Badge Numbers? FLPD Don't Need No Stinking Badge Numbers

Above is the video of the arrest of one Brennan Hamilton -- which shows once again that you can never underestimate the pettiness and downright stupidity of some members (not most, mind you) of the Fort Lauderdale Police Department. 

You'll see in the video that the 26-year-old Hamilton walks up calmly to a Fort Lauderdale police officer who is identified as Jeff Overcash.  When Hamilton asks for Overcash's name and badge number, the officer immediately puts the cuffs on him and arrests him.

Thanks to JAABlog, we have the back story from Hamilton's attorney, Brad Cohen:

"We have several witnesses for the incident prior to the arrest.  The facts are essentially the train was going past the intersection, on SW 2nd Avenue, Fort Lauderdale.  My client, Brennen Hamilton, was waiting with his wife and friends for the train to pass.  My client leaned up against the rear of the police car. 

Officer Overcash approached my client and took him by the arm and said 'Get your ass off the car. How would you like it if I leaned my ass on your car?'  My client remained silent and rolled his eyes. The Officer said 'Really tough guy, you have something to say to me?'  My client

remained silent.  Officer Overcash then said 'Yeah, that's right tough guy, you've got nothing to say.' The train passed and my client and his wife went to his car and called Fort Lauderdale Police, to complain about the treatment he just received.  There wasn't a Lt. or a Sgt. working at that time, so he left his number.  During the call he was asked for the Officer's name and badge number.  He did not know that information. 

After getting off the phone he went back to Officer Overcash and asked him if he could please give him his badge number and name. That is where the video is recorded. You can see my client approach calmly and request his badge and name.  Without hesitation Officer Overcash immediately puts my client in cuffs, and ultimately charges him with resisting without violence and disorderly intoxication.  My client was not intoxicated whatsoever.  He is a licensed recovery agent and possesses all of the proper State licenses. 

We called Internal Affairs today and left a message at 1pm, no call back as of yet.  I am preparing my notice of investigation pursuant to Florida Statute and calling SAO Case Filing tomorrow to discuss the charges... "

The video speaks for itself. Hamilton is obviously arrested because he had the audacity to ask for the officer's badge number. Overcash says he's arresting him for what he did "previously" and then says something to Hamilton's wife about trespassing on FEC (Florida East Coast Railway) property.
 
Unfortunately for Overcash, his explanation makes no sense. If Hamilton did something to warrant an arrest prior to the videotaped request for his badge number, Overcash should have arrested him then. He didn't. He was prompted to do it by Hamilton's question. The arrest is garbage and it will be thrown out.  
 
Just to be clear, I love good cops. I have good cops who are sources of mine. Hell, my grandfather was the sheriff of his town. That's one reason this kind of amateur-hour abuse gets under my skin.

BSO, FLPD, there are really good cops but sadly they cover up for the idiots. This guy should consider himself lucky someone had video going or he probably would have been beaten.

That same Officer order to tow my boat parked on a private property. They would not even bother release it according to status. The boat was on a trailer and they load the trailer on the ramp of a tow truck. They could have just tow the boat on its trailer and that would have been just another bill. They wrecked it instead. I guess it was more fun to watch the boat slide on the trailer while it was loaded (could have fall off the street).I try to sue the city but could not get a civil judgment for the damages. The internal could care less. They would not even see the basis for a complaint.

Same Officer conducting an arrest for leaning on a car... No Killing! It would have arrested the tow company or the usurpateur who signed the tow order I would say the officer was simply concerned about vehicles but I can say he really don't.

Just one more case of hotheadedness with a badge.yes we need cops, yes they have to deal with the scum of the earth.But not everyone is out to break the law or there balls for that matter.cops need to know the differrence, and stop waisting tax dollars and resources and time on there eagos.people need to respect the law and officers behaving badly and overstepping the law does not help them either it is lazzy and bullyish.Take a moment and listen ,you might learn something.

As for my career I've been on for 16 years and was on the road the first 5, with time in district SET, district CI, and regional investigations, with a short stint in training.

I haven't had a marked car for years.

As for this case it appears I'm right. After IA interviews Hamilton and other witnesses, they felt it imperative to relieve him of duty. Even FLPD members ripped him on LEO Affairs.

BTW I've read the PC it doesn't jive with the video, this guy will be lucky if he doesn't get charged.

FLPD suspends Overcash based on a complaint filed by Cohen's client. Overcash doesn't get to sit at home on this one. He is relieved of duty but must report to the PD to take adminstrative phone reports. He is not to interact with the public. Good idea. The city gets something for the pay Overcash will receive until his termination. There are serious rumors around FLPD that SAO or USA may file criminal charges against Overcash.

I personally know him. He's a responsible person.A business man, and not a trouble maker. He barely touched the police car, no dis-respect, and the officer in question went off on him, and grabbed his arm forcefully. He did not respond, but left, and called the police station to report the incident. He only returned to ask for the name and badge number of the abusive officer, which is his right, and at that point was arrested.

This was his 2nd wrongful arrest, for trying to report abuse in the department.

Stop it, you are at best a CSA. And if you had a star, not a badge it does have a number on it, it is on the back and it is there for accounting reasons. I just viewed this guys youtube page. He seems like a normal family guy. He has a video of his wife snd him skydiving, and of two little kids easter morning. He doesnt look like a trouble maker to me

I agree respect is important. But it is respect for the law not some personal affront that people should ultimately respect.

I liken it to burning a flag. That is completely vile and disrespectful to me personally but it is not unlawful. The same with leaning against the patrol car.

This punk wants to complain to the department because the officer put him in his place after he disrespected property that's not his.

We've all seen the bad things that cops get caught doing, but this is one video that is an example of the typical punk-kid that cops have to deal with daily.

There is video of the incident pre-arrest. It will not be released until the officer submits his sworn report. It will completely refute what he says. They are waiting to see what he and his "witness officers" swear to.

The Repo man has FLPD by the balls. This officer may very well be wearing handcuffs and depending on what his partners say, they me be too.

Not too mention to the police officer's dismay, I heard there are no less then 6 witnesses who all saw the "incident" prior to the guys arrest.

It would be hilarious if after the police officer hands in his report and another phone video surfaces of the prior "incident" showing something completely different then what his report says...Talk about a rock and a hardplace...tell the truth and look like an ineffective spiteful officer, lie and get fired.

If it was a real set-up they would have followed the guy thru the rest of this lawful and acceptable practice of LE and watch as they,

1. Tell him the $50 in his wallet wasn't there at booking so he can't post his own $25 bail,2. Tell him the $500 in his wallet, he needs for rent tomorrow, will be converted to a check that'll take 2 weeks to process, mail and cash,3. Tell him the $5000 in his wallet is being confiscated and forfeited as drug money,4. Tell him he picked up a Felony, somehow, so for his safety Officer Jolly will have to do an anal probe,5. Tell him that 15 years ago he forgot to dot an "i" on some legal form and he has an outstanding warrant and that means a No Bond Hold,6. Tell him that when he took that plea of convenience the last time Officer Over-react pounced, his VOP will keep him in jail for 'a little while' longer, and he may wind up in Prison,7. Keep his family in the dark about his situation and lie to them about when to expect his release for maximum asshole affect to everyone,8. Put him in the cell with the drunks and mental cases so he can learn prison justice about using the can in the can, (drop a rumor he's a kiddie molester if things get boring)9. Release him right before he gets to a real Judge who won't take this LEO-BS,10. Repeat.

The Florida statute defines disorderly intoxication as: �(1) No person in the state shall be intoxicated and endanger the safety of an additional person or property, and no person in the state shall be intoxicated or drink any alcoholic beverage in a public place or in or upon any public conveyance and cause a public disturbance. (2) Any person violating the provisions of this section shall be guilty of a misdemeanor of the second degree, punishable.� The punishment for a second degree misdemeanor is up to 60 days in jail and up to a $500 fine. If it is a first offense, a judge may decide to allow the offender to go through pre-trial diversion.

That is still not a crime, It is a civil matter you can sue him. There is no criminal intent to commit a crime. The crime would then be criminal mischief. (none of that is alleged).

Here are the crimes (city ordindances)that are alleged.

Sec. 16-71. - Disorderly conduct.(a)Offense. It shall be unlawful for any person to commit an act of disorderly conduct in the city. (b)Definitions. A person shall be guilty of disorderly conduct if his conduct shall directly tend to or does create or cause public danger, alarm, disorder, nuisance, or if his conduct directly tends to or does create public danger, alarm, disorder or nuisance and by such conduct he knowingly: (1)Creates a disturbance of the public order by an act of violence or by an act which directly tends to or does produce violence, or makes, aids, assists in making an improper noise, riot, disturbance, breach of the peace or diversion which directly tends to or does create a breach of the peace within the city; or collects with others in bodies or crowds for any purpose, in a manner which hinders, impedes or obstructs normal traffic along streets, sidewalks or other public ways, and annoys or disturbs other persons; or (2)Engages in fighting or in violent, threatening or tumultuous behavior, or aids, incites or abets any fight, quarrel or other disturbance in the city; or (3)Goes about begging or panhandling; or stands, loiters, or strolls about any place in the city, waiting or seeking to obtain money or other valuable thing from others, by trick or fraud, or aids or assists another in a violation of this section; or (4)Enters upon the property of another and for lewd or unlawful purpose deliberately looks into a dwelling on the property through any window or other opening in it; or (5)Addresses fighting words, threats or threatening gestures to any person, specifically including a police officer, speaks language which directly tends to or does create a substantial threat of provoking to immediate violence a person of ordinary sensibilities and temperament; or which directly tends to or does incite an immediate breach of the peace; or addresses fighting words, threats or threatening gestures to a person of ordinary sensibilities and temperament, which fighting words, threats or gestures tend to or do create a present danger of violence; or (6)Damages, befouls or disturbs public property or property of another so as to create a hazardous, unhealthy or physically offensive condition; or (7)Commits a trespass on private property or on public property; or(8)Hinders, molests or annoys persons passing along a street, sidewalk, crosswalk or other public way.

Sec. 16-96. - Obstructing justice.

It shall be unlawful for any person to knowingly obstruct justice. A person obstructs justice when, with intent to prohibit the apprehension or obstruct the prosecution or defense of any person, the person knowingly induces a witness having knowledge material to the subject at issue to leave the state or conceal himself.

I know the facts of this case well and none of these things occurred.

This is a bad case for the FLPD and Overcash. It is worse for Hamilton as he had to spend the night in jail for no reason.

Its almost like the police officers are their own gang in this town. There colors are always Black and they rule that downtown area with agression and force. Did you see the video of the kid in the elevator getting beaten up? Even if we are to believe he gave a lawful order of telling him to leave a public area for leaning on his cruiser, does that make it right to arrest because he came back to simply ask for a name and badge number?

Why didn't he just give him his name and badge number and be done with it? What was he afraid of? Did he feel he needed to make the arrest so that any complaint this citizen might file would be negated by an arrest? I.E. when someone gets the crap beat out of them by FLP and they get a Battery on a Police Offier Charge.

And are we to beleive that this man "set up" this cop...so that he can get arrested, harrassed, hire a criminal lawyer and spend all that money to get the case dismissed? I haven't heard anything about any type of lawsuit being filed so what would be the benefit?

The city should be ashamed of itself if this charge gets to see the light of day. With all the corruption going on in this city to waste tax payer money on this is a sin.

you are wrong. If a person is intoxicated and leans on the cops car (or your car) he is definitely endagering the property in which you or the police own.

This endagerment is absolutely against the law.

Put it this way, are you fine paying the $500 insurance deductible when some guy leans up against your car and scratches it with his keys, belt, or wallet chain. All cool with you when some 300 pound drunk guy puts a dent in your car?
