Lawsuit Says Rothstein Assistant Wept, Said 'I Don't Want to Go to Jail'
I wanted to take it easy, but I feel compelled to link Bill Scherer's amended complaint for the diehards.

Can you feel that?
But remember that Scherer put that detail in there to build a case against Stay, whom he named today as a defendant. He writes that Stay furnished "investors with falsified bank account statements and wire transfer confirmations... despite having actual or constructive knowledge that the investments were a Ponzi scheme."
Scherer says he had a staff of ten people working around the clock for two weeks to produce the original complaint. It shows. He learned of a meeting of "investor-victims" on November 1, that Sunday when I was breaking this thing on this blog. At the meeting was Mel Lifshitz, Ted Morse, Ed Morse, Richard Pearson, A.J. Discala, Dean Kretschmar, Ira Sochet, Mac Melvin, Mark Nordlicht, Jack Simony, Steve Jackel, Laurence King, Frank Preve, Barry Bekkadam, Michael Szafranski, and Steve Levin, and his father the whale, George Levin.
Here's what the lawsuit says happened (and pardon the blue type):
[D]uring that same meeting, Levin informed the group that he reached out to
Rothstein in Morocco letting him know that Banyon stood ready to
provide shortfall financing if he was having trouble making payments.
Astoundingly, Levin's revealing admission took the group by surprise
because one of the core "deal" tenants insured against any possible deficit
by requiring a putative defendant's settlement to be funded prior to an
investors lump sum purchase. Thus, any shortfall, even the smallest one,
is patently contrary to the investment structure and obvious evidence that
the monies are either being misused or are a part of a Ponzi scheme.
Plaintiffs now believe that Levin's statement was a thinly-veiled attempt
to cover his tracks after Rothstein rejected Levin's last-ditch efforts to
persuade Rothstein to keep the Ponzi scheme going. In support, Plaintiffs
rely on a October 31, 2009 email from Preve to Rothstein stating that "We
[Levin and Preve] understand that the shortage is now 300m which is still
manageable if we have your cooperation. Let me know," to which
Rothstein responds, "[t]hat is not the shortage . . . . . that is the amount of
money needed to give the investors back their money. I really just need to
end it frank. It will make it easier for everyone." (emphasis added). The
attempt to try and "manage" the hole created now presumes that Levin and
Preve had knowledge of a prior deficit and serves as an unwitting
admission of their involvement in the perpetuation of the Ponzi scheme.
Levin wants to fund the shortfall of $300 million, but Rothstein basically tells him it's bigger than that and says, "I really just need to end it, Frank. It will make it easier for everyone."
Not sure anything about this is going to be easy.

Why hasn't Bill included in his complaint a civil remedy for a criminal act for a violation of the Florida election laws?
I like Bill, but recall that he is a Republican activist and may not want to make certain politicians key witnesses in the case.
I think even Bill will have his hands tied when the other partners are dealing with stated violations of election laws. He would have a clear claim for fraudulent conveyance to take back the funds from the candidates (unless he suggests that the IRS has a lien on those funds). But even the IRS did not put a lien on all the funds contributed, nor have all the funds been returned.
I know Bill is a good lawyer, and he needs to be prepared to deal with the new claims (in his second amended complaint), as well as some not-so-nice folks that protect their funds with more than just lawyers.
Bill should start the deposition process and see how many people file motions for protective orders and/or assert the fifth amendment privilege. SR likes to talk quite a bit and it's better to get him before he goes into federal custody. If SR "wants to do the right thing," and as we know he is a sociopath and willing to even speak over his lawyer during a WSVN interview, now is the time to take that deposition.
Don't let SR negotiate a lesser sentence, or worse yet, implicate those not-so-nice guys (as Bob already indicated are involved) and then allow SR to go into the witness protection program.
And Stuart Rosenfeldt going into business with Shawn Birken? Judge Birken's son? Why on earth would two birds flock together and a judge's son stick to a guy who is going to be sued into bankruptcy, spending a decade in depositions, and perhaps worse? That doesn't pass the smell test.
Too many loose ends here. Bill and the Feds have A LOT of work to do over the next several years.

Doesn't the entire point of investing in a structured settlement hinge on the fact that the plaintiff doesn't want to wait for his money to be funded by the "putative defendant" so he is willing to accept a lesser amount up-front from the investor, who receives the entire sum over a period of time?
If the settlement was already funded prior to the investors lump sum purchase, what was the investor purchasing?
If the scenario as Scherer writes it was true, then the investor was merely swapping his investment of x for an immediate return of x+y.
This isn't too difficult to follow: The investor was receiving an immediate return for an investment that was supposed to be paid out over time!
In case any of you keeping score at home still thought that any of these investors were 'innocent'...

Why would a company settling a lawsuit say "OK, here's $20 million, I'm going to give it all to your lawyer, but I want your lawyer to only give you $5 mil per month for four months."
I can see some very limited scenarios where that might be useful (to ensure silence & cooperation for a while, for example), but no such explanation is offered in the complaint. I really wonder why the investors bought this pitch, or what else SR told them.

Bekkedam until recently held the position of Chairman of the Board of Nova Financial Holdings, Inc. The current website for Nova, however lists Edward Di Marcantonio as the Chairman. Nova Financial operates Nova Bank, which operates in the greater Philadelphia area.

I see the SS reports that the Bankruptcy Judge has issued letters to all charities receiving $$ from Rothstein over the past 4 years to return it - because it was not his $ to give.
Hope he has issued the same letters to the BSO and FLPD cops paid for private security details. They were paid with the "same" illegal $$ as the charities were.

I do believe that even though they received the money, because they were part of Rothstein’s MO, they are in fact true victims of his Ponzi. Special consideration should be given on a case by case basis to see if they have the ability to return the money, perhaps over an extended period of time.

Thankfully, Bill Scherer was booted from the Hospital District by Jeb Bush when it became apparent Scherer was a corrupt thief. Jenne going down is exhibit 1 that when you lie with dogs you get fleas. All those Broward guys are corrupt and its just a matter of time before Scherer gets what is coming to him. They should investigate all the big contract deals he had his hands in at the hospital district. Word has it he traded big contracts for political contributions for candidates he supported so he could have influence.
Clawbacks:
1) As extensive as as this case is; is as extensive as the clawbacks will be.
2) A money-map will be created that follows it from Ponzi scheme to receiver, e.g., (and including) fundraiser events, etc. First, you ask the people to return the money or goods (simplest path); then you clawback under a variety of methods. And, if people knew or should have known that the money was tainted is a plus if you can prove it. It is normally difficult to retrieve all money. That is where various insurance companies join to pay up. Then the insurance investigators start their hunt, in this case I believe Kroll will be used to help, to find the money, retrieve it, make successive claims and work with law enforcement. Insurance companies are very diligent at this. Also, payouts from the insurance companies are highly dependent on what type of crime or fraud occurred and they may try and stop any payout. And, we have payouts from TD Bank as law enforcement and civil actions place liability on them - after everything is proved or they make a settlement.
My guess is that TD Bank will make a settlement if they believe they are in a losing position; and probably retract their expansion plans for Florida; or leave the state. We have yet to see significant answers to the various complaints. I am aware that many people in NJ are pulling their TD accounts, especially snowbirds who track SFla news.
Keep watching for first arrests, more civil complaints, complaints to the FL Bar, more complaints against TD Bank and other banks; and more amended complaints; and more complaints individuals and businesses. Also; watch for many (and I do mean many) cross-complaints for contribution.
What I think is important to watch for are the responses to the complaints in terms of affirmative defenses plus the results of discovery.
Remember that Mercedes Ken Jenne was driving for free back when he was Sheriff? Yep, it was Sherer's.

I am still troubled by a post from last night that stated how the "guardians" of overseeing accounting, receivership and the like are, in effect, pocketing the spoils for themselves. Modern day piracy and we don't even have to travel to the coast of Somalia. Why, in heaven's name, have the courts NOT frozen every account? Why is there no forensic accounting firm involved? Have the courts established a pecking order of entitlement to claims, for prioritizing who gets what sometime in the future, once the "what" has been identified?
The idea of those brought in to bring order to chaos as the next round of circling buzzards is very disturbing, to say the least.

What do I see: the payoff list is mostly Ft. Lauderdale.
This indicates that
1) the Rothstein scam is parochial and local. All the bluster about big hidden machinations is *just* bluster.
2) the payoff is misdirection
3) what was the business plan? Surely, someone in the Ponzi knew the mathematics of pyramids are unsustainable.
Ponzi work from several premises: a) self-delusion and ignorance of math, b) money laundring (the cost is sustainable) c) an alternative investment (usually illegal) that will make whole.
Hypothesis 1: Rothstein was delusional and math challenged. Levin, et. al., understood the math and used Rothstein as a pigeon. They thought he would take the fall and leave them clean as "victims".
2. Rothstein was an extortionist-- he thought the Epstein (or similar) extortion would come in summer 2009 and get him clear. The lawyers delayed and he could spin out the game any longer.
3. Rothstein was on the hook to someone running coke, gambling, or other dollars and didn't care what it cost if he could make clean dollars.

1) This is where the (severe) action will be:

4) Torts (me) I submit:
a. The $ volume of litigation here will be SO BIG, who is going to pay for it?
b) You will see many defendant attorneys motion to be relieved from this case due to non payment, or, substantial possibility of future non payment. (not to mention where is Def $ coming from)
c) You will see certain Defendants resort to Public Defender's office (so who are these people and how do they connect to corruption?0
d) Bail package for SR and others in the inner circle will be a major problem due to source of funds and who will sign (and will the feds let sign, as in using their homes as guarantees of SR's future appearances. (Feds will motion for immediate remand, no bail)
e) Many cases will be merged into one large matter.
f) There will bet at least 3-4 more amended complaints as new data is identified. However, counsel may be out of time for automatic amend and will have to seek leave of court; which will or may be opposed (not to worry, this is always given)
g) Cross-complaints, counter-claims, protective orders sought and court orders will be voluminous.
h) Who will administrate this case at the judicial level? I can suggest several ways.
i) Who will administrate any e-discovery and preserve the authenticity of the data?
j) Normal discovery will start soon: depositions, production of (other) documents, possibly interrogatories and RFAs to sew up ends), etc. There will be much argument over discovery, but there should not be since I do not believe there were thousands of documents, etc.
k) Def. counsel knows this is at a higher standard of proof because "fraud" hence preponderance is out the window, clear and convincing is in; and so Defendants will attempt to keep P counsel from reaching that standard of proof.
l) During the above process, and concurrent, more subpoenas will be issued as well as certain individuals arrested; hence discovery takes on a new tone.
m) People will/may flee or consider fleeing.
n) The new US fraud office needs this case as a showpiece for its newest fraud reduction initiative.
Now, connect the existing dots to:
- who will be on the bench for trial?
- who will comprise the JURY?
- who will be the pool for Voir Dire (jury selection)
- who will try and reach the jury
- who will be resident for appeal (Judge)
- who will hear emergency appeals (Judge)
- does SR or anyone else still have any Judicial pull as in "I have something on you..."

I, for one, believe that Mr. Rothstein came back to the United States, because he realized he was in above his head. In a sense, with the $$ generated by Mr. Levin and his "network," he realized that it had become a case of the "tail wagging the dog." That is, when the $$ amount was manageable (2008 levels), Mr. Rothstein felt comfortable in this alleged scam. But, enter Mr. Levin, with his serious $$ (2009 levels: $75mm/month) and his serious colleagues....well, the game changed.
Please don't stop, Mr. Norman.
Hopefully, the Federal authorities will pursue the serious $$ and network.

The civil case is a sham. A fun beginner. Headlines are nice. But it is going nowhere. Very little money will be recovered and pennies on the dollar won't be that interesting to anyone. Scherer is doing two things. He is not getting paid, (a contingent fee contract without a win = zero) but he has his name out nationally. That is big for any wanna be bigshot. Second, he is placing his client, Von A, on the offensive. This is smart as he may be trying to keep his client(s) from being indicted right along SR, as an accomplice(s).
The real case, the criminal case, will decide everything. Perhaps some of the civil Plaintiff's will eventually become criminal defendants and they will quickly forget their alleged civil claims.

However, aren't you aware that in Broward that it is simply and profoundly impolite to bring up social injustices of that sort.
Here in Broward you are supposed to shut your mouth and only get belligerent when one group off monied interests steal from another group of monied interests. Then and only then are the powers to be take action and run down to the courthouse and file suits and inform everyone that grave injustices have been thrust upon us all.
All you have to remember is that although there are 1.8 million residents in Broward, there are at most 50,000 people that keep up with the news and perhaps another less than 5,000 who actually have any input at all in how this whole thing runs.
With all that being said, a proper tribute should be given to Mr. Norman for seizing the opportunity and running with it.

That wikipedia page is awesome and a wiki would be a great format for our needs except for the fact that we would constantly be battling the revisionist histories of the guilty parties and their cronies. What we really need is a page moderated by a dedicated and honest pulp fan, perhaps that old fart Herb Caen Entertainment Award.
When I look at the list of characters in this mess, I'm astounded that, after keeping up with this blog, I could sit down with someone unfamiliar with this case and give detailed descriptions from memory on each of the individuals and their roles in this. The average page-turner novel has 4, 5, 6, maybe 7 characters to keep up with. This riveting story has dozens yet somehow my pea brain has been able to keep up. It's just that interesting.
Whatever format this ends up in, photos and videos must be included.

Exactly Paul. Levin seems to have mastered the part while having the gall to use the legal system, the justice system, to sue others to in an attempted double-down. And in fort lauderdale they may just be able to pull it off. Seems to me much of the so-called "anti-semitism" is a result of people having anger at the "victim mentality."

1. RRA was not co-counsel on the Eli Lilly case. That firm had ABSOLUTELY NOTHING to do with it. They were not counsel of record for anyone in the case.
2. He must be speaking with/working with Jeffrey Epstein's attorneys if he believes any depositions sought in the case were "inappropriate." It's not his case, he was not involved with the investigation, so how would he know whether or not it was appropriate to depose certain individuals?
3. He fails to mention that the Chiquita mass tort cases were CONRAD SCHERER'S cases!!!
He doesn't have the facts straight on any of the legitimate cases, not even HIS OWN FIRM'S case that SR was using in his Ponzi scheme. Shouldn't he disclose that to his clients or mention it in the Complaint. Seems a little fishy to me...

David Boden WAS NOT working there at the time. He used to run National Beverage.
But make NO mistake. He was DEEP in the turds. He was known/introduced/slated as "Scott Rothstein #2" He was to BE Scott when Scott was not there to make decisions. He was being GROOMED to take over for Scott. He was "General Council and EVERYTHING had to go thru him.
