?

q. Isn't it true that in your letter you offered to professionally and personally assist Scott Rothstein should he call upon you to do so?

r. Isn't it true that Tom Wheeler, employed by the Broward County Sheriff Office, was a close personal friend to Mr. Rothstein?

s. Isn't it true that Mr. Rothstein was a close personal friend of David Benjamin, a lieutenant with the Broward County Sheriff's Office?

t. Isn't it true that you never suspected that Mr. Rothstein was involved in any criminal activity, including the Ponzi scheme for which he was convicted?

u. Were you ever suspicious of Mr. Rothstein's activities?

v. Isn't it true that Mr. Rothstein was never investigated by the Broward County Sheriff's Office?

w. Isn't it true that you were never advised from anyone employed by the Broward County Sheriff's Office or anyone else in law enforcement, prior to the end of October 2009 that Mr. Rothstein was involved in criminal activity?

x. Isn't it true that you never received any information from citizens prior to the end of October 2009, whether they be friends or associates of Mr. Rothstein or investors or otherwise, that Mr. Rothstein was involved in criminal activity?

y. If you did learn of such purported criminal activity, isn't it true you would have caused Mr. Rothstein to be investigated?

z. Isn't it true that if you received information regarding Mr. Rothstein's purported criminal activity you would have ceased associating with Mr. Rothstein?

aa. Isn't it true that if you received information regarding Mr. Rothstein's purported criminal activity you would have instructed employees of the Broward County Sheriff Office, including Messrs. Wheeler and Benjamin to cease associating with Mr. Rothstein?

bb. Isn't it true that you never received any information from any source whatsoever that Russell Adler or Katie Adler had any actual knowledge or involvement in Mr. Rothstein's criminal activity?

cc. Isn't it true that Mr. Rothstein never gave you any indication that he was involved in criminal activity?

Just judging from the neck up photo of Carline, the texted nude pics of her may have constituted cruel and unusual punishment for that poor prison inmate.

I were that poor inmate, I would be petitioning the court for a one way trip to Starke just to get as far away from those nude pics as possible.

Did Tony Villegas wear Thom McCann shoes? The Sheriff in a press release got up in front of TV cameras and said the poi wore Thom McCann shoes. He then said he didn't think they made that brand anymore. My guess is whoever told the sheriff to say that was not his friend. The Anthony case is getting interesting in that they have managed to get rid on anyone working on it that is not from FL.You would think the case would have been moved out of Orlando by now. It's the opposite it is probably the only place she can get a fair trial.You have to realize that the lawyers for the police and firefighters are partly the law firm of Joel Steingers son. As I posted over a year ago, those in the inner sanctum at RRA--Adler included-- were left with no choice but to advocate a position of complete and utter ignorance. It is the lesser of two evils for him.

Now, if you knew anything about Scotty and how he carried on in public-- even around strangers-- you would know that there is no possible way Adler did not know his partner was as a crooked as a barrel of snakes. The lavish and never ending purchases, the security system, the bodyguards (What lawyer has bodyguards?), the lack of a real law practice that would justify and support all of those expenditures, etc:McFly, McFly, is anybody home?

So, Adler, you are either someone who at the very least acquiesced to obvious criminal activity, or in the alternative, you are palpably idiotic and clueless because everyone within close proximity to Rothstein knew for certain he was dirty.

These are all softball questions that Lamberti should embrace. How nice to know them in advance of the depo. Great opportunity to go on record and bolster Adler's narrative and make yourself look good to boot.

Remember Lamberti is always doing things for his personal interest. That is why he was bringing his son and following broward's biggest historical thief wherever and whenever as long as the money was coming in for his campaign.

Now he's going after the jail workers only after he had a fight with them over the raise he gave only to his ranks.

Don't be suprised if after tarnishing the jail pigs he asks for a private company to take over the jail and fund his future campaigns forever.

If any deputy honored his oath he or she would have arrested Lamberti, at least for perjury while he had that guilty hand up before.

If any deputy believed in the law he or she would have arrested Lamberti.

I think that Adler is really clutching at straws. Is he saying that Sheriff Lamberti SHOULD have known everything that Adler MUST have known? Astute lawyer has it correctly, it's a dumb defense. I'm a Democrat, but I think that Lamberti is head and shoulders above Jenne, Navarro, and Brescher...not to mention Alan B. Michel. The Sheriffs office probably needs to be restructured. Fire services should not be under the auspices of law enforcement, perhaps the jails shouldn't either, but, I don't think that Al Lamberti "...looked the other way.." regarding Rothstein. Perhaps some of his command staff did...and I'm waiting for the Sheriff to correct THAT mistake.

I'm still amazed that after all this time, there haven't been DOZENS more arrests in the Rothstein fiasco...Kimmee, most of the staff at RRA & at least half of BSO...but hardly anyone but Rothstein & Villegas. What a travesty of justice...

One thing that definitely needs to be done in light of LEO's bodyguarding of Rothstein, would be to once & for all PROHIBIT LEOs from moonlighting on any security job of any kind. But that's pie in the sky, isn't it?

Adler is a POS. Instead of admitting he's a f*cking liar, instead he chooses to say he's deaf, dumb and blind. He was a name partner with Rothstein. He blew his horn everywhere he went about how close/tight/important he and SR were, the "A" in RRA. He bought drugs/condos/dancers with Scott's ponzi money. Agree they are softball questions (and not very well phrased, at that). But I *believe* the intent is to have the interrogatories with responses on record. Once on record, opposing attorney can delve further and make Lamberti look like a real fool - by certifying one thing and then disproving himself and his actions later.

No one who sits in judgment of the facts is going to render a verdict favorable to Adler. I would think he is intelligent enough to know that and is posturing in order to cut a better deal for himself in the clawback lawsuit, hoping to pay back pennies on the dollar.
