Broward Charities, Beware: They're Going for the Rothstein Money
Scott Rothstein gave $1 million to Holy Cross Hospital and hundreds of thousands of dollars to a slew of other charities, including the Dan Marino Foundation, Alonzo Mourning Charities, the Humane Society, the American Heart Association, the Joe DiMaggio Children's Hospital, and the Jewish Federation.
Guess what? The lawyers are looking to get that money back.
Fort Lauderdale attorney Bill Scherer, who is representing investors who gave Rothstein more than $75 million, says he believes case law supports
the Rothstein charity money and sent me a case from Pennsylvania in which the U.S. Bankruptcy Court ruled that charitable contributions could be set aside by the court as fraudulent transfers. From the ruling involving accused Ponzi schemer David Burry:
[C]haritable contributions which were made by operator of Ponzi scheme to specific charity, as part of pattern of contributing more than $1.5 millon to charities over four years that he successfully operated scheme in attempt to create appearance to potential investors of profitable and charitable enterprise, were made with actual intent to defraud future investors, for fraudulent transfer purposes.
Now, I'm not prepared to argue the law, and there are differences between Florida and Pennsylvania law, but the message is clear: Rothstein's charity money will be targeted for return.

Click on page 18 to see one of the final soirees of Rothstein and his social set at the Broward County Heart Ball, which as co-chaired by Scott and Kim Rothstein and supposedly raised about $1.25 million. The whole gang was there, including big Rothstein investors George Levin, Doug Von Allmen, and Ted Morse, who are all pictured with significant others. Mark Levinson and Les Stracher helped sponsor the event, and Stu Rosenfeldt is pictured in his tux. Also there were Rick and Rita Case, who I hear didn't invest with Rothstein, and Sheriff Al Lamberti, who is photographed with his arm around Rothstein.
I've said this story is going to have big ramifications in the political, financial, and legal worlds. But recent developments have prompted me to add one more sphere that will be significantly impacted: the law enforcement realm.
Also included elsewhere in the edition is Ron Picou, a longtime Fort Lauderdale businessman who socialized with Rothstein. Former Rothstein associate Roger Stone says Picou was one of the early investors in Rothstein's investment scheme. Still trying to reach Picou -- who was a friend and supporter of Ken Jenne when he was sheriff -- for confirmation.
Rothstein claimed he met his wife, Kim, at a charity event, Harley Dog Days, four years ago. Here's the quote he gave about it earlier this year: "And just for the record, I would not be married to the amazing woman that I call my wife, Kimmy, if it were not for PAWS. No, she did not adopt me at a shelter, but we did find each other at the Harley Dog Days event four years ago. I am now well-trained, very much loved, and yes... I am housebroken."

Les Stracher? Is this the same Les Stracher who's wife Bev Stracher ran campaigns such as J.R. Markham, heavily underwritten by Ron Bergeron, and the same Bev Stracher who ran Beth Flansbaum-Talabisco's campaign for Tamarac Mayor, the same Bev Stracher who was at the County Commission in December 2006 seated in a cluster of cheerleaders including Russ Klenet to admire Prestige Homes getting approval of Stacy Ritter and other Commissioners to develop Sabal Palm and Monterey golf courses, over the protests of the residents, the same Prestige Homes that helped Stracher by funding Talabisco's campaign, and which unbelievably corrupted the already corrupt Eggelletion, hired School Board Member Stephanie Kraft's husband to get a half million dollars from the financially strapped School Board, allegedly tried to bribe Joe Schreiber to get his wife to jump out of the race (chauvinsts!) etc., etc. . . . it's all pure coincidence, no doubt, please tell me this small clutch of people are not working together for a welfare program for the rich, namely themselves.

You are right about clawbacks, but they won't apply here, and Scherer knows that. He's using this post to push a settlement.
The fact is the investors got in because they thought Rothstein was extorting rich people. It seemed like easy money.
And even if you forget the law, let's deal with the reality. There is zero, and I do mean ZERO, chance that a jury is going to decide to make a charity feeding poor people or treating the ill give money back to a rich person who tried to become richer by joining up with a scum bag.

If it is established that investors who got their money back were selectively enriched as compared to those who lost everything, a pro active trustee in bankruptcy can petition the court to mandate those individuals, who thought they were home free with their investments and earnings, to pay back their profits as well. This is what happened to a bunch of investors in the Alderdice case years ago. They were breathing sighs of relief because they had 'gotten their money out in time,' only to have their hearts broken and wallets shaved by a trustee who said their checks were preferential transfers under the bankruptcy code and had to be returned. So I guess what people would want to know is who scored while others suffered?

This is the second tome Ron got nailed. The first time was by Navaro Security Guard Co, when the business was first starting up. Navaro had promised all his friends if they invest the would get stock and make money. That deal took a dump and no one got back a dime.
Navaro just landed a contract in Miami with five other companies and Navaro is scrambling all over town to get the $600,000.00 start up money for the contract. He has been having a hard time with this endeavor. Ron can't invest because he lost everything to THE GREAT CORRUPTOR SCOTTIE ROTHSTEIN.
Picou was with Scotty one night at the Blue Martini while Scott was courting Kimmie with $1000.00 tips. Ron was drunk and mouthed off to a marshall arts expert and the guy just kicked his A__. Ron had two black eyes and a broken nose.
Ron was arrested one night at the Voo-Doo lounge by FLPD and the cops threw Ron down in a mud puddle. Scott was representing the FLPD Fraternal Order of Police and some how the case disappeared. The few million Ron had left Scottie got it.
You will find Ron with Ted Morse smoking cigars at Moes Ultimate Cigars all the time. They should call him Moe the informant. Scottie had Moes arrest records sealed . One arrest was here in Broward for AX credit card fraud and one was in the Middle District of Fl by the feds.
