Attorney Confirms Some Stolen Rothstein Money Went To Business Partner

There are numerous rumors about who may have been on the receiving end of Rothstein's stolen fortune, but Scherer confirmed only one recipient so far: Ovadia "Ovi" Levy, Rothstein's good friend and partner in the Renato watch company.
I left a message with Levy, who refused comment when I called him two weeks ago, today. Sources say Levy, who joined Rothstein last year in supporting John McCain to the tune of about $15,000, also allegedly had invested millions in Rothstein's scheme. Scherer declined to say how much Rothstein wired to Levy before he fled to Morocco.
Levy is the son of mulitmillionaire hotelier Shimon Levy, whose holdings include the Sea Club Resort on Fort Lauderdale beach. Shimon Levy has had known ties to major Israeli organized crime figures in the past, according to published reports. He once spent a year in Israeli prison himself for
abetting two Israeli organized crime figures. In May 1997, Levy's partner in the Sea Club Resort in Fort Lauderdale, Zvika Yuz, was shot in the face as he parked his car at the hotel. Yuz, who was himself involved in a huge Ponzi scheme, died a few days later. The suspect, who was wearing a fake beard and carrying a doll, was never caught. Here's a passage from a Miami Herald story published at the time of Yuz's death:

Shimon Levy, 50, a partner with Yuz at the Ramada Sea Club, said Yuz never mentioned that he was having a problem with anyone.
"I knew him for three years very well," Levy said. "And I don't see any reason for something like this. He's not a guy that deals with illegal stuff. He's a very straight guy. He's a good husband. He's a good father."
But Yuz, an Israeli native who lived in Miami, played a significant role in what authorities have described as one of the largest fraud schemes in Florida history.
He was one of about 20 money men who in the late 1980s and early '90s recruited investors for the now defunct Premium Sales of Aventura.
Federal authorities indicted 36 company employees last year alleging the company was a front to bilk 1,800 investors of $300 million. Yuz was not among those indicted.
Fort Lauderdale Police Detective Jack King has said there is no evidence linking the shooting to Premium, but investigators are exploring the possibility.
Yuz's testimony did not appear critical to the case. Robbery did not appear to be the motive for his slaying, King said.
Levy said the killing must have been motivated by something that happened before he met Yuz.
"I think it's a past thing, either Premium or something from the past," he said.
It goes deeper. This from a Herald follow-up (the Sun-Sentinel, incidentally, had nothing on this angle):
A co-owner and Yuz's partner in the Ramada Sea Club Oceanfront Resort -- Shimon Levy, 50, now of Plantation -- came to the United States almost as soon as he was released from an Israeli prison in 1982. He was granted a visa because U.S. immigration officials didn't know of his Israeli conviction as an accessory to murder after the fact.
The case made national headlines in Israel and caused Levy immigration problems as late as 1989. Former Israeli president Chaim Herzog ordered Levy's criminal records destroyed that year for unexplained reasons. But those records turned up later in a New Jersey civil case against Levy.
Those records also reveal earlier Israeli convictions against Levy for tax evasion, insulting a police officer, giving false testimony to a police officer and suborning perjury by urging a police officer not to prosecute an acquaintance.
Both Shimon Levy and Yuz had ties to major Israeli organized crime figures. Former Miami Herald investigative reporter David Kidwell did an extensive investigation into the murder and those ties. Key passages:
[F]ederal authorities are taking seriously an informant's allegations that his murder was tied to South Florida's Israeli underworld -- a complex enterprise allegedly orchestrating the movement of millions in ill-gotten drug proceeds through a myriad of businesses here.
``They have all this drug money they need to clean, and they are looking for any cash business to funnel it through,'' said the federal informant, who has already pleaded guilty to his role in the money laundering. ``Jewelry stores, T-shirt shops, restaurants, strip shopping malls, flea markets, everything. This is just the tip of it.''
... Isaac Benarroch, 64, was being sought for questioning in Yuz's murder because of some threatening letters he sent Yuz four years ago.
Police also suspect that Benarroch shot at a building owned by a friend of Yuz when he was trying to retrieve $600,000 he had lost in a failed investment scheme promoted by Yuz.
Benarroch's partner in a Venezuela tennis club, Ricardo La Bergere, was also shot execution-style in West Palm Beach in February. Neither of the killings has been solved.
Benarroch was a sworn enemy of Yuz. U.S. authorities are more interested in Yuz's circle of friends and their associates, many with ties to a famous list of 11 top Israeli organized crime figures.
The list, leaked to newspapers in 1977 by the Israeli national police, became a news event of Watergate proportions in Israel. Many of those with ties to the list, all proclaiming their innocence, left the country and settled here.
Their business relationships are complex, extend into many facets of South Florida life and have attracted the close attention of investigators.
Among those linked to the infamous list of 11: Eli Tisona, now in the federal lockup in Miami awaiting trial on money-laundering charges; his brother Ezra, convicted for his role in corruption at the flea market; Shalom Genish, a partner at the market and the target of numerous federal probes; and Shimon Levy, Yuz's partner in the hotel.
... Yuz's partner in the Ramada, Shimon Levy, has his own ties to the list of 11. Levy lives in a Plantation house built by Genish and spent a year in Israeli prison in 1981 after he helped hide two top organized crime figures wanted in a grisly double murder in Israel.
Both of the crime figures, eventually sent to prison for the murders, were on the list of 11. Levy did not return Herald telephone calls.
These are interesting ties, especially considering the rampant rumors surrounding Rothstein, but there is no evidence that there are any current ties and there certainly hasn't been any evidence surface to date showing any of the stolen Rothstein money ended up in the hands of organized crime. The reason for Rothstein's alleged payments to Ovi Levy could be simply that he wanted to reimburse his friend for ;the ripped-off investment. Answers should come in due time.

I saw it in my old Brooklyn neighborhood all the time. Hasidic Jews would move into predominantly Italian, Irish, and German neighborhoods. They would NOT patronize any business that wasnt Jewish owned. Completely ignore established business to spend their money with there own people. Rabbi Baruch Chalomish faced drug charges in Manchester Crown Court yesterday
A wealthy rabbi financed a drug dealing operation in which girls were given cocaine in exchange for sexual services, a court heard yesterday.
Baruch Chalomish, 54, turned a city centre flat into a base for a ' commercial cocaine supply operation' after abusing the drug himself, it was claimed.
He was arrested along with a friend, Nasir Abbas, also 54, with over £15,000 in cash and 100g of cocaine --some of which had a purity of up to 80 per cent - after police searched the flat in January this year.
Police also searched the rabbi's home address in Salford, Greater Manchester, and discovered cash and a further 50g of cocaine scattered around the house in different containers.
When questioned by police, Abbas claimed that Chalomish didn't sell the drugs but would allow any young woman who visited the apartment in Shude Hill, Manchester, to take the cocaine in exchange for 'sexual services'.
But at Manchester Crown Court, prosecuting counsel Michael Goldwater said: 'Our case is that Nasir Abbas and Rabbi Chalomish were dealing in controlled drugs.'
Rabbi Chalomish denies two counts of possession of cocaine with intent to supply, but has pleaded guilty to two counts of possession of cocaine.
Nasir Abbas, who failed to attend court, denies one count of possession of cocaine, and another of possession with intent to supply.
The case continues.
I wonder how much a one-way first class ticket to Israel is.... It seems the flights from Ft. Lauderdale are booked up.... Maybe if I try leaving from Miami.

You are now faced with a defining moment in your professional life. There's a story here, one that a true investigative journalist dreams about. Rothstein fraud, Britt murder, sex, corrupt politicians, judges and cops, athletes and celebrities, international ties to organized crime, etc. Rothstein is one of the many players, but certainly not at the top. As a previous poster stated...it's all so obvious that he is merely a single tentacle that leads to the octopus.
I bet that when you became a reporter you, as most reporters do, had fantasies of winning the Pulitzer prize. This is the investigation of a lifetime. Are you going to be a hack journalist, or propelled to the forefront of your craft. Woodward and Bernstein faced a similar choice.
You need resources, as the scope of this is monumental. Some of your readers have honesty, integrity and investigative skill. Some of your readers are both active and retired attorney's...many are also retired law enforcement types. You need help with this, your paper obviously cannot give you the resources, and there are those out there that are willing to help.

In Casablanca he met with members of NY and Israeli organized crime because they were and are concerned about the money's disappearance. They explained his family is in jeopardy.
Hence he returned to:

6. Protect his family (now have extended protection)

He will shortly flee the US prior to bail hearing. He cannot make bail due to fruit of the poisonous tree and liens on all 16 properties. Hence SR knows he will see the isolation floor/wing of a local MCC. If he is assigned to a fed judge he knows he may be able to swing house arrest but I doubt it and the locals will be up in arms.
The Feds are taking more time than normal due to the depth and breadth of this crime. People in government, gangsters and others are involved. And, there is the possibility that someone at the Fed level is also involved.
This was a well-planned, intricate scheme and that scheme is still playing out - although the general population thinks he has been caught. This guy was able to help people with hidden Swiss accounts that were jeopardy get the money out and make short term investments with high yields, or so they thought. Now their money is gone and they can't yell help me to anyone. SR may win.

Is Jeff Epstein Also Running A Ponzi Scheme?
There are still mysteries around the money manager's sexual habits but perhaps not enough people are asking the question: is Epstein running a Ponzi scheme?
This 2002 New York magazine piece on Epstein raises several red flags. It tells us that Epstein got his start in finance when he was hired by Ace Greenberg to work at Bear Stearns. A few years later, he launched his own money management firm, J. Epstein & Co. As with many private managers, his client list is kept secret, although there are rumors (and denials) that David Rockefeller and Linda Wachner had money with Epstein. His only confirmed client is Leslie Wexner, the founder of clothing chain The Limited. This kind of secrecy and exclusivity, viewed in the light of Bernie Madoff, is at the very least suspicious.
Another red flag is the way the money is managed. In 2002, Epstein's company reportedly had around 150 employees, based in Manhattan; New Albany, Ohio; and St. Thomas, where he reincorporated his company as Financial Trust Co. several years ago. But these employees are all said to be "administrative." He reportedly employs no analysts, portfolio managers or traders. All of the investment decisions are said to be made by Epstein himself, Landon Thomas reported in that 2002 article.
Is there any other multi-billion-dollar financial company run this way?
Here's another red flag: Epstein reportedly only accepts investments of $1 billion or more. There aren't many people out there who can place $1 billion with anyone, much less entrust it to a single individual. If this is a scam, we expect that Epstein lowers the billion bar for "friends" who are permitted to place much smaller sums with him.
Yet another red flag is that Epstein takes absolute control of the money, leaving investors with no options about how it is invested. According to rumors, he gives them little information about what he does with it.
The way Epstein is compensated is also a bit suspicious. Last year in the New York Times, Landon Thomas reported that Epstein charges a flat fee on the assets entrusted to him, anywhere from $25 million to $100 million, but doesn't collect any portion of the profits. This is oddly reminiscent of Bernie Madoff's compensation scheme.
Here's something else: how could Epstein's one-man show not fall apart while he was in jail during one of the most volatile years in history? We don't know for sure that Epstein's business has kept humming along. But if an allegedly multi-billion investment company fell apart, we'd expect that there would be some news or at least rumors about it. We suppose he could have moved his clients to all cash before he got locked up.
We do know, however, that Epstein actually has invested money with both Citigroup and Bear Stearns (he was a big investor in those Ralph Cioffi run hedge funds that blew up). So if there is a scam aspect to his operations, it's not as pure as Madoff's. Epstein was putting money to work.
On the other hand, there are no SEC filings disclosing Epstein's holdings. Not one. It's hard to see how he could be managing billions without ever tripping a disclosure trigger, unless he avoids the stock market altogether and only invests in private deals. This is another red flag.
One thing we don't know is what kind of returns Epstein delivers to his clients. If they were very modest and subject to regular market fluctuations, this would suggest that maybe he isn't running a scam.
We have no concrete evidence that Epstein is running a scam. But given the red flags and the fact that he reportedly controls billions of dollars, isn't it something worth looking into?

Specifically, the numerous accusations against Judge Stettin include :
Abusing his judicial office and the Miami Dade Courthouse for personal gain by conducting a constitutionally prohibited private law practice while concurrently serving as an appointed sitting Senior Circuit and Associate Fourth District Court of Appeals Judge with chambers and a courtroom in the Miami Dade Courthouse;
Filing false sworn financial and gift disclosures with the State of Florida since 1999 that conceal the sources of millions of dollars in payments and mislead as to the activity of his sole proprietorship law firm, Hebert Stettin P.A.;
Using the American Arbitration Association as a billing conduit to facilitate the ability of local lawyers and law firms to secretly and indirectly hire and pay Judge Stettin while at the same time appearing in his courtroom;
Wielding his judiciary power, under color of state authority as a sitting judge, in private arbitration proceedings to improperly confiscate millions of dollars in assets to fund his law firm’s activity;
Appointing “cronies” to a receivership whereby over a span of five years millions of dollars were misappropriated;
Accepting his appointment as receiver in the Rothstein scandal given either the real or appearance of conflicts created by Judge Stettin’s ties to members of the Rothstein Law Firm. Such ties include: Judge Stettin’s recruitment by and lengthy collaboration with Judge Barry Stone (now a member of the Rothstein Law Firm), on the 4th District Court of Appeals; Judge Stettin’s service on the 4th DCA with Judge Gary Farmer Sr., father of Rothstein partner Gary Farmer Jr.; alleged scamster Scott Rothstein’s position on the 4th DCA nominating commission; and Gary Farmer Jr.’s relationship with Eric Stettin, Judge Herbert Stettin’s son.
These accusations have been raised in the American Arbitration Association case #321810001800 by Peter Halmos and Richard A. Sharpstein as a result of their investigations into Judge Stettin’s conduct.
Mr. Sharpstein, a former Miami Dade County prosecutor with thirty years of trial experience in Miami, stated, “The Florida Constitution prohibits a sitting judge from procuring, directly or indirectly, privately paid legal employment and requires sworn annual disclosures that identify the sources of income and gifts received by public officials.”

Sure there are good and decent people here but the corruption (second to NJ) is just terrible. Everyone is either mobbed-up or has ties to someone. SR is ripping people off (greedy or not) while other people are having homes foreclosed and can't find jobs.
And I think most of the people in this post agree with me; because I think most or all are hardworking, honest people.
I work for a law firm in Miami and every lawyer told me they are embarrassed by this fiasco; and clients of ours are pulling out their investment business with us because we have "Jewish" lawyers. Rothstein, Madoff and Dreier and others I read about are repulsive creatures that give their heritage a bad name. I despise crooks.
But, then again, they made a series called The Sopranos.
You can take the 16 yr old Punk from da Bronx and transplant um in Lauderhill Ghetto with the dream of living on da ICW. Ya can't take da Bronx mentality outta da punk. I too am a journalist and I am shocked that Bob would quote David Kidwell's article...clearly he didn't do his due diligence. If you investigate further, the Levys were never on the Israeli 11 list like the article states. Neither was Yuz. Further, I'm not a Jew but I find the anti semetic remarks appalling. One has nothing to do with the other. If Obama messes up, I'd like to see how the white community will respond and whether they will blame his race for his inadequacies. That would be so wrong on so many levels.

Nurik is very competent, but major conflicts, which do not go away just because he left the firm. No the issue of his fees is not premature, the AUSA, always looks at the attorney's fee and that is why before, one represents a person in Federal court, you get a preapporval of your fees before going forward or those fees may be taken in the criminal case (just like in major Drug cases) and the Bankruptcy case under a claw back. And Mr. Nurik is a smart man when it comes to his fees. He is not doing this out of the goodness of his heart.
Remember the Feds, sat for (2) years, on Oakland Pk Blvd, guarding the files of Mutual Benfits , before and after every thing went down.
The town is completly wired now and for the past 12 months. Too bad Ireland's Inn is closed, it used to be a great watering hole for the politician , drug smugglers, and small business owners.

Nurik's problem is not the AUSA, but the scrutiny of the Feds and IRS as to where the money is coming from. A competent attorney in these cases would know the litmus test to apply. Any potential conflict in his representation would unfold as the investigation persists and would be based on several factors. Most important are whether he might be a "material" witness in the criminal and civil cases and whether he is positioned to provide the best legal represenation. It is complicated. But, based on years of seeing similar cases unfold, I have to believe that by now Nurik would know any level of conflict that exists. The Feds have put enormous man hours into this already and I doubt they would jeapardize their case....but he may not know for sure until the indictments come down.

He has actually been "consulting" for years, previously as DWB Consulting Serrvices LLC. This was a Florida corporation using is home address in Sunrise.
Apparently his association with SR made him a little more sophisticated and the current entity was incorporated in Delaware in 5/09 and filed in Florida as a foreign corporation.
The address is a favorite RRA corporate service but the involvement of RRA attorney Christina M. Kitterman is the RRA link.
