Share of Fortune Contested in Boies Divorce

Less than three months before she died after a two-year battle with cancer, Fort Lauderdale attorney Caryl Boies was served with divorce papers from her husband of more than seven years, Broward Sheriff's Capt. Richard Reilly, an action has set the stage for some legal wrangling over part of the considerable Boies estate.

Caryl Boies, who was 48 when she passed away on December 26, was the daughter of attorney David Boies, famed for his work in the 2000 presidential vote recount representing Al Gore and for his role in the Microsoft antitrust case.

While Reilly's assets amount almost exclusively to a BSO pension worth $1.2 million, Boies valued her assets at more than $13 million. That figure doesn't include nearly $20 million sunk into law buildings near the Broward County Courthouse that Caryl Boies acquired in 2006 at the height of the real estate boom because the buildings have lost considerable value.

In court filings, the 49-year-old Reilly is asking for attorney's fees and "an unequal distribution of assets wherein the husband receives a greater share." Prior to her death, Boies indicated in court filings that she didn't want to pay for her husband's lawyer or give him a greater share of their marital assets. There is no mention in court filings of a prenuptial agreement.

Among the $13 million in assets listed by Boies was $3.5 million equity in her Rio Vista dream house she shared with Reilly before the split. She also listed nearly $7.3 million in two partnerships and a $182,000 stake in her father's law firm, Boies Schiller Flexner.

Caryl Boies founded the firm's Fort Lauderdale office and, in 2006, purchased law office buildings at 700 and 750 SE Third Ave., 409 SE Eighth St., and 524 S. Andrews Ave. Her real estate holding company, CBSA, paid nearly $20 million for the property at the time, but according to affidavits filed in the divorce proceeding, they are now worth a combined $13 million. Negative equity in the buildings was calculated at more than $800,000. A portion of those buildings was listed as nonmarital in nature.

Boies listed $894,252 in net annual income versus Reilly's take-home $99,335 from his BSO salary. Reilly, a member of Sheriff Al Lamberti's command staff, listed assets of $295,500 in the house he now lives in, $1.2 million in his public pension fund, and a motorcycle valued at $10,000. He totaled his debts at $3,023,000, including $323,000 owed on the house, a $2.3 million mortgage on the Rio Vista home, and a $400,000 construction loan.

"Based on the superior financial ability of the wife and the needs of the husband," wrote his attorney, Kim Marjenhoff, in court papers, "the wife should be obligated to pay the husband's attorney's fees and costs."

In court filings submitted by Boies' attorney Jeffrey Weisman, Boies disputed paying the attorney's fees and allowing Reilly to recieve a "greater share" of the marital assets.

Weisman declined comment when contacted at his law office, and I am requesting comment from Marjenhoff as well. The couple was married on April 6, 2003, and had no children.

He went to the W Hotel in Wash DC right next to the White House so he could entertain a lady friend in the style to which he has been accomstomed. That weekend and several more also. That's the process of constantly spending great amounts of county time on exchanging his various cars so as to conceal his late night social calls on everybody except his wife. Let's see: I'll leave my take home BSO car in the main lot, and take my Checy Avalanche truck. Then when I get throughly drunk at the Captital Grill, I'll order my civilian aide Alex to meet me and then tomorrow he can show me where I parked my own car. Tomorrow I'll use my Jeep Wagoneer to visit the ex and I'll exchange it for the BSO car in time for Monday morning and everybody will be confused by my brilliance except for all those who watched me play the BSO car shuffle from the cafeteria windows and laughed their asses off.

I have to agree with P_Nis and All That Glitters. It is my opinion that the guy showcased in the article, who is part of Al Lamberti’s command staff, seems to have a sense of entitlement to other people’s money, and it seems that it made no difference in the way that he treated a woman dying of cancer (who happened to be his generous wife). YUCK!

And -- a message to LOOSER: You seem to be new to this blog, and you may not understand how stories affect the pulpsters and other people who join in from time-to-time. Certain stories may seem to disparage, but, if you took the time to understand what had been written, you would know that there is certainly no intent in creating any harm. This particular story in no way diminishes the personal or professional life of Caryl Boies. Do you believe that the coverage of divorce while a dying wife was being treated for cancer disparaged the wife or her philandering husband, in the case of Newt Gingrich? Do you believe that the reputation of (the lawyer) Elizabeth Edwards was in any way whittled away by the stories told of her husband’s philandering, after she had been diagnosed and had been treated for cancer?

Because of the fact that Caryl Boies was accomplished and the daughter of a well-known lawyer who had put up the good fight for the presidential candidate Al Gore (in a well-publicized Florida brouhaha, against the George Bush campaign, in regards to vote tampering and election fraud), the Boies lifestyle had a spotlight shown. Public figures, like David Boies, know to expect this, and (like it or not) try to come to terms in an acceptance, of the invasion of privacy, by what may feel like a meddling media. Four years after the Bush v. Gore battle, another battle raged when vote tampering and fraud occurred in Ohio, in another Bush involvement. The vice-presidential candidate, John Edwards, realized that he was a public figure because of his participation with well-known figures. This did not prevent him from philandering, although at the end of the life of Elizabeth Edwards, it was shown from his actions that he was a caring individual. There were no divorce papers, and he definitely showed contrition. Maybe the future won’t look so harshly at what he had done to his wife (who had cancer). There is no way of measuring what will occur to the reputation of BSO Capt. Richard Reilly, who was married to Caryl Boies and filed for divorce when he knew that she was dying of cancer. People like you and his other friends at BSO will know if he had a relationship with his wife that was not one based on greed. If he really is a stand-up fellow, you have no need to worry about trivial conversation on a blog.

It is good that Bob Norman has taken the time to report on the circumstances of the life of Caryl Boies, may she rest in peace. Just like MSG & the cartel, I also believe that stories developed by Bob Norman (not only assist the dearly departed, but) assist those left behind. The Ynot investigation may not have been as thorough without the reporting of Bob Norman. And, the John Goodman investigation may have had some facts swept under the carpet if not for reporters like Bob Norman and others (on the Palm Beach Post & Jose Lambiet’s page2live) who would not let any of the details be covered up, because the accused was super-rich and powerful enough to buy his way out of serious charges.

As a matter of fact, it is possible that the pulpsters also have assisted in keeping a story alive, that could have helped unravel any yarn wrapped around some tall tales. While the homicides of Ynot and Scott Wilson may have had necessary coverage by reporters (to bring the story to light), there was a constant barrage by concerned citizens who became involved in discussions about the cases (on blogs) that kept these cases in the spotlight -- which probably made those working the cases perform in a way that could not be influenced by the money of those who needed a defensive press (such as the money paid for the services that Roy Black could extend to John Goodman, in preparing an alternative to the reason for the tragic demise of Scott Wilson).

Herbcaenentertainmentaward gave us insight into the workings of the Fontainebleau Hotel and made us think about the tragedy of the deaths of Bernice Novack and her son (Ben Novack, Jr., in Rye Brook, New York), even though other stories had besmirched the character of the family and diverted the attention from looking into the possibility of homicides. The stories altered the sight, in a focus on sexual titillation (of S & M sex games) and voodoo practices, to try to turn-off the public’s insistence that the deaths be investigated, rather than swept under the rug. Bernice Novack’s death had been investigated by the Fort Lauderdale Police Department and the Broward Medical Examiner’s Office, which agencies found nothing out of the ordinary in the location where Bernice Novack was found dead in a pool of blood, and they had concluded the death to be an accidental fall. The pulpsters kept clamoring that it appeared suspicious that the deceased had a cracked skull, broken fingers, and other defensive wounds that tended to show that Bernice Novack was the victim of foul play and had been beaten to death.

Under Florida law, anyone convicted of murder or arranging a murder isn’t entitled to any of the victim’s estate. (When the incident surrounding the death of Ben Novack, Jr., was reported) it occurred to the pulpsters that the death of Bernice Novack was not an accident, and we made it known that the story of “accidental death” was not going to fly. We were adamant that the death of Bernice Novack should have been classified as a murder. The incident report had revealed too many inconsistencies, with the Medical Examiner’s declarations that the death had been concluded to be from several bloody accidental falls, that repeatedly occurred throughout the house, until she fell one last time to die (suffering a broken jaw, broken teeth, and broken bones, along with many bruises and abrasions). Blood was seen “splattered” throughout her house and on her car in the garage. Her body was found in a utility room. It seemed that Joshua Perper was acting irrationally in his illogical thinking on the cause of death. Joshua Perper had concluded the death to be accidental, since (he declared) the blunt force trauma of her head injuries did not have any characteristic weapon imprints. He also said that he relied on the fact that there were no signs of footprints in the house, which “proof of absence of entry” reinforced his findings that the death occurred with only Bernice Novack present.

The feds had to take care of the proper investigation and filing of charges, when it was left to the feds to request the Westchester County, New York Medical Examiner’s Office to review the Bernice Novack death. (This office could be utilized because of the death of Ben Novack in the jurisdiction of that New York County, making it very apparent that the feds did not trust Broward County or the State of Florida to examine the case.) That New York office concluded the Florida death was a homicide. In addition, an unsigned letter (from a witness) arrived in the mail detailing how the mother and son (Bernice Novack and her son Ben) had been murdered, with more details of the deaths and a description that portrayed the murder of Bernice Novack. It is a good thing that the letter was sent to Miami Springs rather than Fort Lauderdale, as that letter would have probably been tossed in the trash can in any department in Broward County, since the letter did not agree with the findings that the death was accidental. Once confronted with all of this irrefutable proof, Joshua Perper had to revise his findings (for the first time in over 16-years), concluding that Bernice Novack had been bludgeoned to death on the day her bloody, beaten, broken body was found on April 6th, 2009.

The feds followed through with domestic violence charges and stalking, filed against Narcy Novack, her brother, and two male companions, after these criminals had been indicted in New York. (It’s better that a Grand Jury hears charges in New York, because in that State, they know how to indict, rather than Florida, where Grand Juries merely issue reports.) With a little shove from Rye Brook Police, the death of Ben Novack was also determined to be a homicide. But, the homicide would not be investigated as it had been told by Ben Novack’s wife, Narcy. Narcy Novack had reported the death to have been through an invasion of the hotel room by unknown perpetrators, who had bludgeoned Ben Novack to death. Law enforcement instead centered on Narcy Novack as the real culprit in the death (and centered on Narcy Novack for the death of Ben Novack’s mother Bernice, although jurisdiction could not be had). The feds indicted the whole lot of Narcy & her accomplices, claiming that Ben had been bludgeoned to death (3 months after his mother) on July 12th, 2009, at the instigation of Narcy Novack, who wanted to inherit the entirety of the estate that had belonged to Bernice and her son before their untimely deaths (by murder). Narcy’s histrionic personality may have worked well with law enforcement in Broward County, Florida, but it did not work as well in Westchester County, New York. The daughter of Narcy Novack has testified that the murder of her step-father, Ben Novack was so that her mother could cling to all of her husband’s assets, instead of losing any of the luxuries and benefits provided by her husband from a divorce that could have changed the right of inheritance. Testimony was that filing for divorce was imminent. Thus, the only way to keep the assets of the marital estate was through a Probate Court.

Reporting on the deaths of these individuals assisted in making known that which had been covered up. This is a good thing. While it is sad that the public is going to be told that the husband of Caryl Boies was a philanderer and was trying to force her to give up her moneys in a timely filed divorce, it is better that these things get aired out than covered up. If you were a true friend of the recently deceased, you would know this to be correct in this circumstance. After all, this is the county where the coroner, Joshua Perper, can rule deaths to be natural when all the evidence points otherwise. And, this is Broward County, where the Probate Division is run like a money making machine for those associates of the Chief Judge and appointees, raking in the dough when taking over the disbursement of assets of an estate. The Probate Division runs almost like the Bankruptcy Courts in South Florida (where an earlier case was able to wrest control of the Fontainebleau from Ben Novack, Sr.). Be grateful that it is not you that has to search out the answers to a loved one’s death and untangle the estate of a family member who had been dearly loved. Let Caryl Boies rest in peace -- yes. But, also allow her family to know peace.

David Boies was paid to try and steal an election. If you or anyone else wants to blame someone for Bush winning try the tri county Democratic parties who mismanaged and bungled the campaigns. Add in Theresa LePore (Democrat) and the befuddled seniors who couldn't figure out a ballot that 3rd graders could-they actually tested that PB Count ballot with kids and they understood it. Pulp-You are sooo correct. At the funeral this morning, Mr. Reilly and the family looked on the brink of atomic war with each other. It was obvious. Since Mr. Boies has a national reputation for being one very astute and talented attorney, perhaps he saw through Reilly some time ago. Many of us suspect that Caryl knew what a golddigger he has been. she deserved better and many of his colleagues witnessed his behavior for years. He basked in the wealth and bragged of his new status among the movers and shakers. But humble and well deserved roots always shine through in the end. Let's stay tuned!

Also not being a lawyer, I and others wonder if the husband's well known drinking escapades and infidelities will play a part in the final resolution. His primary affair has taken place weekly over the past seven years at 2770 NE 56 Court, Ft. Lauderdale in the Imperial Point home of his ex-wife, Maria Mercedes Delgado. The neighbors will tell you that his frequency at that house has been so extreme that they truly believe that he actually live there and that Maria and he are still married. His BSO issued SUV is seen there so often that even neighbor kids know who he is. He frequents local businesses close to that house, despite his "married home" being miles away in Rio Vista. Some say that the BSO can easily verify the GPS locations of his issued SUV anytime it is requested or subpoenaed. He dishonored that poor sick woman for years. It seems a shame that he will now profit from it.

How sad she passed away so young. The way I see it he was the one that filed for the divorce and should not be entitled to her assets or his Attorney's fee. Her father is a very powerful Attorney and should take up and continue to make sure his daughter's wishes are followed through. Her husband should be awarded the house they shared and nothing more.
