Tough Holiday Season for Parents of Boynton Man Found Buried in Freezer

Stephen Febonio's parents may not feel like they have much to be thankful for this holiday season. Stephen's 76-year-old father, Edwin, who lives in Boynton Beach with his wife, Margaret, is a retired police detective from Peabody, Massachusetts. But instead of upholding the law, Febonio's two sons have tangled with it again and again. Now these aging parents are facing a new year with one son dead and the other looking at a possible 25-year prison sentence.

On March 16 of this year, Stephen Febonio's body was found in a locked freezer buried on land occupied by a Delray Beach marijuana grow house. Stephen, 45, had been missing for two years, since August 2007. He was allegedly shot in the head by a grow-house accomplice over an unpaid $10,000 debt.

And just this past September, the Febonios' younger son, Bryan, 41, who has had a history of drug abuse and served felony prison time, was charged with armed, masked robbery of a bank in Peabody -- a charge that could carry a prison term of 25 years if he is convicted.

Jose Alfaro: His "big mouth" might do him in.

Stephen had been running with a bad crowd. Two years before his disappearance, he'd been arrested and charged with two felony counts of assault and battery after a dust-up on Key West's Duval Street.

At the time of his disappearance, he was allegedly involved in building marijuana grow houses with his friend Jose Alfaro. Before he left home the night of his murder, he told his father that if he didn't come back to search for a note in the bedroom of the Boynton Beach house he shared with his parents. He never returned.

Jose Alfaro, of Deerfield Beach, was indicted and extradited back to Florida from New York this month. He was booked into the Palm Beach County Jail on December 3 on charges of premeditated murder. Alfaro allegedly bragged about Febonio's murder to acquaintances, according to PBSO Det. Sean Oliver.

But there might be one piece of good news for the Febonios this year: Fort Lauderdale criminal attorney Brian Silber, a former state prosecutor, has speculated on his blog that Alfaro's "big mouth" may make prosecution of this murder case a breeze. "Even with heresay there are exceptions where statements made by the party will be admissible," Silber told us by phone, adding that the friends Alfaro bragged to will likely be called to testify by prosecutors. "It's one of our frustrations as criminal defense lawyers that defendants don't always exercise their constitutional right to remain silent."

Jose Alfaro, AKA Phillip Durante, AKA Julian Kayne, you got what you deserved. From Costa Rica to NY, you ran but couldn't hide.
To the victim's family, may your son rest in peace. The same friends that you screwed are the same ones who turned you in, Jose.

Your Buddy..

By the way buddy...being a snitch is one thing, but being a snitch on someone who didn't do the crime simply cause he screwed you over...is called purgery. Don't worry though, to all you trying to get revenge on someone by falsly testifying against them, he'll be out soon enough. Good luck!

Stacy Beringer says:

Sorry Gail,

I'm not interested in fueling this sad, mis-guided, mis-informed media fountain. I'm sad though, to see in our society that ANYTHING can be printed in a newspaper, shown on a news broadcast, or posted on the internet.

It's funny how the majority of society truly believes that cops never lie for their own gain. Even when you're selected for jury duty involving the testimony of a law enforcement officer, the judge always asks the potential jurors, "Do you think that a police officer's word is always true over that of a private citizen's word?" Even the judges know that most cops are deceitful. It's unfortunate that truth is no longer the objective of the media, just looking for the best way to spin any story so that it gets the maximum amount of hype and ratings possible.

It's all pretty sad when criminals associating with criminals, turns into this kind of one sided story where the victim is always portrayed as a saint. The media should be focusing more on fact than speculation. No articles state that the victim had a warrant for his arrest at the time of his disappearance.

I'm just really suprised and disappointed at the way our society functions. The kind of sadness that almost makes me ashamed of being American. We run around the world telling other cultures how to structure their societies, but when it comes right down to it, we're so focused on the wrong things, that we'll probably never even straighten out our own issues. Unfortunately that fact may be the ultimate downfall of the empire that we so proudly call a democracy.

So in response to your request, I'm sorry but talking to the media never solves anything. Your Buddy may want to comment if the cops allow him to...as he is a confidential informant(CI) that is working for them. Maybe he'll give you a quote from his false testimony. I'm sure it would be printed without verification, as is par for the media.

Posted On: Sunday, Dec. 27 2009 @ 9:26PM
gail shepherd says:

@Stacy, your comments are appreciated but I hardly think the victim was portrayed as a "saint" here. As noted in the post, he had a prior record (take a look at the photo; it's a mug shot and is labeled as such). I am curious though -- where do you think reporters are supposed to get their information if not by talking directly to human sources? "Facts" do not grow on trees, ripe for the plucking. Talking to the media actually DOES help resolve just the issues you're worried about: in this way information gets verified -- or not.

Your Buddy 2 says:

"Stacy Beringer", sounds like you would be interested in paying his lawyer and private investigator fees. Anyway, Jose Alfaro killed his buddy Stephen Febonio because of a dispute over $10,000 from a marijuana grow house in Delray Beach. Bottom line is...its wrong. It doesnt matter what Stephen's character is or was. Two wrongs dont make a right.

Jose Alfaro made incriminating statements to multiple people, therefore, you can not point to anyone in particular. Even so, it was the right thing to do. Jose ran to Costa Rica, almost made it off the plane, and was flown back to the U.S. He then ran to NY, made a few mistakes, and made it easy to apprehend him.

The body was not located from 2007 to 2009. It was found because Jose bragged about it to MULTIPLE persons. It was in his backyard, buried in the ground, in a freezer. He moved it around and stored it in his friends house, which by the way was at one point burglarized and the fridge was opened.

So, the defense is that the note that the victim left in his room is fake, someone else killed Stephen AND buried him in Jose's backyard?? AMAZING. Oh and someone also planted Jose's fingerprints on the freezer, right??

And by the way, "Stacy", you say...... "he'll be out soon enough. Good luck!"
Be careful, that almost sounded like you are leaving a threat, "Stacy". We wouldnt want you charged with tampering or threatening...

Any information contained herein is no secret, and is known to law enforcement already. By the way, MANHUNTERS will feature his capture on January 14th.

And...this will be my final response and comment.

So Stacy, are we to believe Steven was some mass murderer running around posing as a dry wall expert and was doomed to eternity stuffed into a 4×4 freezer posing as an overgrown popsicle? That Jose did society a favor by killing this dude, turning him from a cryogenic experiment to a puddle of goo buried in some yard because he was just trying to do the right thing? Haha! Yeah.

It’s just a good damn thing Jose has that baby face and those big ears on him. Those two things will make him mighty attractive in prison. The face will draw them in and those ears will give his celly something to hold onto while he’s getting karma right up the ass.

Truly Shocked says:

I grew up with Jose and always saw him as a good kid with a little bit of a wild side. We were roommates for a few years, both in Boca and Poughkeepsie, the funnist and most memorable years of my life. There was never a dull moment when hanging with Jose...aahh the memories. The Jose I know didn't have the ability to murder in him so I have my doubts as to him being guilty, but I guess people can and do change. It's sad to see things end this way for him, and my prayers go out to his family...especially his mother whom he has put through hell with all this nonsense. I also feel for Steve's parents, and hope that they are able to find comfort by remembering their son and his accomplishments...although I have never met him.

Stacy says:

Your Buddy....I'm sure that you must have your facts straight about the motive of a $10,000 debt. You must have been there right? Which if that was all true, you must be in the business of cultivating pot! You also seem to be certain that he did, in fact, kill Stephen which implies that you were witness to the alleged incident. So if you saw it with your own two eyes that would make you an accessory?

Money as a motive is pretty farfetched since he was a very generous person. Helping people make their house payments, letting people live with him because they had nowhere else to go, yeah that really sounds like a horrible person!

You want to talk about threats and tampering? OK, where did you get info about fingerprints? You must have gotten it directly from the officers that you are working with? Leaking case info would be considered interference in an official police investigation. Maybe you should be the one watching what you say. Especially since evidence of that nature is not listed in the indictment.

By saying "good luck" is not a threat or tampering. But it's easier to slander someone when they aren't face to face. I bet you wouldn't have the balls to say it to his face! You know that he is not a violent person and isn't bothered by rumors so there will be no threat to you when he gets out. But having to put on your second face and act like you're happy that he was cleared will be quite awkward for you.

All these rumors that have spawned the grand jury indictment are the result of "friends" trying to look cool by telling other people not to mess with them because of their "friendship" with "Jose the murderer"! All those alleged bragging sessions came from a third party's mouth, not Jose's. Drug addicts that are also addicted to drama and gossip don't make for very reliable hearsay witnesses.

I did happen to catch the episode of "Manhunters" and they too have quite a bit of incorrect information. His tattoo is not CSA, and is not gang related. This is why I'm amazed at the amount of bad info that can be used to accuse someone of murder. It's all quite sad really.

And as for "Anonymous" maybe you're the gossip queen that should get your facts straight! If you check Jose's arrest record you will see that he doesn't have any firearms charges. Way to add to the pool of bad info! You seem to be certain that he did it too, were you there? Didn't think so!

Stacy says:

If they have such a good case...why didn't they arrest him when he flew back from Costa Rica? They let him leave the airport! Murder suspects aren't just allowed to walk away after being detained for 2 hours at the airport. This case is going to fall apart when it gets to trial. Waste of tax payer's money if you ask me.

Just sayin' says:

My guess is Febonio was killed either because he was an informant or he had given evidence against somebody.

Posted On: Thursday, Jan. 21 2010 @ 1:12PM
Amazed says:

The point of the story is that most of what I've seen printed as news on this site is incorrect information obtained from law enforcement officers that couldn't tell their asshole from the asshole mugging the old lady standing next to them! Yet they seem to be able to take any info off the street from a confidential informant, use it to investigate or accuse someone without evidence, and all this results in multiple people's lives not only being splattered all over the news but having their reputations ruined even before they are proven guilty!

If the media wants to use the "People have a right to know!" scape goat to get ratings, they should atleast have to wait to post any info until it's been proven beyond a reasonable doubt in a court of law and the defendant has been found guilty.

But I guess old news doesn't have the same effect as fairy tale news! I'm quite sure that people who are found innocent would not get near as much media coverage as those who are found guilty. That speaks volumes about society's character as a whole. It's ok to ruin someone's life without proof; it's just not profitable to clear their name once you've ruined it.
