OK, sources say Debra Villegas has another day of relative freedom today. Still expected this week.

In lieu of action in the case, I'm going to throw out some tidbits.

UPDATED: Sentinel reporting that bankruptcy lawyers filed a clawback suit on Kim Rothstein seeking $1.1 million back from her, including charges on her Amex card, her RRA salary, and the political contribution money they say was reimbursed by Rothstein. They also say there's a whole lot more in jewelry too. Among the goods: "jewelry, clothing, shoes, handbags, leather goods, plastic surgery treatments, eyewear, electronics, local hotel room and spa charges, household furnishings, home gym equipment, vacations and personal travel, athletic club charges, groceries, charitable contributions, personal meals, general household and other items." 

Questions abound, like how much does Botox cost? And just what kind of "leather goods" wound up in the Rothstein home? And since when did "groceries" become a clawback item?

The Berger Singerman lawyers are not to be trifled with. They are basically saying she owes everything she spent during the marriage. I still think a quarter million in shopping charges at stores over four years is pretty tame for the wife of Rothstein. I would have expected at least a couple of hundred grand a year. 

Kim, here's the plan. Hand over the wedding ring first. Then any other jewelry you may have stashed away. That should help get them off your back, because what they really want is the treasure.   

-- In regard to Villegas, I'm told she was at Scott Rothstein's beck and call all hours of the day and night. When Rothstein struck a deal for an investment in one of his bogus settlement deals, speed was of the essence. He would call Villegas and have her draw up the papers for the deal. While her complicity in the Ponzi hasn't been spelled out, more will be known when the government formally charges her (soon).

-- I'm told that Rothstein may have had a bit of a closer relationship with California Gov. Arnold Schwarzenegger than previously believed. We know that Schwarzenegger was a guest at Rothstein's home for a fundraiser, but a source tells me that the two men and their wives also went on at least one skiing trip together. Another source says that Schwartzenegger invited Scott and Kim on the trip, that Rothstein

accepted, and then, in true Rothstein fashion, canceled at the last second, showing up the action star/politico. Schwarzenegger seems to favor Sun Valley, Idaho. Here's a fawning piece about the guvernator's skiing prowess, in case you're interested.

-- I've also confirmed 100 percent that, in addition to an untold amount of cash, Rothstein took something else of value with him to Morocco: his multimillion-dollar watch collection. He returned to the States with the watches, but the same apparently can't be said for some of that cash. Maybe he needed the watches to keep track of all the different time zones, huh?

-- There's been a lot of speculation about the role of Grant Smith, the attorney whom Rothstein almost cruelly made a managing partner just before the law firm imploded. Smith was Rothstein's legislative director, so there's been speculation that he may have been involved in suspected contribution reimbursements to the firm's lawyers. Not so, sources say. I'm told by sources inside the firm that Smith actually went out of his way at times to remind Rothstein that reimbursing contributions was illegal. Another thing about Smith: He never pops up in any infamous Bova stories. To his credit, Smith, a family man, seems to have completely avoided the seamier side of Rothsteinland.

-- Sources also say that Rothstein had a fairly close association with U.S. Sen. George LeMieux. The two met on several occasions, usually to talk about political races and strategy, often with the idea of using Rothstein's incredible financial power to help favored candidates. Is there anything more to it than that? We'll see, but just the thought of the milquetoast LeMieux and the flamboyant Rothstein pow-wowing is enough to make me laugh.

I would like to speak with you about the widespread corruption among the Judge's, Attorney's and Guardian's in the Probate Courts here in Florida. Where competent elderly people are being ruled incompetent so the attorney's and guardian's can go in and steal all their money. After the money is gone they are put on medication that kills them, Seroquel is one of the main medications. The doctors working along with the guardian's know that these medications will kill them, but because the children are always over 25 we cannot sue for medical malpractice. This is widespread corruption which is an epidemic in Florida, Please call me at 305-338-6160

There are individuals who have been dragged before a so-called mental health court that has been illegitimately set-up in the County Court, which acts the same way as a Probate Court under the Circuit Courts.

If you look further, you will probably uncover a massive amount of fraud revolving around very greedy people. Follow the money trail and you may be able to dismantle this system. Once the money disappears from the funding, those currently involved will no longer stay involved. In order to understand how the scheme has been run, what you would look for is the same type of acts involved in medicaid and medicare scams. The money trail needs to be choked out of existence. In other words, the money supporting this scheme must be removed and can be removed because the funding is not according to the law.

Seroquel, as well as other harmful substances and psychotropic medications, have been delivered like candy to those who have been forced into the system, through the action of court-appointed personnel that depend on their immoral & unethical acts to receive payments and other forms of recognition. These people, who are unwillingly or unwittingly forced into the system, stay in the system because they become scared through the colorable tactics used -- of fear, intimidation, harassment, and coercion, by officers of the court acting under color of law, color of authority, or color of office (who should be acting under their true positions of authority to prevent the misuse of the law and protect the courts and these individuals from the treatment being pursued). Examine how these wards were duped into committing themselves to a system of abuse under court directive. You just may be able to save someone or more than one. May G_D speed.

Kim Rothstein blew through nearly $900,000 on her American Express credit card since 2006, and received another $200,000 in salary and reimbursements for political contributions, according to a claw-back lawsuit filed against her Wednesday.

Bankruptcy attorneys dissecting her husband's massive Ponzi scheme want all that money back. They allege in the suit filed in Fort Lauderdale federal court that she owes the $1.1 million to creditors of her husband's defunct law firm.

But it could be many million dollars more, because the accountants working for the bankruptcy attorneys have not finished analyzing how much Scott Rothstein spent on his wife. She said in a recent bankruptcy deposition that he bought her so much jewelry she could not list every item.

"It is believed this additional sum is well into the millions of dollars, just on jewelry purchases alone, and not counting personal consumer goods," the suit against her says.

Kim Rothstein liked expensive shoes, Louis Vuitton handbags, Gucci accessories and evening dresses by Zola Keller, she said in the deposition. She could burn through thousands of dollars on a shopping outing, or drop nearly $5,000 buying platform shoes from a chic Los Angeles boutique online, she said.

She used the Am Ex card for "jewelry, clothing, shoes, handbags, leather goods, plastic surgery treatments, eyewear, electronics, local hotel room and spa charges, household furnishings, home gym equipment, vacations and personal travel, athletic club charges, groceries, charitable contributions, personal meals, general household and other items," according to the suit.

The lawsuit also seeks repayment of $153,000 in salary she was paid by the Rothstein Rosenfeldt Adler law firm and $104,000 in political contributions she made that were reimbursed by the law firm.

"The third set of payments the Trustee seeks to recover includes payments made by RRA to Mrs. Rothstein, some of which were classified in RRA's financial records as 'professional fees or fee/cost income,' even though Mrs. Rothstein provided essentially no meaningful services to RRA," the suit says.

"These payments were reflected by numerous checks written by RRA to Mrs. Rothstein over a 4-year period from the RRA payroll or operating accounts. During 2006, Mrs. Rothstein received $78,198.71 in 'professional fees or fee/cost income,' and she also received $75,000 on February 20, 2009. These payments provided no benefit to RRA and thus, RRA received no or less than reasonably equivalent value in exchange for these payments."

Kim Rothstein's civil attorney, Scott Saidel, could not be reached for comment Wednesday evening. Kim Rothstein might be able to offset some of what the bankruptcy attorneys allege she owes by turning over the luxury goods she purchased. Federal agents have already seized all her jewelry, she said in her Feb. 18 deposition.

As for the political contributions, the suit says she made large donations from her personal savings account and money was then wired into that account from law firm bank accounts to reimburse her.

"For example, on November 8, 2007, Mrs. Rothstein made a political contribution of $28,500 to the National Republican Senatorial Committee, and on November 13, 2007, a $30,000 wire transfer from an RRA operating account was credited to Mrs. Rothstein's personal account," the suit says.

"Similarly, on May 29, 2008, Mrs. Rothstein wrote a check for $70,000 to the John McCain presidential campaign and on May 30, 2008, a $74,223.99 wire transfer was sent from an RRA trust account to Mrs. Rothstein's personal account. These two political contribution reimbursements totaled $104,223.99."

Scott Rothstein, 47, pleaded guilty to five counts of racketeering, money laundering and fraud in January. He has been held in federal custody since his Dec. 1 arrest. He faces up to 100 years in prison at his May 6 sentencing.

I would have to say that of all the folks at RRA involved in this mess, Grant Smith is probably the least culpable, most innocent of them all. He's a really stand up guy. I've seen him do the right thing over and over even when there was pressure or opportunity to go the other way.

I truly hope none of this stuff falls on him.

In 1962, Dominick Rocco “Remo” Cersani, who served as a Caporegime in the New York based Colombo crime family, introduced Richard Eaton to James “Jimmy the Gent” [a/k/a “The Big Irishman” and “The Irish Guinea”] Burke in Fort Lauderdale, Florida. Although the three had done business together for years, Cersani would eventually turn informant on his pals when he was busted with a load of hijacked goods in New York. He turned on his friend, Jimmy the Gent Burke, who would find out about Cersani’s cooperation with local law enforcement from the corruption-riddled Queens County District Attorney’s Office. Once Burke was told of Cersani’s status as an informant by the criminal serving as the District Attorney, Burke had his mentor, Cersani, eradicated [in 1963, at the age of 70]. Cersani was garroted by a relative of the DeSimone family and then buried next to the bocce court of (the Burke/Eaton operated enterprise) Robert’s Lounge in South Ozone Park, Queens.

Jimmy Burke fathered four children. One daughter, Catherine, is married to Bonanno crime family member Anthony “Bruno” [a/k/a “Whack-Whack”] Indelicato. Burke’s two sons were named after two wild west outlaws, Jesse James and his brother Frank James. Jimmy Burke’s life of crime started when he was in his teens, at which time he was popped in 1949 for passing counterfeit checks, and by the 1950s he was distributing untaxed cigarettes and untaxed liquor and engaged in other illegal activity, including several murders for the Mafia. Jimmy Burke’s crew worked out of Queens and Brooklyn, where the corrupt Law Enforcement Officers would give him and his associates a pass and any enforcement help that money could buy. These dirty Police Officers took bribes that were offered to them to tell Jimmy Burke about any potential witnesses or informants. Burke would take the information given him by these Public Servants on-the-take, and dispose of these witnesses and informants in ways that he saw fit. He had no trouble in taking out the children, spouses, and other relatives of those he considered to be his enemies. Doing business under a protected status given by the corrupted Law Enforcement and the corrupt District Attorney, Burke ran a loan-sharking and book-making operation out of his saloon [Robert’s Lounge] and was awash with laundered money from his legitimate establishments, like Moo Moo Vedda, a dress factory.

An associate of Jimmy Burke’s and the Lucchese crime family in New York was Thomas “Two-Gun Tommy” [a/k/a “Tommy D”] DeSimone. His sister, Phyllis was Jimmy Burke’s mistress. His paternal grandfather [Rosario DeSimone] and paternal uncle [Frank DeSimone] had both operated at different times as boss of the Los Angeles crime family. Two of his brothers [Robert and Anthony] were associates of the Gambino crime family, and he was related to other mobsters named DeSimone [Franky, James, Joseph, Phil, and Ralph]. Thomas DeSimone had relations by marriage to Joseph “The Barber” Spione as his brother-in-law, to Gambino crime family associate Salvatore DeVita as his father-in-law, and to [an operative from Toms River, New Jersey] Silvio P. DeVito as his uncle-in-law. (It has been reported that one of the brothers of Thomas DeSimone, Anthony, had become an informant and had been murdered in the early 1980s for such an offense by Thomas Agro of the Gambino family.)

Jimmy Burke had taken on Thomas DeSimone, [DeSimone’s former cell-mate] Angelo Sepe, and Henry Hill as protégés, and they worked under Mafia Capo Paul “Paulie” Vario. At one time early in his life, Thomas DeSimone had shined shoes, and some had taken to calling DeSimone “Spit-Shine Tommy”, but not to his face, as his reputation had become notorious for his flash anger and ruthless killing style. Jimmy Burke used this to his advantage when arranging a get together with DeSimone and William “Billy Batts” DeVino, a made man who belonged to the Gambino crime family and worked alongside his friend, the up-and-comer-mobster John Gotti. Jimmy Burke had held down the various businesses of Billy Batts DeVino while DeVino had been incarcerated, and wanted to continue doing business without DeVino’s presence. So, one night after DeVino’s release from the pen, Burke held down Devino with a plastic mattress cover over his head while DeSimone worked him over, pistol whipped him, and stabbed him. Henry Hill would assist Burke and DeSimone in the disposal of DeVino’s body.

Angelo John “Angie” Sepe’s ancestors “Philipe Sepe” and “Josephine Marino” were both villagers from outside Marigliano, in the province of Naples, Campania Caserta, Italy. Sepe was married to the sister of Lucchese crime family associate Antonio “Tony” Rodriguez [a former member of the Latin Kings Puerto Rican Street Gang] (prior to Sepe’s involvement with Joanna Lombardo). In addition, Sepe was a nephew to both Colombo crime family Capo Ralph “Shorty” Spero and Thomas Spero, as well as a cousin to Colombo crime family member Thomas Spero. Sepe’s alignment with the Luchese crime family had come about through Thomas DeSimone bringing him to the attention of Jimmy Burke and Capo Paul Vario. When Sammy “The Bull” Gravano executed Sepe’s surrogate father, Capo Ralph Spero [a Mustache Pete], in 1980, for becoming an informant with the FBI, Sepe severed all ties to the Colombo crime family. However, killing was never an unacceptable act to Sepe, as he had been a hit-man for quite some time, and he and Thomas DeSimone performed contract killings together, including during their stints at the Leavenworth Federal Penitentiary. One of the victims was Lawrence Gennino, a Soldier affiliated with the Patriarca crime family from Boston. Although Capo Paul Vario and Capo Johnny Dio had said that Gennino would be taken care of after leaving Leavenworth, DeSimone and Sepe proved that their loyalty lied with themselves, as neither one would wait until the time set and they both disobeyed the rules established (by the two Capos) when they murdered Gennino.

Richard “Richie” [a/k/a “Dick”] Eaton was an associate of the Lucchese crime family, and General Manager of Jimmy Burke’s Moo Moo Vedda’s dress factory, a legitimate business that was viewed as a money laundering enterprise. Eaton also held ownership [with Jimmy Burke] in Robert’s Lounge, a saloon where the wiseguys met and Jimmy Burke had buried several bodies (that were removed by Burke when he was told by his paid Police Operatives about a search warrant for the establishment). Eaton attended Notre Dame where he earned a Business Degree and learned to speak both Spanish and English fluently. At the time of his death, Richard had just returned from a trip to Fort Lauderdale, Florida where he was suspected to have laundered huge amounts of money.

Thomas “Tom” Monteleone had dual citizenship with the United States and Canada, although he mainly resided in Fort Lauderdale, Florida. Monteleone was involved with Paul Vario and Jimmy Burke in drug trafficking and money laundering. Monteleone was a known associate of con-man Richard Eaton. Sometime in 1978 or 1979, Thomas had purchased a restaurant called “The Player’s Club” (now The Player’s Club Bar & Restaurant) located at 13410 Southshore Boulevard in Wellington, Florida which was strategically located at the Palm Beach Polo Stadium. The restaurant was transformed into a La Cosa Nostra hangout for vacationing Soldiers affiliated with the Lucchese and Gambino crime families. Monteleone had fled to a safe place in Toronto, Ontario, Canada after the bound and gagged frozen body of his murdered business associate in their money laundering enterprise (more specifically the Lufthansa stash), Richard Eaton, was found in Brooklyn on February 18th, 1979. The FBI holds a suspicion that Richard Eaton as well as Thomas Monteleone were murdered because of some sort of conspiracy in regards to the Lufthansa heist loot from New York and the scheme operating out of Fort Lauderdale, Florida in washing the loot.

In December of 1978, the largest robbery in the United States occurred when tens of millions of untraceable cash (although it has been reported as a lesser amount, being described as around six to eight million dollars, but still considered the biggest heist of that time) and an undetermined amount of jewelry went missing during a robbery in building 261 at the Lufthansa Cargo Terminal at John F. Kennedy Airport. Those involved in this planned robbery included members of Jimmy Burke’s crew who were working on insider information provided by a Lufthansa Cargo Supervisor who owed a huge gambling debt to a Burke controlled bookmaker, Marcin-Martin “Marty” Krugman. Since the crime would be on property controlled by the Gambino crime family, Burke had to get permission, through his contact, Capo John Gotti. A deal was made that Paolo LiCastri, a Gambino Soldier who was a made man (who had become a Man of Honor in the Palermo Mafia under Enzo Napoli and Carmine Galante), would go along as the “sixth gunman” in order to protect the Gambino interests, which would include a payout of a portion of the robbery after-the-fact. (Capo Paul Vario was also guaranteed a share, which was later to be reported as two million dollars from the cash amount that was admitted to by Jimmy Burke [although the security notes and the jewelry amount seems never to have been accounted or disbursed].) Burke’s son, Frank, assisted in the plot by operating as the driver of a crash car if a need developed to divert a possible police chase. After the heist had gone down and Burke and his son retired to a safe house with the plunder, Burke counted up the cash [without anyone else around]. From this action, one can imagine that he had decided to underreport the size of the stash and keep most of the money, jewels, and securities to himself.

It appears that greed got the better of him, and Jimmy Burke decided not to be truthful in the accounting and chose to not pay his crew even an appropriate share of the reported six million of the cash money from the Lufthansa heist. So he acted as a hit-man himself or ordered another to assist in his murderous gluttony to rid himself of those who held knowledge of the heist. Stacks Edwards, who was supposed to put stolen license plates on the van used in the robbery and drive it to an auto junk yard in New Jersey where it would be compacted to scrap metal, did not do his job properly as he drove the van to his girlfriend’s house and parked it in a “No Parking Zone” where the police had impounded it -- thus, he was shot to death [within a week of the robbery] on December 18th, 1978. Martin Krugman, the bookmaker who had provided information to Henry Hill and Jimmy Burke about the Lufthansa stash, vanished on January 6th, 1979. Richard Eaton’s body was discovered on January 17th, 1979 [three days after the disappearance of Thomas DeSimone]. Theresa Ferrara [a former mistress of both Thomas DeSimone and Paul Vario] was murdered and dismembered February 10th, 1979, because Jimmy Burke found out from his helpful bribed Law Enforcement buddies and a leak from the Office of the District Attorney that she had met with the FBI, and Burke and his crew considered her an informant from the act taken in voluntarily going in to speak with the Feds, although she had not been cooperative. Tom Monteleone, who had involvement through acceptance of cash from the heist for a major drug deal of cocaine, was found dead in Connecticut in March of 1979. The murdered [gunmen] accomplices in the Lufthansa heist included Louis “The Whale” Cafora [and his newly-wed wife] who have not been seen since March of 1979. Two of the other gunmen in the Lufthansa robbery, Robert “Frenchy” McMahon, and Joseph “Joe Buddha” Manriquez-Manri, were silenced when they were shot to death in Brooklyn on May 16th, 1979. Paolo LiCastri was found shot to death, his half-naked body smoldering in a garbage-strewn lot in Brooklyn on June 13th, 1979.

The only gunmen and accomplices that survived Burke’s murderous rampage following the Lufthansa Heist were Burke’s son, Frank James Burke, Tony Rodriguez, Angelo Sepe, Henry Hill, and Thomas DeSimone. However, it appears that Thomas DeSimone may have been one of the first persons to be eradicated [albeit after he eradicated Stacks], but not for the Lufthansa heist. Stacks Edwards [the person responsible for getting rid of the van used in the Lufthansa heist] had been taken out by Thomas DeSimone because he thought that he would become a made man through this killing. However, DeSimone had been set up by the Gambino crime family, in that the time had come for DeSimone to be assassinated as a reprisal for the murders of two of John Gotti’s closest associates, Foxy Jerothe and Billy Batts. The arrangement for DeSimone’s murder was made by Mafia Caporegime Paul Vario, who had approached the Gambino crime family and told them about DeSimone’s violation of protocol, in that he had not first sought out permission from the family before killing a made man. So, sometime around the Christmas/New Year holiday of 1978/1979, Peter Vario and Bruno Facciolo took out DeSimone, with John Gotti present.

In 1972, Jimmy Burke and Henry Hill had been arrested in Tampa, Florida for extortion after roughing up Gaspar Ciaccio over a very large gambling debt, as a favor for union boss Casey Rosado. Burke did six years in federal lock-up before he was paroled back to his life of crime. Henry Hill’s sentence was similar to that of Burke’s. Henry Hill became leery of Burke’s intentions as time went by, and he became an informant in 1980, partly to avoid being hit [after the Lufthansa heist wherein the majority of those involved had been murdered or disappeared]. Also, he had found out that the Lufthansa Cargo Supervisor who had been prosecuted for the Lufthansa heist and had received a fifteen year prison sentence, was ratting out everyone that had been involved.

Henry Hill entered the Witness Protection Program and testified against Jimmy Burke. Though Burke was suspected of committing over 50 murders he was only convicted of one: the murder in Brooklyn, New York of Fort Lauderdale, Florida resident Richard Eaton. Burke was convicted on February 19th, 1985 and given a life sentence. In one of the last stories concerning Jimmy “The Gent” Burke, in his final moments before leaving New York to go to Wende Correctional Facility in Alden, New York, the pompous, narcissistic, greedy, killing-sociopath Burke is depicted as turning to a law enforcement officer, while looking down at the JFK airport, and stating “One day.... That was all mine”.

I am having touble believing you are a lawyer based upon the first question you asked. Google the word RESTITUTION and read up on the concept. I am not trying to be a jerk, but as a lawyer you should know this stuff or at least be able to find the answer yourself.

The feds take a big bite as income tax needing to be paid on the ill gotten gain income, leaving much less money available for the ponzi fuckees. That's why the feds filed the tax liens.

But I guess its fair enough--the feds gotta pay for their investigation, their prosecution, and feed cloth and medicate SR for the next 20+ years.

Lesson to be learned, if you rob a bank, claim the proceeds on your 1040 and pay taxes--otherwise you are subject to late payment interest and penalties.

They made Marajuana illegal.

When you have too many hands in the pot so to say it collapses the money of the country they are operating out of.

1/2 of every drug deal is counterfeit money that gets washed into real currency.

What do you think that does to the infrastructure of out country?

Not only do you have the old crime families still at it, you have the Russian mob which is more viscious and has our own Government
helpless to control them.

I was the one who said back in Oct that they would begin to cover their tracks and that DV life was probably in danger as well as the rest.

Our Government itself has employed the help of the mob in times of War.

Threatening me with death threats in an open forum leaves Anon poster and Jad poster from yesterdays blog article about Judge Hurley and mental health guardianships and abusing them is not a wise thing to do.

Once the FBI and Justice Dept enter into a criminal investigation certain Patriot Act rules kick in.

Singling me out of all the posters is just raising another red flag to this group in which the situation has been if not staged and watched.

My question does not concern mobsters but only the political mess that has occured because of SR giving all the Republicans tainted money?

What does that do to Floridas political climate right now? Did SR and RRA reposition Democrats or Republicans majority here?

I admit bankruptcy/criminal/collections are not my forte but I have pretty good instincts. The Federal and State forfeiture laws were designed to confiscate the proceeds of crime. such as when drug dealers buy houses and cars. The money came from people that were involved in illegal activity and then went to criminals. the criminals then invested that money in cars, houses or businesses. It is the fruit of the crime.

I say this is different because the money did not come from a criminal activity it came from alledgedly innocent investors. Scott was the one involved with the crime not the investors. So that money is clean when he got it. this is different than the regular forfeiture situation. So why should the government have priority of a claim over that money than the people who actually lost that money.

I thought about that tax angle issue. but again the money that I think the feds seized should not have priority over the peoples money. Secondly they say that the Rothsteins owe 10 million well how much did the feds get already. becasue it seems like the feds took more than that, even assuming the tax lein would have priority over the investors.
