UPDATED: Florida Bar Prez' Sister-in-Law Got Big Bucks From Rothstein

So Florida Bar President Jesse Diner says in the Daily Business Review (thanks, Christy) that the Bar "can be preemptive" when it comes to investigating lawyers but is "not in the position of just going out willy-nilly and auditing people."

I bet not, especially since Diner's sister-in-law was getting tens of thousands in campaign contributions from Rothstein and his law firm.

You see, Diner's wife is lawyer Adele Stone, and Adele Stone is the sister of state Rep. Ellyn Bogdanoff, a Republican running for the Senate. Bogdanoff has been the recipient of big money from Scott Rothstein, who considered her a close friend. He was probably her biggest monetary supporter through the years.

In June, Rothstein held a fundraiser at his Isla Bahia home for Bogdanoff that raised her something on the order of $15,000. Over the years, Bogdanoff has received tens of thousands from Rothstein and the RRA firm. Bogdanoff, by the way, has worked at Diner's firm, Atkinson Diner Stone Mankuta & Ploucha (and yes, the "Stone" would be Adele).  

Diner says he didn't attend that fundraiser but says he did attend Bogdanoff's victory party last November at Bova Prime. He said that he didn't, however, speak with Rothstein that night and that he's met Rothstein only twice in

his life. One of those times was at a recent fundraiser for Jeff Atwater held at the since defunct Jackson's Steakhouse. He says he didn't contribute.

"Someone introduced me, and we talked," he said. "A lot of people contribute money to my sister-in-law and I don't know them... The Florida Bar will investigate everything related to this case."   

You can click here to see a photo of Diner being sworn in with Stone in the background. In his acceptance speech, he thanked Bogdanoff personally, along with Sen. Ken Pruitt and, yes, Gov. Charlie Crist himself for their great work. I gagged a little upon reading that.

Nothing against Diner personally -- he seems like just another cog in the machine -- but I do despise the Florida Bar (where, of course, Rothstein himself sat, in the height of absurdity, on the grievance committee).

Broward is truly the biggest small town in America.

-- A birdie told me that the FBI paid a visit to the Broward Sheriff's Office today, requesting information on the Santucci incident and Lt. David Benjamin. What's that I hear? Is that a... train. Clickety clack (where are you, Karnack?)?

-- One of you asked about the West Boca Chamber of Commerce breakfast featuring new FBI chief John V. Gilles. I called political consultant and radio man Barry Epstein to see how that went, and he said Gilles did a fine job. The problem is he can't talk about ongoing investigations, so there was little to no dope on the Rothstein investigation. Epstein said he asked, "Are you going to go after the people who wrote checks to these political candidates knowing it was illegal to do so and getting reimbursed in the form of a bonus?"

He said Gilles answered: "No, I'm going to go after the bosses who told them to write the check." 

But the presentation actually made Reuters, which highlighted the fact that Gilles said that corruption was threating the "fabric" of America. No shit. Here's the story.

Levinson Jewelers and owner Mark Levinson are being targeted for deposition in the case against Rothstein Rosenfeldt Adler, the defunct law firm that allegedly was a front for Scott Rothstein’s Ponzi scheme.

Bankruptcy trustee Herbert Stettin wants to depose a corporate representative of the jewelry company as he tries to figure out how the money flowed in and out of RRA. The deposition is set for Dec. 21 at the Berger Singerman law firm.

In his notice to the court on Tuesday, Stettin seeks invoices reflecting jewelry purchased by Rothstein, his wife, Kim Rothstein, the law firm and any other RRA company.

Levinson has not returned phone calls regarding Rothstein since the first week the scandal broke, in early November. He previously told the Business Journal that he was withholding judgment on Rothstein until he heard more information – but that was before Rothstein was charged with racketeering and money laundering in running an alleged $1.2 billion Ponzi scheme.

Besides records of jewelry purchases from Kim and Scott Rothstein, Settin’s motion seeks:

All general ledger account entries that list debits and credits for jewelry purchased by the Rothsteins or RRA entities.

All agreements of any nature between Levinson Jewelers and the Rothsteins or RRA entities.

All e-mails, written memorandum or correspondence exchanged between Levinson Jewelers and Rothstein.

All titles to boats owned by Levinson Jewelers, Mark or Robin Levinson, or a business entity owned by them directly or indirectly.

All checks payable by Levinson Jewelers, Mark or Robin Levinson, or any business entity owned by them directly or indirectly paid to Rothstein or his companies.

They can't go skiing. They can ask for a different date. They can also try and quash, protect, eliminate, say the information is overly burdensome, etc.

Yes from SoCal. No agenda, no other perspective. Intimate observations only through reading here. Sorry if there is too much passion (maybe from the coffee). I got this way with OJ too. I can't stand when people get away with murder as they say.

I have been following the story through BN and friends that live there in FLL. My friends have had several dealings with many of these attorneys and judges (mentioned on this blog) in the past. For years they would tell me stories of the mob, corrupt judges and attorneys on the take etc. I never believed them. BTW, they are not attorneys. Now I believe. They wrote to the bar, they called, they complained.Nothing. Now I know why. I am familiar with FLL. Lived there once for a bit. My friends have been there all their lives and they have connections to attorney types there. I met Adler once. (Maybe I can make the Cheese list?)That is it. Plain and simple. It is sunny and cold here today--snow on the mountains..:) Injustice bugs me too.

Melissa did not miss a trick in terms of her demonstrated legal skills and education pedigree. The fact Melissa was not sporting vulgar displays of wealth like Rothstein and fatso-Rosenfeldt demonstrates she had no part in the scam, but she likely had knowledge of it.

You are right. They are following the same plan we all said many posts ago; just slow and methodical. They know what to do and this story is gaining in popularity all over the US.

Not only is this good Blog stuff; but I hope it helps Broward.

I read all about Levinson - all the posts and background research.

This will reach critical mass faster than I thought with discovery filling in the gaps, money laundering, exposing lies and cover-ups, providing pointers, showing where politicians are more involved than thought now, show tax issues, kickbacks, and revealing the inter-connecting linkages between all actors. Much finger-pointing.

The post above says they need an army. This is a real mess and needs to be carefully co-ordinated in chunks, a step at a time. Plus by the time 1/6 rolls around you will have a plea from SR that will even add more fuel to this.

Time for much Xanax.

I'm a TX lawyer--havent been in Broward county since 1993. (Most states have similar IOTA systems). So I had NO IDEA about the sister-in-law , $15k fundraiser @ Scotts house. I called BS just based upon the IOTA stuff. I'm gonna call Double BS now.

If I were representing a Scott creditor I would notice the Florida State Bar to notify their E & O Coverage. Diner, you and the florida state bar smell really really bad.

Till now, I thought Scott's ponzi was a garden variety mega-mil ponzi, but I have finally come to believe that many of the local Broward poster's are right--this Ponzi has an unbelievable amount of corrupt side trails.

We havent had corruption like this in TX since the 70's. Miss it. Its great entertainment. Broward County, enjoy.

I don't see how they can police themselves let alone prosecute one of their own.
Sadly this state ranks at the top in respects to public corruption.
Personally I hope the feds indict hundreds of these characters and maybe that will be the start of a house cleaning.

Quick depositions are key - in all matters.

Lawyers should do depositons quickly an early - most don;t. They like to run up the clock.

I called bar once regarding a contingency matter where lawyer after two years did zero discovery. Bar not only told me tough luck, lawyer found out i called. Needless to say, a mess ensued.

Can't give these types time. The BR case depos can be carried over to other matters. Make them all come up with their stories now.

Lying to BR court or in a federal deposition carries stiff sentence. I wouldn't want to be caught with my pants down for these.

I grew up in S. Fla. I already knew of the legendary level of political corruption - in fact, I was involved in politics for quite a while, especially in Boca Raton and N. Broward. I saw how various lawyers and businessmen manipulated the system by controlling large blocks of retiree votes. I saw how gov't officials, from the lowliest commissioner to U.S. Senators, would kiss these guys' rings. I watched government officials supplicate themselves before these guys who could deliver votes and money. It was fascinating and disgusting all at the same time.

AND YET, I still can't believe the level of corruption and graft the SR ponzi is exposing, and we are just at the tip of the iceberg. It looks like it will ensnare a number of prominent lawyers, a number of higher-ups at BSO, people at all levels of government (including possibly the governor), etc., etc. We have a ponzi scheme, the Jewish Mafia, a murder, and $5,000 Tom James suits. It's truly amazing.

BOCA RATON, Fla. -- Dean Lavallee's restaurant might look like it's in disarray. But at Park Avenue BBQ's newest location on Glades Road, this is organized chaos.

"We completely replaced the cook line wall," Lavallee said on a tour of the kitchen.

The actual chaos is behind the scenes where Lavallee just learned his landlord is Scott Rothstein.

"It was quite a surprise. We saw the Rothstein thing in the paper," said Lavallee.

Rothstein is now a disbarred lawyer in federal detention awaiting trial on charges stemming from $1 billion Ponzi scheme.

Lavallee, not an investor, never dreamed he'd be involved. "Not in a million years. When we went down to the first meeting to negotiate the lease, we were impressed by the opulence of the office," said Lavallee.

It's not an option to walk away. He said he invested some $200,000 in the build-out and that the lease says Rothstein was to kick in a $100,000 more. "The landlord is not easily accessible," laughed Lavallee.

Rothstein's Fort Lauderdale attorney, Marc Nurick, said, "There's nothing to comment on. This is just one of the many properties that Mr. Rothstein has turned over his interests consensually to the government."

Although this property is on a list to be seized by the federal government, Lavallee is going ahead with the opening, planning to serve his piping hot BBQ in just two weeks.

"We hold a signed lease and we're hoping to work with the FBI to keep it a valid lease," said Lavallee.

People who were denied due process in our Florida State Court system must request the Federal Courts to immediately step-in so as to supervise The Florida Bar's activities in all respects. As you recall, such was effectively accomplished when the fed courts stepped-in to supervise individual states' school busing mechanisms.

Is it just me or does it seem obvious someone was laundering money through Levinsons. The big red flags are:

1. The diamond business is notoriously easy to launder money though (they hold their value well and are easy to secretly transport)

2. There is never anyone in that shop. Drive by and you'll see.

3. Finally, from the Captain Obvious files, Rothstein registered a boat in their name? Why? Perhaps it was an in-kind trade on paper - a boat for diamonds, perhaps - when in reality it was just an artifice to move money around.

One thing I've noticed about potential money launderers, scammers, and swindlers over the years (and I see a lot of them in my practice) -- their schemes do not tend to be complicated, and they are bad at covering their tracks. They do stupid things. They don't tend to be the smartest guys on the block. What they do have is the innate ability to be convincing - some people have it and some don't. Natural charisma is the hallmark of a good scam artist, not brains.

Oh yeah, and stop picking on the Bova girls. Party girls working at a fancy Ft. Laud. restaurant? What a novel concept . . . . I know a few girls who have worked there and they are nice people - they just like to drink and have fun. They weren't blowing guys in the back. Sadly, none of them have any good info to offer, other than to say it could be a tough place to work.

Lawyers self regulate just fine in most states, just like most other counties manage to govern themselves with a fraction of the corruption. It's the people, stupid. The crooked people you elect and the crooked people they naturally appoint from among the crooked people who trade favors with other crooked people for power. The FL Bar is giving lawyers (and other bar associations) a bad name, but the bars in other states do a great job, and include members of the public on inquiry panels and committees where they can see that the lawyers really do run a tight ship, and spread the word.

Pun intended, the bar is so low, and has been being lowered so consistently over time, that the everyday graft and favor trading, and conflicts of interest, etc., practically seem OK by comparison.

The stuff that folks here AREN'T fussing much about would get a lot of attention anywhere else. I know state's where Levine's appointment with Rothstein's vote would be investigated just because of his invisible resume, not to mention Levine's mere presence at a Broward Health meeting for Rothstein to pitch legal work behind the General Counsel's back. An entire state bar would be up in arms, given the number of extremely qualified attorneys deserving of consideration for judicial appointment, and their desire to ensure that the public have confidence that the best of the best rise to the judiciary.

Some on these blogs have called for a citizen revolt. Well, it is the citizenry who have watched as ethical standards sunk to nonexistent. Voters pretty much get what they deserve, on average. Demand more, and maybe someone will emerge as a champion of the cause.

Everything we learn re-Rothstein has all the elements needed to assert Rothstein's self-dealing caused due process vios to on the Florida state level.

One would think Tony Villegas defense team would allege The Florida Bar was biased when they refused to file a formal complaint when the prosecutor who had first worked on the Villegas case, Howard Scheinberg, went to work for Rosenfeldt Rothstein Adler.

Some of us (me included) can allege due process vios occurred in Broward regarding treatment to our own clients while Rothstein sat on the Grievance and Judicial Education Committees.

I would welcome Federal supervision of the Florida Bar by the Norther/Middle/Southern Districts.

Well they will finally catch some of these crooks. Some of them will skate.

If you really look hard at a lot of the players in this case you have crooks that go back into the late 70's and early 80's and just never were caught. They got away with a whole bunch of stuff by buying and gaming the system and got judges, lawyers and politicians to go along for the ride.

Now the entire system is corrupt and broken; both at county and state levels. Unless they tear the whole thing apart and start from the bottom we are never going to be out of this shit.

If you went back to the beginings of a lot of these players they didn't get their grub stakes in a legal way. Guaranteed thy got their start with some white stuff that was falling all over Florida in the late 70's and early 80's. They got out of it before the shit hit the fan and made their money in white collars instead of taking the chance of ending up in prison uniforms. Too bad that these jerks wern't put under a microscope decades ago.

Bar President Jesse Diner is an extremely bright and ethical lawyer. I couldn't have a finer attorney representing me in very complex matters. The Bar has been very aggressive working to investigate Rothstein andRRA and has been since the news broke Halloween weekend.

Don't find him guilty by association. It's unfair, and I don't know any politician who refused Rothstein's campaign contributions - although it was so obvious he was doing something criminal.

As for the Levinsons - they will get their just desserts! The IRS is going to have a field day with Batman and Robin and their accountants. Anyone know who they are??

Remember, he was an 'independent verifier' and one of the top 20 investors in it. It's still unclear if he worked for Rothstein or George Levin, but either way, he is conspicuously absent from that list.

I said it at least a week ago and I'll say it again. Forget about the law. The Florida Bar has an enormous public relations nightmare because of this SR case. They have no choice but to demolish and destroy everything that is RRA.

That does not mean the innocent hardworking attorneys who were concentrating on practicing law and kept to themselves. (Yes, they are as stupid for not bailing out sooner, especially after Love Ya's manic emails. However, that alone does not constitute an ethical violation)

However, the remaining R and A are toast. Finito! Some of the other partners are on the bubble. It ain't gonna be pretty.

I want to know a lot more about Spinosa. So far, very little has been published.

In fact, it seems that there has been very little investigative journalism regarding many of the key players in this saga.

Levin is a good example. I don't see much in his background that suggests that he was capable of running a very large hedge fund. Perhaps that was never his intent. A lot of newspaper articles say that he has many Wall Street connections, but they don't elaborate. I want names of people and companies.

Off topic, are there any transcripts of Gillies speech today at the Boca Chamber of Commerce?

The "anonymous" poster you refer to uses methods typical of a self-regulating Florida Bar committee member. These guys are trained to intimidate and threaten anybody who they oppose. Why do you think Rothstein got so rich/powerful so fast? You can thank the Florida Bar's self-regulating attorney grievance mechanism.

Such is why I repeatedly suggest attorney regulation must be placed in the exclusive hands of the Florida Department of Professional Responsibility.

"I think the forgery was part of the scheme to give [Spinosa] some sort of plausible deniability,'' Scherer said.

Sounds like Scherer has it right to me. Who better to manufacture plausible deniability than a group of lawyers?

What this article doesn't say, is that Spinosa is reported to have had face to face meetings with a number of investors, in which he gave them false assurances.

A few years ago a deal went bad with a client of mine. I hired a VERY good attorney. Anyway, the client tried to hide some assets in a little place called Malta (just above Libya). I recall that Malta was a place for the rich and their "assets."

We ended up doing an out of court settlement so I never got to find out more about Malta. You know Malta is really not that far from Morocco...

Trying to dig a little on Michael Szafranski, Levin's supposed "independent verifier." In various recent articles, he is listed as a 31 year-old CPA, and alternately as a Certified Financial Advisor (sic - this designation does not exist). His "resume" includes a roster of investmen-bank-SOUNDING companies. OK, I am cynical, but I've seen so many of these fraudsters with inflated and/or flat-out falsified CV's who like to choose company names that are similar to legitimate organizations.

I recently looked into another unrelated but similarly foul group of scammers in Orlando that played this game. Lots of fancy sounding "corporate storefronts", homespun web pages, "board" seats on bogus or non-existent organizations, etc. The web creates a powerful marketing tool for scamsters looking to quickly build a "presence." This group got particularly creative in that they had written to foreign governments and lobbied successfully to become "Honorary Consul" for various countries, lending them some credibility in the eyes of naive investors. I couldn't believe how easily they did this - seriously - you just have to ask for it and if there is no cosulate in that city, you'll probably get it. It turns out these guys are outright theives. Pretty young too, like Szafranski. They're involved in multimillion dollar insurance scams relating to workers' compensation. So far no tie to RRA that I can figure.

Back to Michael Szafranski and Levin. It's so hard to believe that someone like Levin would rely on any information from a 31-year old nobody from nowhere, with no serious experience or credentials. Was this kid some sort of patsy for Levin and Preve (Levin's felonious CFO)?

Soooo slimy! This just reeks.

However, he may have gotten a sweetheart deal on a boat, he may have become a part owner of Levinsons (has been rumored) or he became a partner in another biz and saw that money come right back to him.

At any depo even in Bankr. court. I will get a cite for you. One off the top of my head was the Pillsbury case which I thought was an 11th Circuit case.

Yes only in the State civil case will a party be able to defualt by not answering the complaint.

Although, if their are any Advisory Proceedings in Bankr. court there too could be default judgments.

Also, a person that is deposed can certify the question.

It depends on the venue. In Chicago, such "Counsels" would likely enable you to dispose of several well-connected enemies for 5K. In/near Broward, 5k will maybe help you get a cop to help put a patch on your flat tire.

All that will happen is that the bad judge will get all the information from the federal FBI and pass on all information to escape more prosecution. This is the nature of the communist. It is no different here.

The same is with the state court when lawyers with greenberg trooring pretended they were lawyers for the state in citrus canker and the court let them get away with it. The state court is to be corrupt to do the same thing to my friend Julie when bill scherer pretended to work for fort Lauderdale city to let the judge throw her in jail because huuzenga said so. Nobody cared that bonds were being stolen.
The state court is corrupt…the federal court is corrupt. I became a citizen here so I can not get help from my birth country of Rumania. Before it was communist just like you. Now it is free but I am a citizen here where its not free.
Even when Rumania was communist it was not this bad because in Rumania you were told you were nothing and had no freedom…not like here where they don’t tell you.

Lauderdale Court House undercover dressed in sunglasses, trench coats and flashlights, hats...demand arrests and investigations shine a little light on the story (pun intended with flashlights), demand arrests, protest signs, citizens revolt, cyber vigilante group...whatever you want to call it. (I can see the news coverage being used in the movie so dress nicely for your 15 mins of fame). Those who want to meet each other can, those who want to observe and remain anonymous can.

There are so many angles, metaphors and symbolism with this approach. Meet each week at with a topic (candlelight vigil for Melissa at TV Jail, at BSO with a focus on Lamberti and Benjamin, Riverhouse for Boden)

We can call ourselves the Pulp Avengers or something clever...

"I asked him, 'Is this for real?' He said it was, that it's a legitimate deal, that everything was aboveboard," Sakowitz said.

Another group of investors met with Boden about the same time, and he gave them his law firm business card, said their attorney, Daniel Serber, of Aventura.

"David Boden was the contact person," Serber said. "He was the attorney who was in charge of negotiating the structured settlement documents."

After investors did not receive their scheduled payments from Rothstein the last week in October, Serber visited the law firm the Friday before Halloween. Rothstein already had left the country, and Boden met with Serber.

Boden told him that "it's business as usual" and that Rothstein had gone to London and "was working on getting some issues resolved so that the payments could be made."

Records show Boden had been living in a $1.9 million Las Olas Isles home owned by a Rothstein corporation in recent months.

They also said 90% of the time they (people asking questions) already have what they need or very close to it. The best response this morning was: "you can't delay the inevitable."

These blogs are telling signs that some of us had business, personal, or political dealings with SR and I am confident all the truth will emerge over time. Two of the biggest scandals to rock South Florida in recent years merged Monday when attorneys representing billionaire sex offender Jeffrey Epstein filed a lawsuit claiming the part-time Palm Beach resident is the victim of accused swindler Scott Rothstein.

Rothstein, who is accused of running a $1.2 billion Ponzi scheme from his Fort Lauderdale-based law firm, trumped up civil lawsuits against Epstein, according to the complaint filed in Palm Beach County Circuit Court. He then lured investors by telling them Epstein had agreed to settle the lawsuits for as much as $200 million and they could get a cut of the cash.

The problem for investors, according to the lawsuit filed by West Palm Beach attorney Robert Critton, is that Epstein never agreed to settle the lawsuits filed on behalf of women who are identified only by pseudonyms, such as Jane Doe.

``The offer of a $200 million settlement by Epstein was completely fabricated,'' Critton wrote. ``No such offer had ever been made.''

Epstein faces roughly two dozen lawsuits filed by women who claim they were teenagers when he lured them to his Palm Beach mansion and paid them for massages and sex. The lawsuits started rolling in after Epstein pleaded guilty in 2008 to felony solicitation of prostitution and procuring teenagers for prostitution. He was released from jail in July after serving 13 months of an 18-month sentence.

Attorneys who worked for Rothstein, including Bradley Edwards and former Palm Beach County Circuit Judge William Berger, filed three of the lawsuits. But, they said, those represent only a fraction of the young women whom Epstein molested.

``What the evidence is really going to show is that Mr. Epstein . . . has every single day of his life made an attempt to sexually abuse children,'' Edwards said at a July court hearing. ``We're not talking about five, we're not talking about 20, we're not talking about 100, we're not talking about 400. . . . We're talking about thousands of children.''

Such talk was part of a carefully orchestrated scheme to convince investors they stood to make millions by investing with Rothstein, Critton said.

Likewise, Critton said, Edwards has said he intends to depose various luminaries to testify against Epstein. Former President Bill Clinton, business mogul Donald Trump, former Sony Record president Tommy Mottola and magician David Copperfield have all been identified in court papers as people that will be deposed.

While friends or acquaintances of Epstein, they have no information about the women involved in the lawsuits, Critton said.

``The sole purpose in the scheduling of these depositions or listing high profile friends/acquaintances as potential witnesses was, again, to `pump' the cases to investors,'' Critton wrote.

Neither Edwards nor Berger responded to phone calls for comment.

Critton isn't the first to make allegations that Rothstein fabricated cases as a way to lure investors.

Fort Lauderdale attorney William Scherer, who has filed a $100 million lawsuit against Rothstein on behalf of scores of investors, has made similar claims. In a 147-page lawsuit, Scherer also said Rothstein told an investor about the phony $200 million settlement offer from Epstein.

``He would use . . . cases as bait for luring investors into fictional cases,'' Scherer was quoted as saying. ``All of the cases he allegedly structured were fictional. I don't believe there was a real one.''

Rothstein, a potent political fundraiser who turned a small, unknown law firm into a powerhouse in seven short years, has pleaded not guilty to charges of RICO conspiracy, money-laundering conspiracy, mail fraud and two counts of wire fraud. His kingdom collapsed in late October when federal agents raided his firm, Rothstein, Rosenfeldt and Adler.

Lawyers self regulate just fine in most states, just like most other counties manage to govern themselves with a fraction of the corruption. It's the people, stupid. The crooked people you elect and the crooked people they naturally appoint from among the crooked people who trade favors with other crooked people for power. The FL Bar is giving lawyers (and other bar associations) a bad name, but the bars in other states do a great job, and include members of the public on inquiry panels and committees where they can see that the lawyers really do run a tight ship, and spread the word.

Pun intended, the bar is so low, and has been being lowered so consistently over time, that the everyday graft and favor trading, and conflicts of interest, etc., practically seem OK by comparison.

The stuff that folks here AREN'T fussing much about would get a lot of attention anywhere else. I know state's where Levine's appointment with Rothstein's vote would be investigated just because of his invisible resume, not to mention Levine's mere presence at a Broward Health meeting for Rothstein to pitch legal work behind the General Counsel's back. An entire state bar would be up in arms, given the number of extremely qualified attorneys deserving of consideration for judicial appointment, and their desire to ensure that the public have confidence that the best of the best rise to the judiciary.

Some on these blogs have called for a citizen revolt. Well, it is the citizenry who have watched as ethical standards sunk to nonexistent. Voters pretty much get what they deserve, on average. Demand more, and maybe someone will emerge as a champion of the cause.

To the medication question:

During the course of a pre-test polygraph interview, the examinee is asked medical, as well as, biographical questions. One of the medical questions pertains to any type of medications the examinee has taken that morning or has been taking. With the new computerized polygraph instrument comes the Physician's Desk Reference (PDR) software. This software is used to determine whether the medication taken will affect the exam. Therefore, a polygraph exam can in fact be given if the medication(s) taken do not affect the exam based on the results of the PDR. If they do affect the exam, the exam would be rescheduled. However, that is not to say that if the examinee has taken medication as a countermeasure, and does not tell me, they will be discovered, the exam terminated and my report would reflect same.

To the sociopath question:

Even sociopaths know what a lie is. It is my job, as the polygraph examiner, to ensure that the examinee understands what a lie is. Therefore, if he does lie to the relevant issue questions posed, in this case for example, "Did you receive any unauthorized monies from Joe Smith," the examinee will respond accordingly upon completion of the exam, i.e., deception indicated. An examinee physiologically responds to the threat posed by the question asked. Therefore, the examinee, knowing they are lying, will have a physiological response to that question(s) showing deception.
