Bonnie, of course, has claimed to have lost $500,000 in an investment with Rothstein, and her son, Andrew Barnett, worked for Rothstein promoting the investment scheme. He was reportedly supposed to be paid $400,000 by Rothstein on the Friday before the plane trip to Morocco. Needless to say, he never got that money. And now he's named as a defendant in Bill Scherer's lawsuit.
-- UPDATED: Speaking of Scherer, he added George "The Whale" Levin, the Banyon Income Fund, Banyan rep Michael Szafranski, Szafranski's firm Onyx Options Consultants, and accountant Berenfeld Spritzer Schecter Sheer LLP as defendants in his lawsuit today. Can somebody say "scorched earth"?
-- Some of the stuff I'm hearing lately is mind-blowing, but it's just not ripe yet. This thing is going to get a lot darker and uglier before it's said and done (and yes, organized crime appears to be involved).
But in the meantime, I spoke to Muhammed "Moe" Sohail today for a brief minute. I had to ask him if he had read the now-infamous "goodfella" comment in which someone very much resembling Rothstein went off on Sohail and claimed he would be sent back to his native Pakistan, among other choice words. Sohail told me, "People should have the balls to
put their name on what they write. I'm sure it was written by Scott Rothstein. I don't think it could be from anybody else."
That's a pretty solid endorsement of authenticity by a main player in this drama. If it's not from Rothstein, it's from somebody very close to him. It's got all the tell-tale signs. Here are the pertinent contents of the email regarding Sohail (the Morse stuff, well, that's for another day entirely):

-- I just got off the phone with attorney Jeff Sonn, who told me that he had just hired a new client related to the Rothstein debacle. This isn't one of his standard stupid-rich victims, it's a guy who sold a house and had his portion of the proceeds -- $137,000 -- sitting in escrow. Former RRA attorney Lee Watson handled the transaction, said Sonn, and did nothing wrong. The money was simply sitting in a Gibraltar trust account that was raided by Rothstein during his October breakout. "He doesn't have a place to stay, has been living with friends, and on top of that is suffering from cancer," Sonn told me. "I've brought this to the attention of Herb Stettin and we're going to work quickly to see if we can trace this to a particular Gibraltar account."

Posted On: Wednesday, Nov. 25 2009 @ 3:35PMThe arrest part is interesting, but the fact that he's not in jail backs up Scott's claim he isn't coorporating with the feds. But he's not exactly telling the truth.
He spent the first couple days post road trip talking to the feds about the money, and helping them trace a huge chunk of the cash. In his contrite/avenger/delusional state of mind, he figured he'd help everyone get their money back and walk away relatively unscathed.
Since the feds knew they had him cold, it made sense to let him ramble and believe that, while building a case and trying to reclaim the cash. The fact that Scott has an absolute moron for a lawyer made their job easier.
Once Scott realized that wasn't going to work,he told the feds "fuck you,'' and refused to keep talking. (I hear he literally said that, which worked out well). So now they are building a case they hope will make him do what they want.
The problem is the feds may not want to finish the job. The real story isn't the stolen money, it's the influence the money bought. That purchase is considerable, and could change the landscape of Broward for years.
We'll see if the new FBI agent in charge is really an anti-corruption champion or a great investigator adept at politics and grabbing headlines.

@ RIMFC: I agree with you. SR is the iceberg's tip. Trace it -- follow that money trail -- and the iceberg will prove to be deep, the characters involved will prove to be large. He's a pawn.
Actually, we are *all* pawns, considering how he, and all the corrupt politicos, electeds, judges, et al, have toyed with the law, used the public coffers as their personal accounts. And that still continues. Word on the street is that the County Commission waited for the County Charter Review Committee's recommendations to be produced and are now attempting to bury it. And there is more shenanigans afoot ... more manipulations by the "representatives" of We, The People.
Unfortunately, doesn't appear that anyone is out there to keep them honest. All Rothstein, all the time.
Maybe the circles will start closing and we will see connections between the SR story and stories of the people who think they were elected to raid the public coffers.

He most likely will find himself in a Fed Bureau of Prison facility, most likely medium security, a real prison...for a very, very long time. No prison camp for him. You on the other hand will go home to your family each night, eat out, vacation, etc....and hopefully a few years from now you'll visit Rothstein in prison and do a follow-up series.

This started and ended with Morse...Ted was the first investor (according to a post on this blog a few days ago) with $3 mil and returned $3.5.
The end came with Ed Morse sending $57 million to Grand Cayman Bank, in the oldest scam in the world.. That was in March 2009, but the end to all this came on the day The REAL Judge ordered Ed and Carol Morse to appear in his courtroom to answer to a judgement against them in the amount of $800,000. Scott's lies came to an end, if they did not show, the judge was going to issue a warrant for them to appear..they didn't (did not know anything about this) and Scott skipped to Morrocco that night at 8:30 PM.
Ed Morse was more than "shocked" when he found out that he had a $800,000 judgement against him (he actually lost the lawsuit) and in fact did not "win" $23 Million dollar judgement with punitive damages as Scott bragged for months!.. I still don't understand how Ed Morse allowed this to happen, much less give Scotty boy $57 million .... by the way. someone tell me where Les Stracher was all this time..correct me if I have this wrong, I got it from another source, was Les their lawyer???

* the silly speculation about Rothstein being the tip of a huge iceberg. Rothstein and certain other defendants ARE the conspiracy. Isn't that enough? Was organized crime involved? Hmm - isn't Rothstein's scheme "organized" and "crime" enough for everyone? (I acknowledge that more players may surface, but I don't think Rothstein was just a pawn or a small part of this)
* the speculation that Rothstein would comment on this blog as "Goodfella" - please! Goodfella is obviously a friend of Rothstein, with the same cheesy sense of style, but I seriously doubt Rothstein is posting on blogs, openly calling himself a criminal.

Attorney Bill Scherer filed an amended complaint today on behalf of investors who lost around $100 million due to Scott Rothstein. Among the new defendants: Irene Stay, CFO at the Rothstein Rosenfeldt Adler law firm.
When the law firm's phones were ringing off the hook from bilked investors when Rothstein took off for Morocco, Stuart Rosenfeldt, co-owner of the firm, pressed Stay for confirmation of money in the operating and trust accounts, states the complaint.

However some folks on this blog appear to be very angry in general. A few days back it got so bad that Bob dropped a blog to tell us to ignore some of these rants and they would just go away.

Scherer said in the amended lawsuit that he has a damning email from Preve to Rothstein, sent on Oct. 31 when Rothstein had fled the country to Morocco.
According to the lawsuit, the Oct. 31 email states: “We [Levin and Preve] understand that the shortage is now 300m which is still manageable if we have your cooperation. Let me know,” to which Rothstein responded, “That is not the shortage . . . . . that is the amount of money needed to give the investors back their money. I really just need to end it frank. It will make it easier for everyone.”
According to the lawsuit, this email shows an attempt by Preve and Levin to try and “manage” the hole created and presumes that Levin and Preve had knowledge of a prior deficit and the Ponzi scheme.

The fees came from the discounted amount. There WAS NO settlement. The idea of the settlement (the big bucks) was created to get folks to cough up smaller dollars (presumably to pacify the whistleblowers, who would get something sooner, rather than a lot of money later; the investors believed that their fronting of a lesser amount of money would entitle them to the full settlement later). The actual bucks that changed hands -- discounted amount -- was where the cut came from. The other amount -- settlement -- was a fantasy.

But first, I apologize that I was being a buzzkill. No reason people shouldn't have fun, and I guess it's my problem if I get annoyed by clicking on their asinine links. (The only REAL issue is the anti-semitism, that's uncalled for).
Getting back to Virgil's questions, I don't have a ton of facts, but I would share them with law enforcement if they asked.
The only thing I will say in this forum is that the investment initially struck me as "too good to be true", but that there was a lot of documentation that appeared to back it up as potentially legitimate. For this reason, I understand why some otherwise sensible people agreed to invest. It's a bit unfair to say they weren't victims.
Even the Morse situation, where they lost a judgment but were told by Rothstein that they won $23 million - it seems absurd and completely retarded for them to believe this, but people tend to trust their lawyers. If you can't trust your own lawyer to be on your team, then who can you trust? That's one of the saddest parts of this story.
Anyway, it's a holiday eve, everyone should be having fun, sorry to interrupt the proceedings. Later kidzzz.

1. Read levins docs that he used to solicit investors. trying to get them so bob can post them but the person that showed them to me would not give them up. the docs look like they were drafted by a first year finance major at some third rate on line school. lacking any real detail for due diligence purposes. also, they clearly misrepresent the alleged product and levins role. also, the necessary disclosures are missing. one quite important one that would raise red flags immediately: the docs fail to state that rothsteins cpa, weintraub, is also the guy in charge of the firm preparing the audited financial for banyon for this investment.
2. to those calculating money in---you do not double or triple dip. if an investor puts in 20 million and gets back 30 million and then puts the 30 million back in he has not invested 50 million. and that is the way the government and some of the folks in the media are doing the math. its called levin/preve math. also, we must remember that in a ponzi scheme the profit is not real. its just someone elses money that the investor is not entitled to in the first place.
3. someone needs to write about morse and his involvement. from what i gather we have the father who is in his 80's, the son who is the CEO and in his late 50's, and the grandson who is the manager of one of the stores and is in his 30's. the CEO son was rothsteins best friend. they were inseparable. so tell me with a straight face he was not involved. look at his recent real estate purchases. look at the recent improvements to his home. look at the improvements to his dealerships. give me a break. while other car dealers were cutting back morse did tens of millions of dollars of building and renovations to three of his dealerships. a complete rebuild of bayview cadillac, a palace of a dealership at delray toyota---so richly done that the toyota family themselves flew in to the grand opening, and upgrades at one of their dealerships on the west coast of florida. i dont know about you but i have not seen ANY other car dealers doing what morse has been doing. the IRS and the feds need to take a good long look at this. does not pass the smell test. never mind all the additional stuff that goodfella points out about the hundreds of thousands the son and grandson spend on mistresses.
4. sfranski had an office at RRA and that did not raise red flags. he was the guy doing the weekly due diligence on these deals. he needed to be arms lenght at every moment. did he even pay for the space??? no one had any concerns that he was being bought by rothstein??? greed blinds even the brightest people
5. preve and levin both had criminal pasts. and people still gave them tens of millions to invest. i will say it again, greed blinds even the brightest people.
6. as to levin, we must differentiate as to what money he invested that was actually his and what money he invested that he stole from investors in this scheme and over the past 30 plus years. as we keep telling rothstein---if its stolen it AINT YOURS!!!
7. rosenfeldt, boden, adler, smith---the bar finally got to them. better late than never. what about the feds??? the irs???rosenfeldt clearly knew what was going on. how could he claim ignorance when the firm that he is 50 percent owner of is doing only 8 million in business with a payroll of 18 million (two mill of which was his) and he is taking ferraris as gifts, and buying yachts and giving hundreds of thousands in political contributions. he is little---he wont take up much space in jail. ship him away with rothstein. as for smith, he has prison history---his dad did fed time for a little campaign fund mishap. and insiders at the firm all know smith was orchestrating all the donations from the partners and the firm and the timing of the donations to coordinate with important votes etc. Talk to the girls who used to work for rothstein. according to them smith used to come directly to them for checks from all the various rothstein accounts and rothstein would just sign them.
8. adler---for starters he needs to return the condo he bought in ny with a 500k loan from rothstein. and how did a guy whose income, according to reliable sources, was about 300k per year give more than that in campaign contributions. time to turn in the bar license mr. adler. and make certain to let destiny know its time to move out of the condo you have been paying for to keep her warm while you are away.
9. boden---cooked. he was helping rothstein rip off investors and was also helping one of rothsteins feeder funds, rich pearson, rip off investors further. the thieves were stealing from the thieves who were stealing from the thieves.
10. moe---enough said---he is a rat and a money launderer. and as goodfella pointed out in his hilarious but often accurate rant---just how does a guy with a tiny cigar shop buy a bentley, condos in vegas, a condo in riverhouse, and attend every major charity event in town. helloooo--are there any federal agents out there. go get a cigar and have a look around. pay with a hundred dollar bill and watch where it goes---the cash register or moes pocket.

Search the archives of the Herald, etc. and you will find a wealth of info on Elliott's arrest for a similar crime (though not a Ponzi) while he and Bonnnie were still married.
Also, where is Mark Levinson in all this? Rumor is that he and his wife hosted a party only a few nights before this came crashing down, announcing that SR was the new owner of Levinson Jewelers. Then later denied it to Las Olas ASSC. Also, was one of the vessels confisicated registered to Levinson as has been rumored???

Debra V. quit claims over 50% interest of her house (their house?) to Tony in August 08. Why? Is that part of divorce payoff or something else? Is it true that Debra V got a fancy house and car from SR?

Scott Rothstein may have purchased a large life insurance policy on himself recently, it was revealed in bankruptcy court this morning.
Miami-Dade senior judge Herbert Stettin, the government-appointed trustee in bankruptcy court overseeing liquidation of Rothstein Rosenfeldt Adler, said he's investigating whether there's "a very large life insurance policy on Mr. Rothstein's life.''
He said he was told Rothstein might have paid cash for the policy.

3. Keep in mind that you're not doing this to feed and clothe your children. Were talking bling, cash and vacations. Is it worth it?

1. money rothstein grabbed was all investor money. no client funds.
2. client money was grabbed by the firm after rothstein left. check the court filings as to when money was transferred and how. the few million that was moved that belonged to clients of the firm were moved at rosenfeldts instruction from client trust accounts, not investor accounts, and was moved after rothstein took his fat ass to morocco.
3. what as left of the client funds were grabbed by the receiver, stettin, and he is claiming that this money needs to be used to pay his fees and the fees of his merry band of thieves, the folks from berger singerman.
4. if is amazing to me that the implosion of this ponzi scheme cooked up by rothstein and his partners and the intervention by other lawyers, receivers etc has only resulted in more stealing. what the heck do these idiots need to be paid for. the court should simply freeze all the assets of the firm, cash included, no matter how much or little it may be and hold it for the investors. once all rothsteins assets are sold and once they seize the assets of all the co conspirators and sell them, then divide it up fairly between all the investors. why should a bunch of scavenger attorneys take the bulk of what is left???
they take the terrible wrongs of rothstein and his crew and pretend to be helping by stealing whats left by calling it fees. what a crock.
5. the court should demand an accounting immediately from all ponzi investors to figure out who made what profit. and an excellent method to get them to cooperate is to freeze all their accounts until they provide the accounting. start with morse. freeze his dealership accounts. he will come crying like a baby and admit to how much ponzi money he took. do the same to all the other investors.
6. alot of the losses being claimed are "profits" ie. money that was never theirs in the first place because it was a fraud---and does not go in their loss column.
7. loss= money you really lost. not the jack in the beanstalk magic money rothstein "made you" as profits. stop the greed---if everyone would just try to get back what they really invested alot more people would get back alot more of what they really lost.
8. more on morse--in the middle of the recession morse redecorated his home, put up a massive gate in front of his house, redid three of his dealerships and bought his son and daughter new homes. come on morse---you are trashing rothstein everywhere you go---step up and be a man and admit what you did and give back the illegal proceeds you used to fund your expansions, new homes for the kids, and gifts and condos for your mistresses.
9. levin should do the same. ask him how many planes he bought during this scheme. ask him about the massive renovations to his home in bay colony and his home in pennsylvania. and his kids place in california and his kids place in new york.
10. get sfranskis new home
11. if the feds would grab all of this and all these ponzi filled bank accounts alot more of the investors who were really hurt would be made whole. and forgive me for being rude to the thieves in hiding---but isnt that what this is really all about.

Here is what I know. None of the RRA "chiefs" were keeping serious billable time, and writing off a lot of what they did bill. Their function was strictly schmoozing, "entertaining" and doling out money to pols. This has been confirmed by numerous insiders. They all knew that the firm was floating on non-legal work. They were aggressively recruiting lawyers (though interestingly only targeting 2nd and 3rd stringers) around town and looking for $100k capital contributions, When asked how RRA was doing so well in the recession when other firms were gasping and trimming staff and salaries, all of the "chiefs" in unison were responding, "we have side businesses making millions". Although perhaps not knowing the full extent of the criminality ( no one did except the "administrative corridor"), all the chiefs knew that Scotty was peddling lawsuit settlement deals. Ir was absolutely no secret. They all knew that the firm was maintaining unbelievable trust account balances--bigger than most Wall Street law firms. The "gifts" from Scott--the cars, the watches, the homes,the Tom James clothes, the unlimited expense account at BOVA and Capital Grille, the cigar hooker parties at the BOVA and at Rothstein's New York digs were all payoffs. No one had the gonads to ask questions because they were being overpaid by three times their worth and living the "Gansta lifestyle". Those that did hit the pavement.
Rosenfeldt was stuck and could not blow the whistle even when the Ponzi scheme became evident in Spring 2009. He had taken out a $330k mortgage in May 2005 on his Boca Raton house purchased over 10 years earlier (now worth $250k) and had it tied up in RRA. Rosenfeldt had floated around a half dozen law firms in his career, and saw this as his only chance at fame and fortune. He worshiped Rothstein, particularly when he was given Bentleys, Ferraris, etc. Rosenfeldt wanted to be a national political player and brought in his long-time friend, Roger Stone. Stone smelled a rat a year ago and tipped off Rosenfeldt. Stone is wickedly smart and will be a key behind the scenes informant for the Feds.
Adler likewise had put a $1M mortgage on his house on Las Olas and Scott had funnelled Ponzi money to him to buy a Manhattan apartment where he kept a babe. Adler was intimately involved in the Ponzi scheme and was scouting cases. Adler had previously been a partner with a guy named Carl Karmin, who could have been a Rothstein twin,but who never made it to Scotty's league. Adler is legally talentless and has needed an alpha dog his entire life. Adler also was actively soliciting monies for Scotty around town.
Boden was directly involved in the scheme under Scotty's direction.He prepared the legal documents, etc.
Smith was the chief orchestrator of the illegal campaign contributions.
Stracher was also a Scotty "insider" and was involved in the Morse funding and subsequent rip-off. He had been ripping off Morse for years.
Linder and Kleinfeld were involved in setting up Scotty's asset empire and knew that dirty money was being laundered.They also were part of the illegal campaign conduit funding.
Nurik kept his distance; he smelled something bad since he had been defending white collar fraudsters his whole life.
Stone and Reyes knew nothing because they are as dumb as they come.
Farmer got sucked in to intermingle his large class action settlement with the Ponzi scheme
Some others down the ladder may have culpability too.

He is bright and an excellent trial lawyer. He may be a thief, but its nonsense to say he had no trial skills. He had some excelelnt verdicts and is sharp. Carl Karmin I have known since 1985. He is a good lawyer and an excellent restaurant owner who makes good money and is clean. To say he is a Scotty twin is complete character assassination and bullshit. Barry Stone has a fine mind and was an excellent appellate judge--to say he and Carlos Reyes are stupid is ridiculous. Lastly, there is no question that Farmer is a victim here, as are most of the RRA lawyers. Post facts--not bullshit you made up or heard.

Partners who don't realize the firm is running a $10 mil gap between expenses and revenues? Impossible. You don't have to see the books. You just have to show up, look around, and have half a brain. How hard are people working? What are they working on? What exactly are they doing? These are questions that any Partner asks, no matter how well they are doing. Why? Because money doesn't usually fall out of the sky, and because law partners aren't usually concerned with how they did THIS month - they want to know what's going to happen next month, or at the end of the year when they take disbursements. The idea that the partners, especially the name partners, were innocent victims is ridiculous.
Associates know what is going on too. Again, they may not know the specifics, but there is no craftier, sneakier group than associates at a big law firm. Especially at RRA, where the associates supposedly got paid based on "merit," junior lawyers keep their ear to the ground. How the firm is doing, what it is doing, and where the money is coming from are three things that impact bonuses, and bonuses are the difference between living on Las Olas or in Hialeah, public or private school for the kids, etc. I'm not saying the associates knew there was a huge scam on, but I wonder where they thought the money was coming from?
The $8 mil in revenues collected was not chopped liver, and shows that the firm was, in fact, doing pretty well at actual legal work. However, if Rosenfeldt, Adler, Stone, or anyone else with two working eyes looked at Rothstein's lifestyle, the 170+ employees, all the nice shit they were getting, etc., they HAD to know something didn't add up.
Their cowardly "I'm just as surprised as you" act is shamefully ridiculous, and is an insult to everyone's intelligence. No federal judge will buy it. Lots of people used that excuse in the Financial Federated Ponzi scheme case, and they all got sent to prison - even lawyers like Jeff Payne, who actually lost his own money in the scam. As the judge (Hurley, I think) said to many of these people "Where did you think all of the money was coming from? What did you think you were getting paid so much for?"

well well - this blog should be titled the pot calling the kettle black.... I have lived and worked in this community for 30 years - I dont practice law and have a high school education.
for ten years I was on the P&Z board and know the legal community well - Bill Scherer, Don McClosky, Don Hall, Dennis Mele, Robert Locherie Jr, Harry Stewart (pre city attorney days), Dick Coker, Courtney Crush, Joel Gustafson - these are people that practiced before me regularly and I have a great deal of respect for all of them.
You may not like Bill Scherer - sure lots of you are jealous of his success - but please dont impune his integrity unless you got something and the fact that his son in law was arrsted is pretty weak....
In general I despise the legal community in this town and I hope the Feds strike force puts things in perspective - I believe we are about to see the wrath of the American people strike right here & now. Say what you will about our president and this is post has no agenda political but I can feel the weather changing here...
The feds are going to turn this place upside down like Grant took Richmond - I am hoping you are about to witness the largest federal strike force in the history of this great Country and for along time to come going to the protoligist is going to look like a pleasant experience....
