• Unless he pounded some shots and got in the car, the booze would be in his stomach and was just entering his blood stream, wouldn't that set the appropriate minimum window? What's the rate of absorption? Two hours is plenty of time to go from sober to drunk.

• Prosecution had no real case. Just a matter of displaced public outrage. Call it shared negligence that resulted in a tragedy. Same scene and facts (or non facts) with him dying and not her, and I would bet that the public outrage would be over a drunk, cell phone using, red light running barmaid killing a revered athlete. Sympathy seems to center on the dead ones.

• ATG: You would have to ask the criminal defense experts, but it sounds like since the Defendant has to merely "contribute" to the death of the victim, then the deceased's actions are legally irrelevant. It appears there is a logical flaw in the statute because in many accidents, the parties are comparatively negligent. Therefore, I think the legal standard for DUI and DUBAL Manslaughter should be if the Defendant's actions were the majority cause of the victm's death, meaning the Defendant should have to be found 51% liable for the accident before being convicted of causing someone's death. If this standard applied, then the deceased's actions, including her own drinking and driving, would be legally relevant. P.S. I also think her failure to wear a seatbelt should be a mitigating factor at the time of sentencing. (I don't know if that is the case.)

• The bottom line is the jury should be allowed to hear that the deceased was DUI herself, as well as texting at or during the time of impact. There have been studies that have showed that texting while driving is akin to drinking while driving. Combine texting with a 1.8% DUBAL, and at the very least, you have one very distracted driver. It was a tragedy and Leyritz is no angel, but if he can hold his liquor like the testimony seems to suggest, and did not run the red light, then the correct verdict was rendered.

Post-9/11 security is nothing more than a racket and the profiteers should be brought to trial under RICO charges. The big proponents of war and security profit greatly from those actions. On the issue of Airport Scanners: There are scientists that are convinced that the damage from the scanners is palpable and not as benign as we are being told. That issue is unresolved. We will find out in about 10 years when TSA employees who are in close proximity to the scanners on a regular basis start experiencing cancers. (Or not) Follow the Money on the scanners. Former Head of Homeland Security, Michael Chertoff has been peddling these scanners on National T.V. for a year+. The consolidated corporate media did a piss poor job of not asking him if he had a relationship with the manufacturers of the scanners. It turns out that Skeletor in fact is a paid consultant for an Israeli company that manufactures these scanners. It is all a bunch of bullshit because a professional could easily store an explosive device in his luggage without it being detected. I don't recognize this country any longer. The first sample showed a blood-alcohol level of .14, and the second, .13, police said. Florida's legal limit for motorists is .08. - On February 13, 2009, Leyritz was ordered back to jail as his bail was revoked following his apparent consumption of alcoholic beverages in violation with his bail conditions. So Leyritz was more than 1.5 times the legal limit three and a half hours after the accident. We can reasonably conclude that he consumed no additional alcoholic beverages after the accident so his blood alcohol level was constantly declining between the moment of the accident and the blood samples. Alcohol is metabolized at the rate of .015 of blood alcohol concentration (BAC) every hour. Working backwards, we can extrapolate that if Leyritz's BAC was .13 three and a half hours after the accident, it was at 0.1825 at the moment the accident occurred - more than twice the legal limit. The fact that he violated the terms of his probation by drinking suggests that he is an alcoholic. Non-alcoholics can go without drinking when the threat of jail time is hanging over their heads. Leyritz was wasted, got into an accident that caused a loss of life, and has been exonerated. You can say that he is not wealthy, but how many Sistrunk Blvd. residents can afford Bogenschutz? Strictly based on the facts, the jury probably made the right decision. I am glad that there there must be a very strong case against someone if they are to be incarcerated. But today was Jimmy's lucky day.

• Based on what I did learn about the case, I agree with the verdict 100%. Jimmy hit one of the biggest Homeruns in NY Yankee history in the 1996 World Series. The Yankees were trailing the Braxes 2-0 in the series, and were about to lose the 3rd game. With Brave's Ace Stopper Mark Wohlers on the mound, Leyritz hit a GRANDSLAM HR to save the game and the series as the Yanks came back to win that game and the series. Jimmy was always known as a clutch hitter, someone who rose to the occassion. That HR that Jimmy hit started the Yankee Dynasty of the 1990's. Hopefully, this latest HR can be the start of something good for Jimmy. I wish him well. BTW DF3: He's a good guy and not rich.

• It's a good verdict because him being a drunk rich asshole (although he's not rich) does not mean he caused or contributed to the crash. There is no credible testimony in court or out that Leyritz ran the light. At best it was going to turn red. She was going at least the speed limit with a .18 talking on the phone and texting at the time of the crash approaching a RED LIGHT. She was in the intersection at above 30 MPH
